Pour la France, les données analysées ne concernent que la Cour de cassation. Mais le choix d'analyser les citations croisées de 2000 à 2007 sur 10 cours est très intéressant. Cela offre des perspectives pour la norme ECLI, et démontre qu'il était utile qu'on se préoccupe de normaliser ces citations.

Nous avons numérisé des ouvrages dont les auteurs sont morts depuis plus de 100 ans, donc tombés dans le domaine public. Or, en demandant l'autorisation à des éditeurs (en l'occurrence Hachette et Nathan) de numériser des ouvrages plus récents, ceux-ci nous ont posé une interdiction généralisée de reproduire l'ensemble de leurs ouvrages anciens ou récents. Les éditeurs peuvent-ils s'opposer à la reproduction d'un ouvrage tombé dans le domaine public en avançant le fait que les droits de reproduction leur ont été cédés ?
