The U.S. Supreme Court ruling on June 26, 2013 that struck down Section 3 of the Defense of Marriage Act (DOMA) means that same-sex binational couples are now entitled to all the same rights and privileges of marriage accorded to opposite-sex couples. The biggest right of all - immigration rights, and the right of an American citizen to sponsor a foreign partner for permanent residency (i.e., a green card), is now ours! The U.S. Supreme Court released three decisions today, none of which were the closely watched cases on same-sex marriage - DOMA and Proposition 8. The next possible dates for a decision are Monday, June 24 or Thursday, June 27 -- although the Court has been known to extend landmark decision announcements to the last possible day of the term. That would be Friday, June 28.


The decision on the constitutionality of Section 3 of DOMA is paramount for same-sex binational couples. If Section 3 of DOMA is struck down, it would mean same-sex binationals could at last access immigration rights for foreign-born spouses. Immigration rights are one of the more than 1,100 rights gay and lesbian married couples are barred from receiving due to DOMA.

Yes, it's true that of the 11 million who will move forward with immigration reform, there are an estimated 267,000 gay and lesbian immigrants. Some of those may even be in same-sex binational relationships. But the majoirty of those 267,000 will move forward -- while 40,000 same-sex binational couples are left out -- not because they are LGBT, but because they fit into another category. Make no mistake - there is nothing in this for same-sex binationals, or LGBT people as a community. It blatantly discriminates against us. It is not comprehensive, and we must make our voices heard that any legislation that goes forward that writes discrimination into it needs to be fixed, not given a pass by our community.

Ross' screenplay was inspired when his boyfriend was denied immigration status and, without the option of a nationally recognized marriage to keep him in the United States (DOMA denies federal benefits to legally married same-sex couples), had to move back to England.
