The U.S. Supreme Court ruling on June 26, 2013 that struck down Section 3 of the Defense of Marriage Act (DOMA) means that same-sex binational couples are now entitled to all the same rights and privileges of marriage accorded to opposite-sex couples. The biggest right of all - immigration rights, and the right of an American citizen to sponsor a foreign partner for permanent residency (i.e., a green card), is now ours! "The president laid out an eloquent vision this evening of an America where everyone plays by the same rules, and shares the same opportunities and chances,” [Steve] Ralls [from Immigration Equality] said. “The tens of thousands of LGBT binational couples who live every day with the threat of separation, or are already separated or in exile, want nothing more than that.”


Under current law, straight Americans can sponsor their foreign spouses for residency in the United States. That option isn’t available to gay Americans seeking marriage-based green cards for foreign same-sex partners. Legislation known as the Uniting American Families Act would rectify this situation.

"Until recently, I lived with my partner Melody together at our Delaware home. However, were are now forced to live apart after being together for ten years, because we are a bi-national same-sex couple living in a world that seems incapable of accomodating us and treating us equally. Because of the Defense of Marriage Act, Melody is 3,500 miles away from me and there isn’t anything I can do about it – until DOMA is struck down or repealed – unless the U.S. government implements some policy changes to keep our family together."

Washington Has Enough Votes to Legalize Gay Marriage

The state House is widely expected to have enough support to pass gay marriage, and Gov. Chris Gregoire publicly endorsed the proposal earlier this month. However opponents have already said they would challenge any new law with a public referendum.
