United by Love, United by Law
This site was formerly known as "United by Love, Divided by Law." The U.S. Supreme Court ruling on June 26, 2013 that struck down Section 3 of the Defense of Marriage Act (DOMA) means that same-sex binational couples are now entitled to all the same rights and privileges of marriage accorded to opposite-sex couples. The biggest right of all - immigration rights, and the right of an American citizen to sponsor a foreign partner for permanent residency (i.e., a green card), is now ours! Thank you for visiting and your support. - Kathy Drasky, Volunteer Media Coordinator, Out4Immigration, 2006-2013.

VICTORY! Supreme Court's DOMA Decision Grants Same-Sex Binational Couples Federal Immigration Rights

VICTORY! Supreme Court's DOMA Decision Grants Same-Sex Binational Couples Federal Immigration Rights | United by Love, United by Law | Scoop.it

The Supreme Court of the United States (SCOTUS) struck down Section 3 of the federal Defense of Marriage Act (DOMA) on Wednesday, June 26, 2013, and declared that same-sex couples who are legally married deserve equal rights to the benefits under federal law that go to all other married couples.

Of the more than 1,100 federal rights no one is more critical to same-sex binational couples than immigration - or the right of an American citizen to sponsor a foreign-born spouse for permanent residency, or a green card.

Statement from Secretary of Homeland Security Janet Napolitano

“After last week’s decision by the Supreme Court holding that Section 3 of the Defense of Marriage Act (DOMA) is unconstitutional, President Obama directed federal departments to ensure the decision and its implication for federal benefits for same-sex legally married couples are implemented swiftly and smoothly.  To that end, effective immediately, I have directed U.S. Citizenship and Immigration Services (USCIS) to review immigration visa petitions filed on behalf of a same-sex spouse in the same manner as those filed on behalf of an opposite-sex spouse.”

Catriona Dowling got the news early Wednesday from a friend by text message. Her wife, Cathy Davis, heard it shouted by a neighbor upon returning from taking their children to an ESL summer school program. And just like that, this same-sex binational couple's struggle to stay together in the U.S. got a whole lot easier. Now they, and some 40,000 other couples in similar situations will be able to apply for green cards for the foreign spouse - a right that was denied gay and lesbian couples under DOMA.

DOMA's Defeat a Clear Victory for Same-Sex Binational Couples

DOMA's Defeat a Clear Victory for Same-Sex Binational Couples | United by Love, United by Law | Scoop.it

Of all the many ways in which DOMA harmed same-sex couples and their families, immigration was surely one of the cruelest. DOMA placed a dark cloud over same-sex binational couples, forcing them to live in fear of separation. US citizens, in order to stay together with a foreign same-sex spouse or partner, were often forced to choose between the person they love or the country they love – a choice no person should have to make.

All that changed on Wednesday when the Supreme Court of the United States (SCOTUS) struck down section 3 of DOMA. Legally married same-sex couples now have access to federal marriage rights - among those, the prize for same-sex binationals: immigration rights, or the right of an American citizen to sponsor their foreign spouse for a green card.

One right, however, that this same-sex binational Florida couple will receive is the right of the American citizen to petition for a marriage-based green card for his husband. Immigration law recognizes any marriage that is legal -- that is if you were married in a state, jurisdiction or country where marriage equality exists, then the federal government must recognize your marriage, regardless of the state you reside in.

The Supreme Court victory in United States v. Windsor striking down the discriminatory federal Defense of Marriage Act (DOMA) affirms that all loving and committed couples who are married deserve equal legal respect and treatment from the federal government.

The demise of DOMA marks a turning point in how the United States government treats the relationships of married same-sex couples for federal programs that are linked to being married. For same-sex binational couples, federal immigration rights are now available to those who have been legally married in a state, country or jurisdiction where there is marriage equality.
