BP guilty of 'gross negligence'

A U.S. District judge on Thursday ruled that BP was “grossly negligent” in the 2010 Deepwater Horizon explosion that killed 11 men and allowed millions of barrels of oil to flow out of the Macondo oil well into the Gulf of Mexico.

“The court concludes that the discharge of oil was the result of gross negligence or willful misconduct,” by BP, the ruling from U.S. District Court Judge Carl Barbier said. He found that BP was at fault for 67 percent of the spill. Two other companies involved—Transocean and Halliburton—were responsible for 30 and 3 percent, respectively. 

“The law is clear that proving gross negligence is a very high bar that was not met in this case,” BP said in a statement. “BP believes that an impartial view of the record does not support the erroneous conclusion reached by the District Court. The court has not yet ruled on the number of barrels spilled and no penalty has been determined. The District Court will hold additional proceedings, which are currently scheduled to begin in January 2015, to consider the application of statutory penalty factors in assessing a per-barrel Clean Water Act penalty.”

While In New Orleans, the luxury real-estate market is bouncing back, boosted by homeowners who want to stay in the city; historic homes, prime locations for Mardi Gras.

PIRatE Lab's insight:

While there are many coming back to New Orleans, this article (as you would expect in from the Real Estate folks in the Wall Street Journal) strongly emphasizes the high-end offerings of mostly well paid professionals.  You have to read between the lines to actually figure this out (and know something of the geography of the City.  Suffice it to say that these neighborhoods and houses being touted here are all on the highest or relatively high ground regions of the city.  The lower elevation areas (away from the riverbank) have not recovered anywhere near the descriptions in this article.  It is precisely because there is so little housing stock in higher elevation areas that these prices are jumping up.

 

Again, this is actually a story of haves and have nots.

This mayor, who sought personal profit and position even in the wake of Hurricane Katrina, is finally sentenced.  This sorry political leader would use any tools at his disposal (divisive rhetoric, payola, etc.) to improve he and his children's position, the city and the public be damned.

ianEvery two weeks, a swath of Louisiana the size of this city's French Quarter vanishes into the Gulf of Mexico. Since the 1930s, the state has lost nearly 1,900 square miles, a quarter of its coastal land area.

PIRatE Lab's insight:

When we were last in New Orleans (March 2014), we were hosted at the law offices of the firm who filed the lawsuit.  While lawsuits are always regrettable and it would be wonderful if we could settle our disagreements outside of this confrontational arena, this suit has been a long time in coming.  

 

The oil and gas industry have themselves agreed in the past that their operations were responsible for at least 32% of the wetland loss via not meeting their agreed to mitigation actions post-drilling (primarily filling in excavation channels/ripped up segments of wetland).  

 

The political opposition to this has been massive and overwhelming with multiple laws being proposed to legally ban the lawsuit before the plaintiffs have a chance to have their say in court.  If those same actors put as much energy into effective coastal management and restoration, we would all be better off.

This "risk reduction system" (we are not supposed to call it a "storm protection system" anymore) is certainly an improvement of our previous levels of protection, but to think that this will stop a "once in a century" storm is beyond laughable.  With a fraying network of wetlands, this city is more and more at the literal edge of the sea.  Not a good place to be given the elevational situation of the city (~50% is now below sea level thanks to subsidence, groundwater extraction, etc.).
