"California State Judge Affirms State's Obligation to Underserved English Learner (EL) Students, after ACLU is Aided in Case by U.S. Department of Justice
The American Civil Liberties Union (ACLU) of Southern California found an ally [with the U.S. Department of Justice's lawsuit ]charging that the state abdicated its obligation to ensure all students classified as English learners get extra instructional services to become fluent in English. They won the lawsuit, which was filed in April 2013 and set for a one-day trial [in the summer of 2014] in Los Angeles County Superior Court. The state's Department of Education and Board of Education 'have the duty, the data and the tools' to meet their responsibility under federal law, Jocelyn Samuels, Acting Assistant Attorney General for Civil Rights at the U.S. Department of Justice, wrote in a [accompanying] brief for the case this summer."
