Si le nombre de lois promulguées est en hausse, le nombre d’ordonnances, décrets ou arrêts publiés est quant à lui en baisse. Le stock de normes actuellement en vigueur reste néanmoins toujours aussi important et il est même globalement en hausse.

How to Improve the Explanatory Power of an Intelligent Textbook: a Case Study in Legal Writing | International Journal of Artificial Intelligence in Education
Explanatory processes are at the core of scientific investigation, legal reasoning, and education. However, effectively explaining complex or large amounts of information, such as that contained in a textbook or library, in an intuitive, user-centered way is still an open challenge. Indeed, different people may search for and request different types of information, even though texts typically have a predefined exposition and content. With this paper, we investigate how explanatory AI can better exploit the full potential of the vast and rich content library at our disposal. Based on a recent theory of explanations from Ordinary Language Philosophy, which frames the explanation process as illocutionary question-answering, we have developed a new type of interactive and adaptive textbook. Using the latest question-answering technology, our e-book software (YAI4Edu, for short) generates on-demand, expandable explanations that can help readers effectively explore teaching materials in a pedagogically productive way. It does this by extracting a specialized knowledge graph from a collection of books or other resources that helps identify the most relevant questions to be answered for a satisfactory explanation. We tested our technology with excerpts from a textbook that teaches how to write legal memoranda in the U.S. legal system. Then, to see whether YAI4Edu-enhanced textbooks are better than random and existing, general-purpose explanatory tools, we conducted a within-subjects user study with more than 100 English-speaking students. The students rated YAI4Edu’s explanations the highest. According to the students, the explanatory content generated by YAI4Edu is, on average, statistically better than two baseline alternatives (P values below .005).

Après plusieurs années d’expérimentation, d’échanges de couloirs et d’une quête de formalisation de ces échanges, j’ai décidé de consacrer mon travail d’habilitation à diriger des recherches au sujet qui réunit sans doute le plus d’enseignants-chercheurs en droit, sans cloisonnement disciplinaire, et auquel nous consacrons finalement trop peu de temps : l’enseignement.
Avant de finaliser mon ouvrage consacré à ce sujet et qui vise à identifier des tendances, valoriser des pratiques, discuter de démarches, j’ai souhaité infirmer ou confirmer certaines observations et obtenir un meilleur panorama des pratiques, en réalisant une enquête quantitative.L’enquête a été menée entre le 15 janvier 2024 et le 1er avril 2024.
Les résultats synthétisés ci-après nous offrent des pistes de réflexion et de collaborations intéressantes. Certains enjeux méritent assurément d’être approfondis tels que la variété des exercices, la fabrication des supports de cours, la structuration des enseignements et les espaces dans lesquels nous les dispensons. D’autres questions montrent également l’engagement important des enseignants et enseignantes, en France et à l’étranger et rassurent sur la force collective dont nous pourrions faire preuve grâce à cet engagement, parfois passionnel, envers notre belle profession.
Mais c’est aussi l’isolement, le manque d’accompagnement, parfois le regret des effectifs démesurés, inversement proportionnel des moyens engagés, qui se retrouvent au gré des réflexions portant sur la pédagogie.
Au final, les résultats des réponses apportées par 355 personnes sont exploitables. Ce panel est assez significatif, et me permet d’obtenir des regards variés, comme la présentation des personnes ayant répondu à l’étude le montrera. J’ai souhaité conservé le plan de présentation du questionnaire pour présenter les résultats ci-après afin de respecter l’ordre dans lequel les répondants et répondantes ont été amenés à résonner.
Je me suis également efforcée de ne pas engager mes réflexions personnelles dans ce document. Il est ici question de dresser un constat, un bilan. L’analyse critique sera offerte dans le cadre de mon ouvrage dédié à l’enseignement du droit, qui accueillera les résultats de ce questionnaire en annexe.
Il faut entrevoir la présentation intermédiaire de ces résultats comme une nouvelle étape dans ma démarche de reconstruction collective de nos pratiques enseignante en droit. En diffusant les résultats de l’enquête dès à présent, je souhaite recueillir de nouvelles réactions, propositions, susciter des discussions qui viendront enrichir l’ouvrage qui sera finalement soutenu dans le cadre de mon habilitation à diriger des recherches.
Au final, l’enthousiasme dans les réponses au questionnaire, les encouragements témoignés en faveur de cette thématique de travail, en particulier par des personnes que je ne connaissais pas, ont renforcé ma conviction de poursuivre cette investigation scientifique.
Aujourd’hui, la confiance témoignée par ces personnes, qui m’ont parfois confié des informations importantes et même personnelles, le temps qu’elles ont pu trouver pour répondre à l’étude, m’honore et m’oblige. Grâce à toutes ces forces, mon ouvrage ne sera pas celui d’une personne seule mais d’une personne forte de centaines de regards.
Il est donc temps d’arpenter ensemble ce chemin de la réflexion, carrefour passionnant entre le droit et son enseignement.
