If you have a foreclosure pending or are behind on any debts, don’t play it alone. Recently, Mr. Taieb filed a Chapter 13 and devised a plan to help a gentleman reorganize his debt and save both of his homes. In addition, since he filed Chapter 13, one of the mortgage companies has given him a trial payment plan which will hopefully result in a permanent loan modification.

The worst thing you can do is to wait for the workers’ compensation settlement to arrive before filing for bankruptcy. If and when you receive your settlement, it may not save you from foreclosure because you may not get enough to reinstate the mortgage, and/or you may not get the settlement until after the foreclosure is finalized.

On April 1, 2019, the US government updated the Federal Register with new bankruptcy exemptions and Chapter 13 debt limits. Because of the increase in exemptions, it could make a difference whether you have to file a Chapter 7 or Chapter 13. Thus, the new exemptions can help you qualify for a Chapter 7 when you didn’t before or lower your payments to general unsecured creditors in Chapter 13.

A senior came to TAIEBLAW who has a very good income on paper but is getting killed by the credit card payments each month since they are over 30% interest. The senior is able to file a Chapter 13 plan to substantially eliminate a large chunk of her debt.

Recently, a lady from Burlington County came to TAIEB LAW who earns a very good salary but had to take care of her child who got sick. As a result, she fell behind on her rent and numerous other bills. In this situation, Mr. Taieb was able to file a Chapter 13 petition to help this woman since she did not want to lose her apartment to eviction.

If you are stuck with debts because you had a fiancé who was a problem, you may have to file a bankruptcy to get a fresh start. If you made a mistake and incurred debt because of a poor choice in your relationship, you can either file a Chapter 7 or Chapter 13 depending on your circumstances.

If you feel that a creditor violated your discharge, a Bankruptcy Court can still hold the creditor liable for civil contempt sanctions if the creditor has no objectively reasonable basis for concluding that it’s action violated the discharge order.
