(Reuters) - A widow has filed a wrongful death lawsuit against Marion Suge Knight, accusing the rap mogul of carelessly striking and killing her husband with his pickup truck during a fight outside a Southern
Steven M. Sweat's insight:

If the allegations are true that Suge Knight intentionally ran over a person with his truck after an argument, I think a civil judgment against him may be likely.  However, trying to hold Ice Cube and Dr. Dre and their production company liable, will be a much tougher legal battle.  The argument made in the lawsuit is that the meeting where the incident took place was set up by the production company.  It will probably have to be proven that the officials were acting on behalf of the production company and that they knew or should have known that this type of incident was likely or at least probable.  We will continue to monitor and follow this case.

It is bad enough to be involved in a motor vehicle accident.  There is plenty to worry about like: getting your car repaired, getting a rental car, getting medical treatment if you were injured, dealing with insurance claims for bodily injury and property damage.  In and around Los Angeles, there is now another worry: getting rippped off by an unscrupulous towing company!  Beware of anyone that seems to suddenly "appear" at the scene of an accident offering help.  Oftentimes, these companies take advantage of a vulnerable moment to take possession of your vehicle and then charge exorbitant fees for storage and other expenses.

The westbound lanes of the 118 Freeway reopened in Granada Hills on Monday after a fiery double-fatal crash closed the roadway for more than five hours during the morning commute.

This accident occurred at approximately 3:00 a.m.  The early morning hours are particularly prone to car accidents.  Many things factor in to this including driver fatigue and sometimes alcohol impaired driving.    The article notes that further investigation and toxicology screenings will follow to determine the cause of this particular crash.  As a California car accident attorney and wrongful death lawyer, I have seen many similar accidents occurring in the early morning time frame on southland freeways.  It is always important to remain alert and focused when driving at night or in the early morning.

Police are checking Bruce Jenner's phone records amid claims he was texting at the wheel as his Cadillac Escalade ploughed into the back of another vehicle, leaving its driver dead.

As we all know, distracted driving of any type is a huge cause of motor vehicle collisions in Los Angeles and everywhere else in the U.S.  Photographic evidence seems to indicate that Bruce Jenner was smoking behind the wheel and his cell phone records have been subpoenaed to determine if he was also texting or talking on his phone prior to a recent traffic collision near L.A.  A citation could be issued for the cell phone use, if proven.  Both the smoking and texting and driving could also be used as grounds for a civil claim for damages based upon a legal theory of negligence under the laws of the State of California.

According to the latest statistics available (2011), there were 3,700 car accidents related to drowsy driving in California in a 12 month period.  Even a few hours of missed sleep can affect ones ability to operate a motor vehicle effectively.  This is especially true on longer drives.  If you feel yourself getting sleepy ....


  • Pull off the road
  • Consume the caffeine equivalent of 2 cups of coffee
  • Take a 20 minute nap to wait for the caffeine to kick in


Don't let drowsy driving cause you to wreck your vehicle and injure yourself or someone else!

Yes, even Super Models get in car wrecks in Los Angeles.  In fact, statistics show that there is an accident about every minute thirty seconds in the City of Angels.  Most of them occur on freeways like this incident.  Most freeway accidents are attributable to one of two legal causes as follows:


  1. Following too closely (also known as "tail gating"): In violation of CA Vehicle Code section 21703, which is usually implicated in most all rear end collisions;
  2. Making and unsafe lane change abruptly or without signaling: A violation of CA Vehicular Code sec. 22107.


In this case there is some indication as well that the driver who hit Ms. Kerr was under the influence of alcohol or drugs ( a violation of section 23152 of the CA Veh. Code).
