Unabhängig davon ist zu befürchten, dass die – nach den Snowden-Enthüllungen von US-Präsident Obama in der PPD-28 angeordneten – partiellen Sicherungen des Datenschutzes für Nicht-Amerikaner bei der geheimdienstlichen Überwachung außer Kraft gesetzt werden. Auch wenn dies noch nicht geschehen ist, warnen schon jetzt maßgebliche Vertreter der US-Politik und -Wirtschaft, darunter auch republikanische Kongressmitglieder, vor einem solchen Schritt, denn spätestens damit würden die US-Zusicherungen, darunter die Erklärung des US-Geheimdienstkoordinators im Rahmen der Privacy Shield-Verhandlungen obsolet.

Vor diesem Hintergrund muss die EU-Kommission unverzüglich handeln. Sie darf mit der Prüfung, ob die Voraussetzungen für den Angemessenheitsbeschluss zum Privacy Shield noch gegeben sind, nicht erst bis zur regulären, für Sommer 2017 vorgesehenen Review des Privacy Shield warten. Das heutige Statement von EU-Justizkommissarin Vera Jourova beim Treffen der EU-Justizminister in Malta deutet darauf hin, dass sich die Kommission des Ernstes der Lage durchaus bewusst ist. Das Abkommen "beruhte weitgehend auf dem Vertrauen, das wir in die amerikanischen Partner hatten, zur Obama-Regierung", sagte Jourova. "Dieses Vertrauen muss andauern oder erneuert werden."

The mass surveillance of the Internet conducted by the Government Communications Headquarters (GCHQ), a British intelligence and security organization, was unlawful, according to a ruling by the Investigatory Powers Tribunal (IPT), a secretive court that was created to monitor Britain’s intelligence agencies.

According to the IPT ruling, GCHQ’s access to information, intercepted by the U.S. National Security Agency (NSA), violated Article 8 of the European Convention on Human Rights, which protects the right to a private and family life. In addition, the GCHQ spying also breached the rights to a fair trial, The Independent reported, adding that the latest court ruling could eventually allow people to ask GCHQ to delete any information.

Un pas de plus vers le réglement européen sur la protection des données privées

C'est un premier pas symbolique vers l'adoption du règlement européen sur la protection des données. Le Parlement de Strasbourg vient en effet de voter en première lecture ce texte en y intégrant plusieurs amendements contraignants dont un renforcement des amendes.


 Ils prévoient qu'« avant de communiquer les données personnelles de citoyens européens à un pays tiers, toute entreprise (par exemple un moteur de recherche, un réseau social ou un fournisseur de services d'informatique en nuage) serait tenue de demander une autorisation préalable à une autorité nationale de protection des données dans l'UE ».

First: the online world is coming to benefit every aspect of our lives, bringing innovation, convenience and efficiency.

And no wonder. New innovations like the cloud offer a hundred-billion euro boost to Europe.

 

We cannot turn our backs on those benefits. But, with that growing spread, online threats have correspondingly growing consequences. And a lack of trust can only hamper widescale use, and constrain those benefits.

 

Second: risks are mounting. According to Symantec, the total number of attacks increased by 81% in just one year. In ever more forms: from identity theft and phishing — to botnets, Trojans and denial-of-service attacks. And more besides.

 

Third: these risks imply significant costs. Each year, many businesses, if not the majority, face security breaches: even for a smaller business, the cost can be tens of thousands of euros per breach. For a major incident the cost could amount to over a quarter of a trillion dollars. Let's hope that doesn't happen.

 

But let's not get confused between the different issues in play here. Let's understand the situation, recognise which tools we have available, and use the right one for the right job. Let's not confuse privacy with security, or confidentiality with integrity.

 

Data protection is a fundamental right that we must safeguard. People have a right to know and control how their data is used.

Not least because the further data is spread, it more vulnerable it becomes.

In the resolution, approved by 483 votes to 98 with 65 abstentions, MEPs express serious concern over PRISM and other surveillance programmes, strongly condemn spying on EU representations and call on the US authorities to provide them with full information on these allegations without further delay.

 

Parliament also expresses grave concern about allegations that similar surveillance programmes are run by several EU member states, such as the UK, Sweden, The Netherlands, Germany and Poland. It urges them to examine whether those programmes are compatible with EU law.

 

Stronger data safeguards urgently needed

 

Parliament calls on EU countries to speed up their work on the whole data protection package and urges the Commission and the US authorities to resume negotiations on the data protection agreement without delay.

Le quotidien allemand Der Spiegel et le britannique The Guardian ont publié ce week-end de nouvelles informations sur le programme Prism de la NSA qui révèlent un espionnage généralisé y compris et surtout en direction de leurs « alliés ».



Dès lors, les réactions indignées se multiplient et c’est désormais le ministre des Affaires étrangères Laurent Fabius qui demande des explications dans les plus brefs délais et qui précise : « ces faits, s’ils étaient confirmés, seraient tout à fait inacceptables ». la ministre de la Justice Christine Taubira en rajoute dans l’indignation en parlant

 

                    ===> « d’un acte d’hostilité inqualifiable ». <===

 

Dans toute l’Europe, les commentaires sont équivalents et la menace pèse désormais sur la négociation d’une zone de libre échange atlantique actuellement en discussion.

 

« On ne peut pas négocier sur un grand marché transatlantique s’il y a le moindre doute que nos partenaires ciblent des écoutes vers les bureaux des négociateurs européens », indique Vivane Reding, commissaire européen à la Justice.

Die EU regelt den Umgang mit Daten von Internetnutzern und Flugreisenden neu. Wer im Netz surft, Daten ins Internet stellt oder den Dienstleister wechselt, bekommt mehr Rechte. Für Reisende sieht es anders aus. Wer ins Flugzeug steigt, der muss sich künftig vom Staat stärker auf die Finger schauen lassen.

 

Gust MEES's insight:

British Prime Minister David Cameron has announced that, should the Conservatives win the general election in May, they will ban forms of communications which can’t be accessed by law enforcement if they have a warrant. It appears that messaging apps which use encryption will be banned in the UK.


There are a number of reasons why this idea is a flawed knee-jerk reaction to the tragedies which happened in Paris. Here, F-Secure looks into them…

US-Behörden wollen Verschlüsselung zuvorkommen.

 

SSL-verschlüsselte Verbindungen sind Überwachern naturgemäß ein Dorn im Auge. Anscheinend versuchen deshalb jetzt die US-Behörden NSA und FBI, Provider zur Herausgabe von SSL-Keys zu veranlassen.

High-ranking Eurocrats are expected to begin crisis talks on digital surveillance with American officials on Monday.

 

Lithuanian president Dalia Grybauskaitė, whose country will take up the EU presidency today , said she hoped to piggyback discussions on Edward Snowden and the PRISM system on top of trade talks.


The EU and the US will start hammering out the details of a transatlantic trade and investment partnership on Monday, which Eurocrats hope could create thelargest free trade zone in the world.

It totally makes sense that the EU is considering taking that step. It is interesting that a different country's government is more concerned than our own about our citizens and their rights. I agree completely with the woman's statement that she does not believe that national security is a good enough reason anymore. It is not in the slightest. Losing our rights is far more dangerous and negative than the government's attempts at reducing incidents of terrorism. Orwell's 1984 is becoming more and more a reality everyday. Our government is beginning to get to the point of no return. The probability of a regime change will continue to increase unless the government back pedals.

Manch einer sucht nun nach Wegen, sich ein Stück Privatsphäre zurückzuholen – diskrete Suchmaschinen wie DuckDuckGo oderIxquick, die Nutzerdaten weder speichern noch vermarkten, verzeichnen stark gestiegene Zugriffszahlen. Die Ixquick-Macher wollen dieses Modell bald auch auf den E-Mail-Verkehr ausdehnen.

 

Eine Frage der Zeit wann die sich AUCH beugen müssen!!!
