Farmworkers are getting these new rights in New York Albany Bureau Published 5:38 PM EDT Jul 17, 2019 ALBANY – With a stroke of a pen, Gov. Andrew Cuomo forever changed New York's farming industry on Wednesday. The governor, during a Manhattan press conference, signed the Farm Laborers Fair Labor Practices Act, a long-sought piece of legislation that would give farmworkers the right to unionize and access to overtime pay among other things.  Democratic lawmakers and labor groups have pushed for the legislation — which has existed in Albany in some form for decades — arguing farmworkers have been denied basic labor rights that employees in other sectors have been entitled to "Today the injustice ends," Cuomo said during the signing, which took place at the New York Daily News, which had advocated for the law. (AP Photo/Hans Pennink) Hans Pennink, AP Opponents of the legislation, including business groups, Republican lawmakers and the state's Farm Bureau, said the bill is flawed and would exacerbate the decline of the state's agricultural sector, which has been plagued by declining prices, an ongoing labor shortage and trade disputes. Farmers gathered in Albany last month seeking revisions to the bill, but not all their demands were met. "This measure does not create a path that will assure an economically viable New York agriculture industry," Grow NY Farms, a coalition made up of agriculture groups throughout New York, including the state's Farm Bureau, said in a statement.  More: With New York's unemployment on the decline, the need for seasonal workers has increased More: How U.S. tariffs are hurting New York farms and businesses Issues with overtime Grow NY Farms — which has the backing of dozens of farms across the state — sought to alter the bill in the weeks before it cleared the Legislature. They had some success: The bill's original language called for a mandatory day of rest and overtime pay after 40 hours. Farmers opposed the measures, arguing the mandates were too burdensome for small farms and did not account for how farms conduct business. The industry, they say, calls for long hours and is dictated by weather. The bill that ultimately passed the Legislature increased the overtime threshold to 60 hours and gives workers an optional day of rest with the right to overtime pay should they choose to work seven consecutive days. Grow NY Farms wanted the seventh-day overtime provision removed entirely and said the requirement will lead to less hours of workers. But proponents, including the state's AFL-CIO, say the measure is long overdue. "Farmworkers are finally getting basic labor rights including the right to organize a union, a mandatory day of rest, and the right to overtime pay," Mario Cilento, president of the NY AFL-CIO, said in a statement after the bill cleared the Legislature. Here’s what it would do Other concerns The group also took issue with a wage board established under the law that would further assess overtime pay for farmworkers. The board, which will have the power to successively lower the overtime will begin holding public hearings in March and will deliver recommendations by the end of December 2020, just nine months, or one growing season, later. That's too quick a turn around for the Farm Bureau, which sought to modify the timeline and increase their voice on the board. The board will comprise just three members — one each to be appointed by the state's Farm Bureau, commissioner of agricultural and the NY-AFL-CIO, a labor group that advocated for the legislation.  Grow NY Farms also sought to expand the definition of family farms and preserve the secret ballot process should workers choose to unionize. "In the end, our reasonable requests were cast aside, even though there was support for a moderated bill from legislators on both sides of the aisle," David Fisher, president of the state's Farm Bureau, said in a statement. Proponents praise the law Cuomo said the legislation would help improve the lives of thousands of farmworkers across the state.   "First, as a practical matter, 100,000 farm workers will have better lives. Their families will have better lives," he said. A study by the Fiscal Policy Institute, a non-partisan research group, found the new law would give farmers a pay increase of $34 to $95 per week and help boost the morale of farm workers in the state. "While farm owners would face added costs, they would also see clear benefits from increasing wages for their workers," the study said. But opponents argue the bill would put an unnecessary burden on upstate farmers and will lead to higher prices for New Yorkers. "New York State has lost thousands of farms in recent years and under these new mandates, more closures and job losses are on the way," Michael Kracker, executive director of Unshackle Upstate, said in a statement.  Still, Cuomo said the bill is necessary to protect farmworkers. "They will finally, finally have the same protections that other workers have had for 80 years," he said.
