Eating While Driving Significantly Increases Chances Of A Car Accident ...

While much attention lately has been placed on cell phone use as unsafe distracted driving, this article explores a unsafe driving practice which can be just as much of a culprit for causing auto accidents. Eating and driving is a big cause of losing concentration, taking your hands off the wheel or other actions which can cause a smash up. As a lawyer that represents injured persons related to auto accidents , I have had my fair share of cases where the traffic collision was caused from someone dropping food or otherwise being disengaged from the act of operating a motor vehicle while eating behind the wheel.

The advocates of connected cars will tell you that they're close to becoming a reality -- but maybe not before manufacturers and developers agree on how.

Cars connected to the internet may be able to reduce traffic snarls and even accidents by warning the drivers of impending jams or potential collisions. Sounds great but, I think this technology has a way to go before this will be reality. I also think there is no substitute for good, attentive and defensive driving skills and that, like any "smart device", this may be a source of distraction for drivers but, only time will tell. Government shutdown halts car recalls, crash tests by National Highway Traffic Safety Administration

One of the more unfortunate effects of the federal government shut down is the cessation of car safety and accident testing and recalls conducted by the National Highway Traffic Safety Administration (NHTSA). In my opinion as a traffic accident lawyer, the NHTSA is one of the federal agencies that does the most to promote research and awareness of vehicle safety through crash testing, collision analysis, maintaining statistics on accidents and promoting education of their findings.

How Google's robo-cars mean the end of ...

This is one of the more comprehensive articles I've seen to date on the Google self-driving automobile. These have become legal in California and are being tested. As a Los Angeles car accident attorney, I think that self-driving cars may indeed one day provide more automotive safety and less accidents by eliminating much of the "human error" factor, I think trying to think of automated vehicles as a way to allow people more time to "surf the web" and engage in other activities during their commute misses the mark on this goal entirely. As we saw with the recent Asiana plane crash, over-reliance on instruments rather than basic skills associated with operating a vehicle can be dangerous. I think allowing a car to operate on its own is fine but, the "driver" still needs to have the ultimately "override" control in case of an emergency. Just my thoughts!

What if cars could communicate with each other and sense a pending crash in time to warn the driver? This technology is apparently in development according to this article. Similar to "driverless" cars, I think it raises a lot of potential legal issues for the developers should the automation fail to perform as intended and a crash result. However, it does seem promising.

Like all car electronics and cars for that matter, they are not reliable. Drivers will become dependent upon them and their driving skills will deteriorate.

LOS ANGELES, California - Teen pop star Justin Bieber was involved in a late-night traffic accident, which Los Angeles media said injured a photographer who had been among a crowd trying to take pictures of the singer.

Yet another celebrity vs. paparazzi car vs. pedestrian collision in Los Angeles. This time Justin Bieber was trying to exit a comedy club on Sunset Boulevard, got surrounded by photographers, motioned for them to clear and, when they didn't, he pinned one of them between his Ferrari and some type of fixed object and then sped off with the photographer sustaining non-life threatening injuries. Technically speaking, this could be a "hit and run" on his part. California Vehicle Code section 20001 states as follows: "The driver of a vehicle involved in an accident resulting in injury to a person, other than himself or herself, or in the death of a person shall immediately stop the vehicle at the scene of the accident and shall fulfill the requirements of Sections 20003." CVC 20003 states: "The driver of any vehicle involved in an accident resulting in injury to or death of any person shall also give his or her name, current residence address, the names and current residence addresses of any occupant of the driver's vehicle injured in the accident, the registration number of the vehicle he or she is driving, and the name and current residence address of the owner to the person struck or the driver or occupants of any vehicle collided with, and shall give the information to any traffic or police officer at the scene of the accident. The driver also shall render to any person injured in the accident reasonable assistance, including transporting, or making arrangements for transporting, any injured person to a physician, surgeon, or hospital for medical or surgical treatment if it is apparent that treatment is necessary or if that transportation is requested by any injured person." Pedestrians are the most vulnerable people on the streets, with no vehicle to protect them or move them out of harm. It is because of this that laws are in place to protect pedestrians from drivers. Although there are rules and laws on when and where a pedestrian can cross the street, it is always the duty of motorists to use caution and stop for pedestrians whenever possible.

Steven M. Sweat's insight: It appears that this fatal car crash started with a vehicle trying to pass over a double yellow line on this stretch of the Pacific Coast Highway in Orange County, CA. California Vehicle Code 21460 prohibits driving to the left of a solid double yellow line for purposes of trying to pass another vehicle. These markings are in place to indicate an stretch of road where there is not sufficient length and or visibility for passing. This is a tragic loss of human life and a needless infliction of bodily injury due to a careless disregard of basic roadway safety!

This article is a very good discussion of the potential legal liability issues raised by ride sharing companies like #uber and #lyft. These companies are in business to make a profit but, are arguing that they should not be responsible if a driver hired through their service is negligent and causes and auto collision. It takes an example of a traffic collision in San Francisco where an Uber vehicle crashed into a second automobile and also hit a fire hydrant, which injured a pedestrian. The driver of the second vehicle and the pedestrian are now contemplating naming Uber as a defendant if lawsuits are filed for personal injury. Under California law, the plaintiffs in such an action would probably have to show that the drivers were acting as an agent of the ride-share company or that the ride share company was negligent in allowing the driver to operate a motor vehicle within their system. Many of the municipalities, including the City of Los Angeles, have eliminated red light camera enforcement programs due to legal disputes as to the validity and accuracy of the equipment and monitors. However, there can be no doubt that running red lights is a major cause of accidents causing injury and death every year in California.
