Auto Accident Injury

Being involved in an auto accident is a frightening experience that can drastically change your life within seconds.  A car accident can cause debilitating physical injuries, emotional trauma, and costly property damage. And a serious car accident injury that prevents you from returning to your job (or that limits the number of hours you can work) can be financially devastating. Even an accident that occurs at a low speed, or that doesn’t result in much damage to your car, can cause physical injuries.

If you’ve been involved in a car accident, it’s important to take steps to protect your legal rights, before it’s too late. If you’ve recently been hurt in a motor vehicle accident, we can help you by:

  • Investigating your accident to compile evidence
  • Negotiating on your behalf with the other driver’s insurance company (if the other driver is uninsured, we can help you file for uninsured motorist benefits under your own insurance policy)
  • Filing and pursuing a lawsuit on your behalf if negotiations don’t lead to a successful settlement.

An auto accident lawyer from our firm can help you find peace of mind after your accident so that you can move forward with your life. Contact us to set up a consultation with a lawyer from our office.

There are several causes of motorcycle accidents on the roads. The rising concern at the increasing cases of motorcycle accidents lead to a comprehensive survey made in 2009. This survey compiled a list of possible causes for motorcycle accidents on the road. By identifying the causes behind serious motorcycle crashes, it is easier to minimize their occurrence and make the road a safer place.

Understanding the causes helps in taking preventative measures to stop motorbike accidents.

  1. Careless maneuvering by other drivers on the road: Four-wheeled vehicles tend to cause more motorcycle accidents than others. Most drivers are unable to detect motorcyclists or do not pay enough attention to them. They tend to make abrupt swerves that invariably results in a fall or collision. Motorcyclists are either forced off their bikes or make hard hitting physical contact resulting in severe injuries to the arm, neck and face areas.
  2. Loss of control of bike: Many motorcyclists have been victims of accidents because they were unable to control their motorcycles and took a skid or fall. In a motorcycle crash of this nature, the rider’s arms or legs often tend to get caught beneath his machine resulting in serious lacerations or even fractures. Control is defined as the ability to stop the bike at will in a safe manner.
  3. Sudden stops trigger accidents: Speeding was not a contributing factor for bike accidents. More clearly indicated was the occurrence of sudden stops as a cause for accidents. In fact, statistics indicated that as much as 70% of motorcycle accidents occurred when the motorcyclist was cruising at speeds less than 30 miles per hour. The solution is that motorcyclists are advised to slow down instead of clamping down the brake. The sudden switch in momentum makes the rider fly over the bike and sustain serious injuries.

On January 7th 2013, a nurse was involved in a serious multi-vehicle head-on accident while travelling southbound on South Main Street in Houston Texas. She was driving a Toyota Camry. The negligent nurse, who fell asleep at the wheel, and was at fault for the collision was on her way home after working an overnight 13 hour shift at a hospital.

The crash was apparently caused by drowsy, sleepy driving because the at fault motorist fell asleep at the wheel.  This was apparent by a cursory review of police reports and emergency medical technician (EMT) records.  The drowsy driving conclusion was also evident by the tired driver’s numerous admissions at the scene of the wreck. These admissions were made to police, emergency workers and medical personnel dispatched to the scene of the head-on accident.

Despite overwhelming evidence of the motorist falling asleep at the wheel, for some reason the NTSB decided to investigate it. Predictably the NTSB concluded that this was in fact a tired overworked motorist dozing off at the wheel of her automobile.

excerpt:

The number of commercial trucks involved in rear end collisions across the nation every year is staggering. Statistics by the FMCSA (Federal Motor Carrier Safety Administration) indicate that around 400,000 commercial trucks are involved in collisions each year, with nearly 70,000 of those accidents involving a rear end crash. In most incidences, the outcome to motorists and passengers is catastrophic, resulting in serious injuries and fatalities.

A rear end collision may occur any time one vehicle crashes into the back of the vehicle directly ahead. Often times, these types of collisions will happen at stop signs, intersections, and railroad crossings when the vehicle ahead has come to a complete stop. However, rear end collisions can also happen while both vehicles are moving in the same direction.

Rear end accident involving large commercial 18 wheeler trucks and cars can usually be categorized two specific ways. The first is where the truck runs into the back end of another car or truck, and the second is when another vehicle collides into its back end. The most common type of truck-involved rear end crashes results from the trucker’s inattention, distraction or negligence before rear-ending a small passenger vehicle ahead.

Automobile collisions are the highest percent of all negligence claims in Rhode Island which result in injury or property damage. However, personal injury in RI is certainly not limited to your garden variety rear end car accident.

If you were hurt in a motor vehicle crash in RI, please get in touch with East Providence, Attorney David Slepkow 401-437-1100. There are hundreds of different types of mishaps that may befall motorists on a day to day basis in the Ocean State.

There are some cases in Rhode Island and Providence Plantations in which a person violates an ordinance or law causing a motor vehicle wreck. Some collisions result from a motorist operating a motor vehicle carelessly / negligently and not using due care.
