RI MOTORCYCLE ACCIDENT

Being in a car accident can be one of the most terrifying events that can happen to a person. That terror is compounded when the accident is on a motorcycle. Motorcycle accidents can be very dangerous since the person does not have the protection.

from 2003 to 2012 both fatal wrecks are down from 42K year to 33K a year, and injuries reported are down from 2.8M to 2.3 M. The factors could be less speeding, better car, but this should be of interest to practicing attorneys.

The introduction of Apple’s new iPhone 4, is only one indicator of the rapidly growing and constantly improving market for cell phones. The number of smart phones being purchased and used in California has greatly increased, allowing users to access various applications any place at any time. Inevitably, this has lead to the increase of text messaging while performing other tasks. One such example of this growing trend: texting while driving.

The RI Supreme Court recently suspended Accident Lawyer  and Marketing Guru James Sokolove’s law firm, The Law Offices of James Sokolove LLC, from practicing Law in RI. Mr Sokolove was not disbarred or suspended personally. I do not even believe that Mr Sokolove is personally licensed to practice law in Rhode Island. The Rhode Island Supreme Court  Court ruled: “It is further ordered, adjudged, and decreed that Sokolove Law, LLC is hereby suspended from engaging in the practice of law in this state effective immediately and until further order of this Court.”

There is no doubt that Sokolove’s Law firm has a colorful and controversial history in Rhode Island.Prior to damaging decision, The  Sokolove Law firm notified the State of Rhode Island that it replaced its attorney to a different Rhode Island Personal Injury Lawyer. As a result of this notification the RI Top  Court took action. Sadly, Mr. Sokolove’s RI Injury and Accident Clients may be the victims of this dustup. James Sokolove previously feuded with a  few big name RI Personal Injury Lawyers in an attempt to get a foothold in the Rhode island Market. The feud went all the way up to the highest Court located in Providence. These local Attorneys from the Ocean State were battling to bar Sokolove’s firm from being licensed in Rhode Island.

Prohibited use of cell phones while driving is the law in many communities hoping to eliminate car accidents caused by distracted driving. This is because speaking or texting on a cell phone while driving is a contributing factor in more than 25 percent of all vehicle accidents nationwide.

Not a New Phenomenon in RI or across Nation

Distracted driving is not a new phenomenon. It  is a problem that has been around as long as transportation. Any activity that diverts the motorist’s attention away from operating a motor vehicle creates a serious issue for everyone sharing the road with a distracted driver. While texting and using a smart phone or cell phone has become a recent problem, other driver distractions have been around for decades, including:

• Grooming or applying makeup
• Drinking or eating
• Reading, including studying maps
• Adjusting the radio, MP3 player or CD player
• Grasping for something out of reach in the vehicle
• Driving with one hand

Drivers become easily distracted when they divert their eyes from the roadway to dial a number, read a message on their smart phone, or type out a text reply. However, not all driver distractions caused by electronic equipment involves diverting eyes from the roadway or manipulating the device.

On January 7th 2013, a nurse was involved in a serious multi-vehicle head-on accident while travelling southbound on South Main Street in Houston Texas. She was driving a Toyota Camry. The negligent nurse, who fell asleep at the wheel, and was at fault for the collision was on her way home after working an overnight 13 hour shift at a hospital.

The crash was apparently caused by drowsy, sleepy driving because the at fault motorist fell asleep at the wheel.  This was apparent by a cursory review of police reports and emergency medical technician (EMT) records.  The drowsy driving conclusion was also evident by the tired driver’s numerous admissions at the scene of the wreck. These admissions were made to police, emergency workers and medical personnel dispatched to the scene of the head-on accident.

Despite overwhelming evidence of the motorist falling asleep at the wheel, for some reason the NTSB decided to investigate it. Predictably the NTSB concluded that this was in fact a tired overworked motorist dozing off at the wheel of her automobile.

excerpt:

There are several causes of motorcycle accidents on the roads. The rising concern at the increasing cases of motorcycle accidents lead to a comprehensive survey made in 2009. This survey compiled a list of possible causes for motorcycle accidents on the road. By identifying the causes behind serious motorcycle crashes, it is easier to minimize their occurrence and make the road a safer place.

Understanding the causes helps in taking preventative measures to stop motorbike accidents.

  1. Careless maneuvering by other drivers on the road: Four-wheeled vehicles tend to cause more motorcycle accidents than others. Most drivers are unable to detect motorcyclists or do not pay enough attention to them. They tend to make abrupt swerves that invariably results in a fall or collision. Motorcyclists are either forced off their bikes or make hard hitting physical contact resulting in severe injuries to the arm, neck and face areas.
  2. Loss of control of bike: Many motorcyclists have been victims of accidents because they were unable to control their motorcycles and took a skid or fall. In a motorcycle crash of this nature, the rider’s arms or legs often tend to get caught beneath his machine resulting in serious lacerations or even fractures. Control is defined as the ability to stop the bike at will in a safe manner.
  3. Sudden stops trigger accidents: Speeding was not a contributing factor for bike accidents. More clearly indicated was the occurrence of sudden stops as a cause for accidents. In fact, statistics indicated that as much as 70% of motorcycle accidents occurred when the motorcyclist was cruising at speeds less than 30 miles per hour. The solution is that motorcyclists are advised to slow down instead of clamping down the brake. The sudden switch in momentum makes the rider fly over the bike and sustain serious injuries.

Losing a source of much-needed income because of a work-related injury can be devastating on a family. The loss of wages can instantly change the family’s lifestyle and place financial pressure on meeting their debt obligations. It was not that many decades ago when families would have starved in an attempt to fend for themselves after losing the income. Today, many laws have been enacted in Rhode island  to protect an employee injured on the job, including providing workers’ compensation.

While these laws were enacted as an ideal transition from receiving money by working to getting paid when suffering injuries on the job, the truth is a bit more complex. Even though there are advantages to receiving RI workers’ compensation, there are also significant disadvantages too.

Advantages and Disadvantages

Workers’ compensation helps the injured employee by providing funding to pay for medical expenses and lost wages during the healing process. In addition, it helps the employer by protecting them against lawsuits. Long-term disability claims are usually settled through a voluntary agreement between the employer’s insurance company and the injured employee.
