The strategy for the plaintiffs in the Tracy Morgan v. Wal Mart case seems to be to move the case along to trial as quickly as possible. Given the bad press Wal Mart has received in recent months on this and the added pressure that a pending trial date puts on the defense, I think this is a wise plan. I would assume Wal Mart will fold at some point and offer a substantial sum to settle the claims. If not, I believe that a jury will award a substantial amount of money based upon my understanding of the nature and extent of the injuries (including traumatic brain injury) that will affect Mr. Morgan's ability to earn significant income as an entertainer.
