Good article regarding the various factors that play into the continual high incidence of pedestrian accidents especially in urban areas like Los Angeles. Lack of good sidewalks or other street layout issues and the negligence of drivers and pedestrians, account for a startling 70,000 injuries incidents and 5,000 deaths related to pedestrian mishaps according to the statistics cited in the article. |

As a California personal injury attorney, I can feel for the fans who were injured at the Daytona race. From a legal standpoint, it may be a diffficult claim in that there would be a defense of "assumption of the risk" on the part of spectators at a sporting event where crashes can and do occur. This is a doctrine which sometimes limits or prevents recovery based upon voluntary assumption of a known risk. However, depending upon further facts that develop, there may be a theory of negligence on the part of the race promoters. |
