The Trayvon Martin case was a tragic example of what can go wrong with laypersons attempting to engage in law enforcement activities. In this case, it was a neighborhood watch patrol person but, this type of scenario plays out with private security companies and other similar entities. While neighborhood watch and private security patrols play an essential role in maintaining safety in residential and commercial areas, there are often too many of these persons who go beyond the bounds of their "job description". While I am not the "judge or jury" for what happened here, I can tell you that, as a negligent security attorney in California, I have represented many persons injured by overzealous bouncers and private security officers where it was found that these persons were negligent for a variety of reasons including violation of state statutes and their own company policies and procedures.

As a California personal injury attorney, I can feel for the fans who were injured at the Daytona race. From a legal standpoint, it may be a diffficult claim in that there would be a defense of "assumption of the risk" on the part of spectators at a sporting event where crashes can and do occur. This is a doctrine which sometimes limits or prevents recovery based upon voluntary assumption of a known risk. However, depending upon further facts that develop, there may be a theory of negligence on the part of the race promoters.
