Matthew A. Dolman's insight:

Children and the Permanent Damage of Traumatic Brain Injuries

Children are especially vulnerable to all kinds of harm whether it comes from a medical error or a simple car accident. The consequences of significant injury to a child are often grave and can follow them for the rest of their lives. When it comes to the most severe injuries that a child can suffer, few can contend with concussions along with many other types of traumatic brain injuries. These kinds of injuries can happen at the drop of a hat and can occur almost anywhere when certain parties are negligent.

Children that have suffered concussions and other traumatic brain injuries will not only have to worry about the immediate effects of their injury but also how their injuries will cause issues in the future. Complications of brain injuries can significantly alter a person’s quality of life. In the event that a child’s traumatic brain injury was caused by the negligence of a liable party then they may be able to seek compensation for their injuries. No amount of money can undo some of the painful effects that come with traumatic brain injuries but financial assistance can help make a traumatic brain injury victim’s life a bit more bearable.

Matthew A. Dolman's insight:

The majority of car accidents are minor incidents with no injuries or fatalities. Yet, other accidents cause minor to severe injuries and even fatalities in the most serious accidents. When motorcycles are involved, the accident and injury rate dramatically increases. Bikers don’t have the same protection as vehicle occupants. If you or a loved one has suffered injuries in a motorcycle accident, or a loved one has lost their life, Florida law entitles you to sue for damages when injury or fatality was a result of another party’s negligence; however, you must take legal action before the statute of limitations runs out on your case. The following information offers information about Florida statutes of limitations in motorcycle accident cases.

For immediate assistance with your case and to discuss the best course of action for you and your family, contact Dolman Law Group at (833) 552-7274 (833-55-CRASH). We serve injured clients from our Clearwater, St. Petersburg, Sarasota, and New Port Richey offices.

Matthew A. Dolman's insight:

Deceptive Nursing Home Bait and Switch Lawsuits

According to the Center for Disease Control (CDC), there are roughly 1.4 million people living in nursing homes as of 2014. Not only has this statistic grown in the years since but the rate of increase itself is growing as well. With every year that passes, more people live in nursing homes and the number of new residents grows as well. Nursing homes rush to provide their services to all the elders in need of long term care. They are for-profit businesses after all.

A majority of nursing homes take the services they offer very seriously and strive to provide the best level of care to their elderly residents. They understand that the elderly in need of long term care are particularly vulnerable and ensure that they are given fair and reasonable fees for clearly outlined services.

On the other hand, there are a few nursing homes that see the vulnerability of the elderly as an opportunity for deception and exploitation. These nursing homes may mislead prospective nursing home residents to their care with the promise of certain fees and services offered but upon moving into a facility will have those fees and services fail to be honored. This can often cause harm to an elderly person that was counting on a certain level of care but instead finds out that they were misled by a nursing home eager to pocket their money.

Matthew A. Dolman's insight:

When you think of slip and fall injuries, you probably imagine broken bones, sprained ankles, and strained tendons. But some falls can cause serious head injuries, ranging from mild concussions to more life-altering brain injuries. Slip and fall victims should carefully assess if anyone is responsible for their falls and meet with a personal injury attorney to discuss possible compensation.

Traumatic Brain Injuries

Inside our skulls, fluid surrounds our brains, acting as a cushion to prevent the brain from making contact with the insides of our skulls. However, any jarring motion can potentially cause the brain to contact the skull anyway. You can also suffer a traumatic brain injury if an object penetrates the skull, such as a bullet or metal stake. Depending on the severity of the jolt to your head, you might suffer from mild or more severe brain injuries.

Matthew A. Dolman's insight:

How Uber’s Accident Insurance Works

Drivers use their personal vehicles and are not always on the clock: If the driver is not logged into the Uber app and available to accept rides, then only the driver’s personal insurance is in play in the case of an Uber accident lawsuit.

If a driver is logged into the app but hasn’t accepted a ride from a fare-paying customer, then Uber’s insurance offers no collision coverage. However, it does offer an additional liability coverage for third parties (others involved in the accident) of a maximum of $50,000 per injury (up to $100,0000), as well as a maximum of $25,000 for property damage, for damages that exceed the capacity of the driver’s personal insurance.

Only if the driver is actually transporting a customer does the full $1 million of collision and liability coverage provided by Uber kick in for the following purposes:

Roundup Weedkiller Lawsuits Claim it Causes Cancer

Recently a federal jury awarded a California man more than $80 million dollars in a case that found Roundup weedkiller exposure contributed to his cancer’s development. This is actually the second time that a person has successfully sued the manufacturer of Roundup weedkiller, Monsanto, over the weedkiller’s potential to contribute to cancer development. Monsanto now faces thousands of similar cases to this and now faces even more consequences in the form of Costco now removing Roundup weedkiller from their shelves.

Currently, Costco has not made any official statements regarding their removal of Roundup from their shelves. The decision to discontinue the sale of the controversial weed killer comes none too soon with petitions being made by people such as Moms Across America founder Zen Honeycutt that call for the removal of Roundup weed killer from Costco’s shelves and have amassed more than 150,000 signatures on Change.org. Various news outlets have since confirmed that Costco has stopped all locations from ordering not only Roundup but all weed killers that utilize the ingredient glyphosate which is believed to be the primary cause for the development of cancer among those exposed to the weedkiller.

Matthew A. Dolman's insight:

How to Avoid Common Motorcycle Accidents

Everyone knows that riding a motorcycle can be an extremely dangerous mode of transportation. But it’s also a lot of fun. That’s why people do it.

There are a few basic things every rider knows to do in order to stay safe on their cruiser, sports bike, or touring motorcycle. The first rule is to always wear protective gear. Helmets really do save lives. Don’t believe me? Check out this article on their effectiveness. Ill also provide a link to an article about the different types of motorcycle helmets. Besides just protecting your head, there is a lot of other valuable parts south of the neck. Wearing protective gloves, jackets, pants, suits, boots, etc. can greatly reduce your risk of being injured. Because chances are, you will come off your bike at some point. Just like it is inevitable that someone in a car will get into a fender bender, if you ride a motorcycle long enough, you will probably be falling off at least once.

Taking a motorcycle safety course is a valuable way to spend your time and money, as well. The Motorcycle Safety Foundation offers courses all over the country, from basic beginner classes required to get a license, all the way up to more advanced courses that teach riders evasive movements and how to spot a potential collision.

Sexual harassment is technically a form of sex discrimination under Title VII of the Civil Rights Act of 1964 and is also illegal under section 760.10 of the Florida Statutes.

Both federal and state law describe sexual harassment as “unwelcome sexual advances, requests for sexual favors, and other verbal or physical conduct of a sexual nature that explicitly or implicitly affects a person’s employment, interferes with their work performance, or creates an intimidating, hostile, or offensive work environment”.

So if this description of workplace sexual harassment fits something that is happening to you, what should you do?

Steps to Take When a Coworker Sexually Harasses You

Matthew A. Dolman's insight:

Claims Involving Penetrating Brain Trauma

In the realm of personal injury, one of the most common kinds of injuries that plaintiffs sustain is traumatic brain injuries. Any damage to the head can have serious consequences for a person’s health and should be addressed immediately. All kinds of accidents can result in head trauma as well. Car accidents, slip and falls, medical malpractice, motorcycle accidents, nursing home abuse, and much more have a risk of causing significant head trauma. This damage suffered to the head can take a variety of forms but one of the most serious is damage involving penetration of the skull.
Penetrating brain injuries rank among some of the most serious injuries that a person can suffer as the result of an accident. Visually they are particularly intense to take in but the long term damage that they can result in is not as apparent. This severe damage as a result of a penetrating head injury caused by an accident will often be exceptionally costly in the financial sense as well as negatively impact a person’s quality of living. When these injuries are caused by an accident that could have been avoided had a responsible party not been negligent, then the victim of this kind of injury may be able to take legal action and pursue compensation for the damages that they suffered.

What is a Penetrating Brain Injury?

A penetrating brain injury is when the outer layers of the dura mater in the outer layer of meninges of the brain is breached. In layman terms, a penetrating brain injury is when the skull is breached and damages the brain. This can occur in a number of ways usually involving immense trauma from some kind of pointed object. These objects can travel at high or low velocity but usually with immense force. It goes without saying that these kinds of injuries are serious medical emergencies requiring immediate treatment to avoid death and complications.
On the other hand, there are very similar perforating brain injuries which involve similar acts of breaching the brain with the discrepancy that perforating brain injuries involve the object penetrating the brain making an exit wound in addition to its initial penetrating wound. These kinds of injuries can be even worse than a penetrating brain injury.

Matthew A. Dolman's insight:

When a road hazard sends your car out of control, the resulting accident can cause serious or life-threatening injuries. Before you report the accident to your insurance company as one that was your fault, however, take a closer look at the circumstances. Although you were the one behind the wheel, a serious road hazard can make an accident unavoidable.

The road hazards that cause accidents usually exist because of someone’s error, omission or negligent act. They’re dangerous because they’re not always easy to spot or anticipate before they send your vehicle out of control. When road hazards lead to accidents resulting in serious injury to and your passengers, the person or entity responsible for causing the hazard may have liability to you for damages.

Matthew A. Dolman's insight:

Statistics generated by government oversight reveal that nursing home abuse is a serious and persistent problem in the Sunshine State. Florida’s Agency for Health Care Administration (AHCA) oversees compliance with federal and state laws about nursing care facilities in Florida that accept Medicare and Medicaid (which comprise all but about two percent of homes). The agency rates each facility after an unannounced yearly inspection that lasts up to five days. Each nursing home is given an overall rating from one to five stars; inspectors look at quality of care, quality of life, and administration.

The most recent inspections of the 13 nursing homes in Clearwater reveal nine facilities that are rated three stars or less. Out of the 70 nursing homes in Pinellas County, 29 have major deficiencies with one or two stars. Clearwater is home to seven of those facilities. These startling statistics reveal that even with regular inspections, laws that protect elders, and laws that govern nursing homes, elders who reside in Florida’s nursing homes face an ever-present risk of abuse.

How a Previous Injury Can Affect Your Personal Injury Claim

Accidents have a way of happening at the worst possible time. There are few worse times to suffer a severe injury than after already suffering an injury. This misfortune befalls more people than most realize. Injuries make us especially susceptible to harmand those with pre-existing conditions can easily find themselves involved in serious accidents. These pre-existing conditions can worsen exponentially and cause significant damage to those that suffer additional injuries.

When someone with a pre-existing condition suffers additional injury as a result of an accident they may choose to seek legal compensation for the injuries that they suffered if the accident was caused by someone else’s negligence. An accident victim in this situation would likely file a personal injury claim in order to do this. Unlike a normal personal injury claim, one involving a plaintiff that has pre-existing conditions can run into all kinds of issues when it comes to holding those at fault liable.

Matthew A. Dolman's insight:

Have you or a loved one suffered a heart attack, stroke, or died while taking Uloric to treat gout?

The FDA recently warned that patients taking the gout medication Uloric (febuxostat) face an increased risk of serious injuries or illness. Uloric injuries have included heart attack, stroke, and death.

If you or a loved one suffered an injury due to this gout medication, we urge you to contact our Uloric lawyers for a free case consultation.

FDA Claims Uloric to be Dangerous

In February 2019, the FDA issued a statement addressing the potential dangers associated with Uloric (generic name, febuxostat). Uloric is a medication used to treat gout.

The FDA has been investigating the potential link between Uloric and severe side-effects since 2017.

In the statement, the FDA concluded that there is an increased risk of death associated with Uloric when compared to another gout medicine called allopurinol. Specifically, they found an increased risk of heart-related death, as well as death from other causes associated with Uloric.

In patients treated with Uloric, 15 deaths from heart-related causes were observed for every 1,000 patients treated for one year. In addition, there were 26 deaths from any cause per 1,000 patients treated for one year with Uloric.

As a result of this study, the FDA is now requiring the makers of Uloric, Takeda Pharmaceuticals, to include what is known as a black boxed warning on their medication, as well as an updated medication guide to alert doctors and patients of the potential risks associated with Uloric.

Matthew A. Dolman's insight:

Weedkillers like Roundup are a common sight in many households and used widely to manage agriculture and landscaping. We all know these chemicals kill weeds and are likely not the best thing to expose your body directly to but lately the possible risks posed by weedkillers such as Roundup have come under scrutiny after several lawsuits have been filed claiming an ingredient in Roundup called glyphosate helped cause plaintiff’s cancer. One of these lawsuits against the manufacturer of Roundup known as Monsanto has actually managed to successfully recover compensation in the form of 80 million dollars for a man that claims to have gotten lymphatic cancer after heavy use of Roundup on his property.

Legal action has been taken against the chemical companies that make these weedkillers before. The first case was in California where Dewayne “Lee” Johnson filed a lawsuit against Monsanto who is the maker of the weedkiller known as Roundup. The lawsuit revolved around Johnson’s claims that he developed lymphatic cancer as a result of his long term exposure to Roundup while working as a groundskeeper. The trial resulted in a verdict of 289.2 million awarded to Dewayne Johnson that was later reduced to 78.5 million and Monsanto filed an appeal shortly after.

Matthew A. Dolman's insight:

Useful Tips for Motorcyclists Caught in the Rain

One of the most dangerous conditions for motorcyclists to ride in is wet weather. Motorcyclists in Florida that ride during rainy seasons do so with the risk of being caught in flash storms that can increase the chance of being involved in an accident quite a bit. Seasoned motorcyclists know that these flash storms and sudden downpour can kill but many motorcyclists disregard these dangers and choose to take their chances driving in dangerous rainy conditions.
There are some instances when someone has no choice but to ride through the rain when they are caught in the middle of a flash storm. Almost every Florida motorcyclist has experienced some unexpected precipitation at some point when they have been out riding and had to drive a fair distance across wet roads. While this is a risky endeavor there are a few things that you can do to minimize the chance that you suffer an injury as a result of a motorcycle accident.

Matthew A. Dolman's insight:

Clarifying Non-Compete Provisions and How They Affect You

Often when entering into employment with a company, you will be asked to sign an employment contract or agreement. Inside that agreement are a variety of different covenants or promises that both you and your company are making with each other: agreements on pay, vacation time, benefits, and what your structure of duties will be, etc. In addition to those usual boilerplate sections, an additional obligation a company may place upon you is a Non-Compete Provision.

What is a non-compete provision?

A non-compete provision is an agreement that after an employee’s tenure with the company has ended, either by termination, resignation, or layoff, that the employee will not work for a competitor in the same field or geographic area as the employee’s previous employer for a set period of time.
