Matthew A. Dolman's insight:

A personal injury settlement mill is a high volume law practice that attempts to mass produce the settlement of injury claims while utilizing aggressive advertising campaigns in an effort to obtain clients. In fact, such law firms can afford to employ a mill mentality as they do not rely on former or current clients for referrals of new cases. Rather, these law firms are aware that no matter how their clients feel about the work performed on their behalf, more cases will come in from the massive amounts of advertising they pay for.

What happens when a Medicare Beneficiary obtains a Personal Injury Settlement?

Matthew A. Dolman's insight:
CMS recently withdrew a proposed rule on Medicare Secondary Payer and Future Medicals.  The proposed rule was planned to give guidance on allocations in liability cases.  This would be the first official guidance delivered by CMS regarding allocations in liability cases.  Prior to this proposed rule, the last guidance was given in a one page memo from 2011.
According to the American Association for Justice, “CMS withdrawing the proposed rule called ‘Medicare Secondary Payer and Future Medicals’ has absolutely no impact on the underlying statutory text—the Medicare Secondary Payer Act; 42 U.S.C § 1395y(b)—that provides the parameters for reimbursing Medicare in Medicare Secondary Payer situations. To the extent reimbursement was required before the rule was withdrawn, reimbursement is still required. The rule being withdrawn has not altered any obligations in the statute.” Linda Lipsen, For All Trial Lawyers: Future Medicals Rule Withdrawn (Am. for Justice 2014), https://www.justice.org.

The maximum value of a New Port Richey personal injury1 case depends upon a variety of factors. Unfortunately, there is no hard-and-fast rule or “magic formula” that can be employed to determine exactly how much you can or will be paid in economic and/or non-economic damages. If you or someone you love has sustained personal…
Matthew A. Dolman's insight:

Factors that Affect the Value of a Personal Injury Case

Settlement negotiations in a personal injury case usually begin when the plaintiff’s attorney submits a demand package to the insurance adjuster. The demand package typically includes copies of all related medical records and bills, as well as a monetary demand for damages. In Florida personal injury cases, the demand is not usually submitted until the injured plaintiff reaches a level of maximum medical improvement – or a point beyond which his or her medical condition is not expected to improve.

Recovery in a personal injury case depends upon the amount of insurance coverage available – and maximizing the amount of that coverage. A good New Port Richey personal injury lawyer will be able to seek out all available insurance policies that are in play, as well as the limits of insurance coverage for each of those policies.
