The fact is a concussion can be very serious and a second concussion, following before the first has fully healed, can lead to death. Thousands of former professional football players have claimed they incurred severe brain trauma from injuries on the field. Since these claims and the lawsuits that followed, several medical professionals have seized the chance to develop assessments for brain damage. Many experts say the validity regarding such claims of accurate brain damage assessment techniques are premature and as such, unfounded.


Previously, it was widely believed that chronic traumatic encephalopathy, or C.T.E. for short, could only be diagnosed posthumously from analyzing brain tissue. Most researchers still believe this to be true.

A Traumatic Brain Injury can devastate a person’s life with severe physical, emotional, and cognitive deficiencies.  It is often abundantly clear when a person is suffering from an injury to the brain.  Brain trauma will occasionally be seen on standard imaging studies such as MRI’s or CT scans.  Injuries to the brain can result in symptoms such as vomiting, seizures and slurred speech. However, TBI’s do not always manifest in obvious ways.  Sometimes a person who receives a blow to the head can be diagnosed with a “mild” or “minor” brain injury.  It’s common for this type of damage to not be visible on MRIs or CT scans, and symptomatology becomes more difficult to illustrate.  These injuries may differ than those caused by severe head trauma, but can be debilitating all the same.

The relationship between post-traumatic headaches and the occurrence of a brain injury was long thought to exist but the correlation has now been scientifically correlated. According to a report released by the American Council for Headache Education, it is estimated that over 450,000 new cases of chronic post-traumatic headaches, or PTH, arise in the United States each year.


PTH occurs in 90% of patients following a traumatic brain injury (TBI), and appears to be more common and more serious in mild TBI’s as compared to significant closed head injuries. In many cases, the occurrence of a headache is highest in those without loss of consciousness. Currently, nominal evidence exists to explain this phenomenon.

As you have likely heard by now, in August the NFL agreed to pay $765 million dollars to settle a lawsuit by 4,500 former players alleging pro football’s concealment of information concerning the danger of concussions. The agreement spared NFL executives from disclosing what they knew and when they knew it. This lessened the hit the public relations would surely be taking after news of the settlement hit the media.


Last week, 10 former NHL players filed a class action lawsuit in federal court in Washington, claiming that the NHL similarly did not inform players about the perils associated with repetitive brain injuries. Among the former players was Rick Vaive, the former captain of the Toronto Maple Leafs. However, he recently asked to have his name removed from the suit. According to Vaive’s lawyer, Trevor Whiffen, Vaive “misunderstood the nature of the proceeding” and has no interest in suing the NHL.

Researchers have discovered that a mild injury of the head can cause severe abnormalities in brain function, which can last for several days. Lead research scientist Kimberle M. Jacobs, a professor at the Virginia Commonwealth University School of Medicine, believes that the findings may explain the neurological symptoms experienced by those who have suffered from a head injury commonly associated with playing sports or personal injury accidents.

As both a Clearwater personal injury attorney and Florida brain injury attorney, I am often faced with myths regarding brain injuries that have been purveyed by the insurance industry and the defense attorneys they retain.

Myth #1: Negative diagnostic tests such as MRI's, CT-scans and PET scans rule out the possibility of a brain injury

Please keep in mind that normal imaging such as MRI's, CT and PET scans are often neither specific or sensitive enough to detect damage to the delicate axonal fibers which can be torn, twisted, stretched and damaged as a result of physical trauma which often occurs in an automobile accident. New testing procedures such as MRI with diffuse tensor imaging (DTI) and susceptibility weighted imaging (SWI) are far more specific and have proven to be more effective at illustrating even minor brain injuries. However, both DTI and SWI are often challenged by defense attorneys and have not been fully accepted as valid scientific testing in all jurisdictions.   (read more)
