The IHMC CmapTools program empowers users to construct, navigate, share and criticize knowledge models represented as concept maps. Desmos began its life as Tutor Trove, LLC. Founded in 2007 by Eli Luberoff, an active tutor, avid programmer, and math and physics double major (read: nerd) at Yale, Tutor Trove's mission was to help tutors bring their business online. Eli built the company around a browser-based collaborative environment for remote tutoring called a "virtual Whiteboard".
Now, with a growing team and the support of some fantastic investors and advisors, we're expanding the vision of Desmos. Based on our core Whiteboard technology, Desmos aims to serve as a web-based, unifying standard for interactive lessons. No longer are teachers limited by the kind of hardware they have in their classroom. 1. Soluciones a los problemas con la ley

Además del clásico límite denominado “ilustración de la enseñanza”, hay otras posibles soluciones que nos aporta la ley para usar las obras con derecho de autor en el contexto educativo, en especial el derecho de cita y, para los alumnos con alguna discapacidad, el nuevo artículo 31bis.

1.a Ilustración de la enseñanza

Uno de los límites más clásicos y tradicionales de los derechos de autor es el denominado “ilustración para la enseñanza”. Aparece recogido en el Convenio de Berna, en concreto en su artículo 10.2, que establece que:

“Se reserva a las legislaciones de los países de la Unión y de los Arreglos particulares existentes o que se establezcan entre ellos lo que concierne a la facultad de utilizar lícitamente, en la medida justificada por el fin perseguido, las obras literarias o artísticas a título de ilustración de la enseñanza por medio de publicaciones, emisiones de radio o grabaciones sonoras o visuales, con tal de que esa utilización sea conforme a los usos honrados.”

El término “enseñanza” hace referencia a todos los niveles de enseñanza (universidades, escuelas dependientes del Estado, municipales y colegios de enseñanza privados…). Surge la duda de si esa “enseñanza” queda limitada a la impartida en las aulas “físicas” o incluye también la enseñanza por correspondencia o a través de Internet, donde no existe un contacto directo y presencial con el docente. A este respecto, la opinión mayoritaria es que no hay razón para excluir la enseñanza no presencial. Por otro lado, este artículo tampoco restringe el número de copias que puede realizarse en el caso de las publicaciones y grabaciones audiovisuales que se efectúan con fines de enseñanza, pero sí podría considerarse que no es un “uso justo” (fair use) si se hace un número excesivo de copias (Ricketson, 2003).

Este límite a los derechos también fue incluido en la directiva europea de 2001. A este respecto, son muy interesantes los considerandos 14 y 42:

“(14) La presente Directiva aspira a fomentar el aprendizaje y la cultura mediante la protección de las obras y prestaciones, permitiendo al mismo tiempo excepciones o limitaciones en interés general para fines educativos y docentes.
(42) Al aplicar la excepción o limitación en el caso de fines educativos o de investigación científica no comerciales incluida la educación a distancia, la naturaleza no comercial de la actividad de que se trate debe venir dada por la actividad en sí. La estructura institucional y los medios de financiación de la entidad de que se trate no son los factores decisivos a este respecto.”

The eXe project developed a freely available Open Source authoring application to assist teachers and academics in the publishing of web content without the need to become proficient in HTML or XML markup. Resources authored in eXe can be exported in IMS Content Package, SCORM 1.2, or IMS Common Cartridge formats or as simple self-contained web pages.

eXe grew out of the New Zealand Government Tertiary Education Commission's eCollaboration Fund and was led by the University of Auckland, The Auckland University of Technology, and Tairawhiti Polytechnic. It was later supported by CORE Education, a New Zealand-based not-for-profit educational research and development organisation. It has also been greatly assisted by a global group of participants and contributors.

eXe was named a finalist in the New Zealand round of the IMS Global Learning Impact Awards 2008 and went on to claim a Leadership Award at the international judging. (eXe was rated Best in Show for "Content Authoring", and also one of the top 3 participant rated projects!)
