L’application de l’intelligence artificielle au droit promet un gain d’efficacité considérable dans les sphères juridique et judiciaire. Mais que signifie cette promesse ? L'IA reproduit-elle à l’identique les processus juridiques et les fonctions qu’ils assurent ? Ou bien, au contraire, porte-t-elle un potentiel transformatif du droit, qu’il conviendrait alors d’évaluer et de piloter ? Les auteurs pointent les spécificités des technologies numériques à l’œuvre et soulignent que le langage, la logique et les méthodes du droit sont transformées par leur informatisation. Cette transformation rapproche le droit informatisé de l’idéal kelsenien en même temps qu’elle donne les moyens de son instrumentalisation. Il s'agit alors d'évaluer cette transformation. L'argument du gain en rationalité ou en objectivité du fait de l'informatisation s'avère limité. L'informatisation du droit porte en outre le risque d’une réduction (aveugle) du juridiquement souhaitable au techniquement faisable.

This article argues that, as a matter of constitutional law, government agencies that engage in policing cannot collect digital data, particularly about individuals for whom there is no suspicion of wrongdoing, without a sufficient regulatory scheme in place. A sufficient regulatory scheme justifies collection, achieves a public end, and has adequate protections for individual rights. Unauthorized and unregulated bulk digital collection of surveillance data simply may not occur.
