TSA firing 8 air marshals for drinking on duty in New York | The Billy Pulpit | Scoop.it

(CBS News) The Transportation Security Administration is in the process of firing eight federal air marshals for drinking alcohol while on duty during a training session in New York. Six additional air marshals are being suspended for not reporting the misconduct.

A TSA spokesman said the incident happened in February at a New York restaurant. The 14 air marshals allegedly involved were taking part in a training session that day. They were not scheduled to fly, but were still considered to be on duty.

The TSA strictly forbids drinking for any air marshal deemed to be on the job...

Hialeah Gardens Cop Lawrence Perez Shows How Drugs Can Corrupt Police

Hialeah Gardens Cop Lawrence Perez Shows How Drugs Can Corrupt Police | The Billy Pulpit | Scoop.it

Via Miami New Times:

Lawrence "Larry" Perez spots a white BMW 750Li blowing through a stop sign at the intersection of West Flagler Street and SW 62nd Avenue. It's about 20 minutes past 10 p.m. The husky, bald Hialeah Gardens police detective flips on the blue-and-red lights inside his unmarked silver Ford Fusion and pulls the Beemer over.

He asks the driver, Wilfredo Gonzalez, and the passenger, Danny Zequiera, for their IDs and then sniffs the air. "I smell something strange," Perez announces. "Open up the trunk."

Inside is a duffel bag packed with ten pounds of marijuana belonging to Zequiera. Perez arrests Gonzalez on the spot but lets Zequiera go. A few minutes later, a white tow truck with the words "Good Fellows" stamped on the door whisks the BMW away.

It might sound like an ordinary pot bust, but the car was never sent to an impound lot. Gonzalez was never booked into jail, and the ten pounds of pot — worth $33,000 on the street — never ended up in an evidence room...

MIAMI (AP) — Chris Bosh is still hurting, and his Olympic plans are being pushed aside so he can heal.

The Miami Heat forward told USA Basketball on Friday that he is withdrawing from consideration for the London Games so he can continue recovering from the strained abdominal muscle that sidelined him for a portion of his team’s run to the NBA championship. Bosh announced the decision through agent Henry Thomas one day after Heat teammate Dwyane Wade pulled out of the Olympic mix because of looming left knee surgery...

House could arrest Attorney General Eric Holder

House could arrest Attorney General Eric Holder | The Billy Pulpit | Scoop.it

Via Washington Times:

Despite voting to hold Attorney General Eric H. Holder Jr. in contempt of Congress, there’s little House Republicans can do in the short term to compel him to turn over documents — unless it wanted to revisit a long-dormant power and arrest him.

The thought is shocking, and conjures up a Hollywood-ready standoff scene between House police and the FBI agents who protect the attorney general. It’s a dramatic and unlikely possibility not least because Congress doesn’t even have a jail any longer. But in theory it could happen.

Republicans say it’s not even under consideration, with House Speaker John A. Boehner’s spokesman flatly ruling it out...

Juror renounces guilty verdict in Michael Brewer burning trial: "I strongly believe that Matthew Bent is not guilty based on the evidence given." | The Billy Pulpit | Scoop.it
Via Sun Sentinel:

FORT LAUDERDALE— The jury in the Michael Brewer burning trial was torn by racial divisions and came up with a compromise verdict because those who wanted to acquit accused ringleader Matthew Bent didn't know they had the right to stand by their not-guilty votes, according to a letter sent to the judge overseeing the case.

Juror Karen Bates McCord submitted her letter to Broward Circuit Judge Michael Robinson on Wednesday afternoon. Defense lawyer Johnny McCray went to court Thursday to file a motion for a new trial, using McCord's letter as part of his basis.

"I strongly believe that Matthew Bent is not guilty based on the evidence given," McCord wrote...

Central Park's Antisemitic Elmo is named Adam Sandler and he used to run a Cambodian porn site called 'Welcome to the Rape Camp' | The Billy Pulpit | Scoop.it

Experts Say Pot Didn't Trigger Miami Zombie Attack and Bath Salts May Yet Be to Blame

Experts Say Pot Didn't Trigger Miami Zombie Attack and Bath Salts May Yet Be to Blame | The Billy Pulpit | Scoop.it

Via Miami New Times:

Though, final toxicology results on Rudy Eugene's body only turned up traces of marijuana in his system, experts say that there's no way pot could have caused him to eat a man's face. Instead, some suggest that he may have been under the influence of a Bath Salt-like substance that laboratories are net yet equipped to detect.

In results released yesterday, The Miami-Dade Medical Examiners Office said that they found no drugs other than marijuana in Eugene's system. An outside laboratory was brought in to help check for synthetic substances, and MDPV, the active ingredient in many forms of Bath Salts, was not found. Five other chemicals commonly found in Bath Salts were also absent.

Experts talking to Discovery News say that there's no way that marijuana is to blame for the attack...

Florida Politicians React To Supreme Court Health Care Decision

Florida Politicians React To Supreme Court Health Care Decision | The Billy Pulpit | Scoop.it

Via CBS Miami:

WASHINGTON (CBSMiami) – Within minutes of the Supreme Court’s decision, Florida Democrats and Republicans began firing off statements either labeling the Affordable Care Act as either a burdensome new tax or lauding it is as monumental ruling in American history.

For the most part, Republicans came down hard on the decision and moved the talking point away from health care itself and instead tried to recast the decision as a large new tax all Americans would have to pay.

“The tax question was repeatedly refuted by members of Congress who helped pass this health care takeover,” Governor Rick Scott wrote. “The Justices have declared that the provision of ObamaCare is a judicially mandated tax. A new tax pure and simple. This is just another burden the federal government has put on American families and small businesses..."

Miramar Police Captain Made 15-Year-Old Girl Take Off Clothes, Faces 2 Counts of Lewd Or Lascivious Conduct

Miramar Police Captain Made 15-Year-Old Girl Take Off Clothes, Faces 2 Counts of Lewd Or Lascivious Conduct | The Billy Pulpit | Scoop.it

Via NBC Miami:

A veteran Miramar Police captain turned himself in at the Broward County Main Jail Friday on two counts of lewd or lascivious conduct after he made a 15-year-old girl talk off her clothes to prove that she was not having sex in the back seat of a parked car, authorities said.

Capt. Juan de los Rios found a 15-year-old girl talking with a 19-year-old boy in the rear seat of a car parked behind some office buildings in a Miramar industrial park on the afternoon of Jan. 18, according to his arrest affidavit.

De los Rios, 46, asked the girl if they had had sex in the car, and she said no and that they were just talking, the girl told investigators.

But de los Rios, who has been on the Miramar Police force for 28 years, told her that she needed to remove her pants and underwear so if he could see if she’d had sex. The fearful girl complied, and the police officer went on to “inspect” her with light from his flashlight, and told her to pull down her blouse so he could check for “bruising,” the girl told police.

The charge de los Rios faces – lewd or lascivious conduct on a child under age 16 by someone over age 18 – is a second-degree felony that is punishable by up to 15 years in prison and up to a $10,000 fine...

Taxpayers lose $40-60 million on another bankrupt solar company

Taxpayers lose $40-60 million on another bankrupt solar company | The Billy Pulpit | Scoop.it

Via Businessweek:

Abound Solar Inc., a U.S. solar manufacturer that was awarded a $400 million U.S. loan guarantee, will suspend operations and file for bankruptcy because its panels were too expensive to compete.

Abound borrowed about $70 million against the guarantee, the Loveland, Colorado-based company said today in a statement. It plans to file for bankruptcy protection in Wilmington, Delaware, next week.

The failure will follow that of Solyndra LLC, which shut down in August after receiving a $535 million loan guarantee from the same U.S. Energy Department program. Abound stopped production in February to focus on reducing costs after a global oversupply and increasing competition from China drove down the price of solar panels by half last year.

U.S. taxpayers may lose $40 million to $60 million on the loan after Abound’s assets are sold and the bankruptcy proceeding closes, Damien LaVera, an Energy Department spokesman, said in a statement today...

Attorney: Suspend murder trial so I can compete in Sloppy Joe's Key West Ernest Hemingway Look-a-Like Contest

Attorney: Suspend murder trial so I can compete in Sloppy Joe's Key West Ernest Hemingway Look-a-Like Contest | The Billy Pulpit | Scoop.it
Via Keynoter:

An attorney representing a Tampa-area man accused in a murder-for-hire scheme believes the importance of being Ernest trumps his client's trial needs. A judge -- apparently an Ernest Hemingway fan -- disagrees.

Frank Louderback represents Jerry Bottorff, accused of murder for hire, conspiracy to commit murder for hire and a weapons offense for his involvement in the 2007 slaying of Thomas Lee Sehorne, 37, in Lithia, Fla.

Bottorff would later go on to marry Sehorne's widow, Christie. Both, along with alleged gunman Luis Lopez, face trial starting July 9. Louderback wants the trial suspended on July 20. Why?

He's entered the annual Ernest Hemingway Look-a-Like Contest at Sloppy Joe's in Key West and doesn't want to miss it. The winner will be crowned on July 21.

U.S. District Court Judge Steven Merryday countered in his decision on Louderback's motion: "Between a murder-for-hire trial and an annual look-alike contest, surely Hemingway, a perfervid admirer of grace under pressure, would choose the trial."

He then quotes a Dorothy Parker article about Hemingway from the Nov. 30, 1929, New Yorker: "He works like hell, and through it.... He had the most profound bravery.... He has never turned off on an easier path than the one he staked for himself. It takes courage."

The judge continued: "Perhaps a lawyer who evokes Hemingway can resist relaxing frolic in favor of solemn duty." He then quotes Hemingway’s “The Sun Also Rises”: “Isn’t it pretty to think so?”

On June 22, Merryday issued his decision: "Best of luck to counsel in next year's contest. The motion is denied..."

2nd Miami-Dade Schools Employee Reassigned Over Investigation Into Misuse of Baker Act to Pad Crime Stats

2nd Miami-Dade Schools Employee Reassigned Over Investigation Into Misuse of Baker Act to Pad Crime Stats | The Billy Pulpit | Scoop.it

Via Huffington Post Miami:

A second high-ranking employee of Miami-Dade Public Schools has been reassigned as the district investigates allegations of overusing the Baker Act.

Suzy Milano-Berrios, the director of mental health and crisis management, has been removed to the attendance services office.

Allegations that district police were instructed by then-Chief Charles Hurley to Baker Act, rather than arrest, students in an effort to pad crime statistics first surfaced in mid-May with the filing of several complaints from "high-ranking" officers.

The Baker Act, known officially as the Florida Mental Health Act, allows law enforcement to place individuals who are a risk to themselves under “temporary detention for evaluation.” If necessary, they can be placed in a treatment facility for up to 72 hours.

Statistics show Baker Act cases in Miami-Dade schools have nearly doubled in the last five years; records from the 2011-2012 school year indicate 646 instances in Miami-Dade but just 120 in Broward County and 250 in Palm Beach County, the state's top two and fifth-largest districts...

Convicted child rapist Jerry Sandusky could keep his $5,000 per month Penn State pension

Convicted child rapist Jerry Sandusky could keep his $5,000 per month Penn State pension | The Billy Pulpit | Scoop.it

(CBS/AP) HARRISBURG, Pa. - Pennsylvania's public employee pension system says it won't be able to say if Jerry Sandusky will lose his retirement benefits until after he's sentenced, a proceeding expected in about three months.

Sandusky's $59,000 per year state pension is still being paid out, even after being convicted on 45 criminal counts for sexually abusing 10 boys, reports CBS affiliate KYW in Philadelphia. As he sits in the Centre County prison now, Sandusky is currently collecting monthly pension checks totaling $4,908.17.

A spokeswoman for the State Employees' Retirement System said Wednesday the agency doesn't speculate about potential future actions under the Public Employee Pension Forfeiture Act, but did say the pension board would fully review Sandusky's case once he is sentenced.

Offenses that trigger forfeiture are generally along the lines of theft, obstruction and perjury. A pension system document says forfeiture can also occur when a school employee commits certain sex offenses against a student...
