 "Distracted driving" is defined as any activity that could divert a person's attention away from the primary task of driving.  Although texting and driving is usually the example that people think of most when they think of distracted driving, there are many other culprits out there.  For instance, have you ever seen someone using their navigation system or applying makeup while they are driving?  I actually saw someone trying to read a paperback book while driving on a busy road the other day.  According to distraction.gov, in 2010, 3,092 people were killed as a result of an automobile accident involving a distracted driver and an estimated additional 416,000 were injured in motor vehicle crashes involving a distracted driver.  Even simply talking on the cell phone is dangerous as it reduced the amount of brain activity associated with driving by 37% according to Carnegie Mellon.

TALLAHASSEE, FL (NSF) - Drivers would be banned from manually typing or reading texts, emails or other electronic messages while operating a car under legislation filed in the Senate Tuesday.

 

The measure (SB 52), filed by Sen. Nancy Detert, R-Venice, calls for the offense to be what is known as a "secondary offense," meaning officers could only ticket people for texting while driving if they've stopped them for some other traffic violation. That is, if a police officer sees someone texting they wouldn't be able to pull them over but if they see someone speeding and texting, they could tack on extra charges for texting in addition to the speeding penalty.

 

Drivers would still be able to read navigational devices or electronic maps without incurring a penalty under the proposal. Reading weather alerts or other safety-related information would also be exempt, as would using a hands-free voice-recognition application.

 

Texting while driving would be a nonmoving violation, punishable by a $30 fine, under the bill.

 

According to the National Conference on State Legislatures, Florida is one of only five states without some sort of ban on texting while driving. The others are Montana, South Dakota, Arizona, and South Carolina...

1.   Obtain all items of evidence and preserve such:  It is vital to retain an investigator to examine the accident scene, take photos of the roadway including skid marks and interview all available witnesses.  If possible, have the investigator secure as many witness statements as possible.

2.   Request the police/incident report, any investigative reports prepared by a governmental agency and all photographs.

3.   Have the investigator photograph the truck and all motor vehicles involved in the collision

As a motorcycle accident lawyer in Clearwater, we see a number of collisions between bikes and cars. A recent study by the Florida Department of Transportation (FDOT), found that a majority of car vs. motorcycle collisions were actually caused by the negligence of the car driver in contrast to popular opinion.  It is a common belief that the reckless conduct of those on sports bikes (i.e., “crotch rockets” ) are representative of the general behavior exhibited by most bikers.   This could not be further from the truth. 


In fact, the leading factor in such collisions is the car or truck driver failing to yield the right of way to a much smaller motorcycle.  This behavior, known as “lane splitting,” is not illegal in some states.

However, Florida is not one of those jurisdictions.

This activity should be distinguished from “lane sharing.” Lane sharing occurs when two motorcycles occupy the same lane.

If an accident occurs when a motorcycle is lane splitting, they will be presumably held at fault even for the collision. In Florida, an accident victim will be compensated to the extent that his or her negligence did not contribute to an accident. Therefore, if a motorcyclist is at fault, then they will generally be unable to recover. The caveat to this rule is that if the rider can show that the other driver contributed to the accident. For example, if the driver was talking on a cell phone, weaving between lanes, or performing other careless maneuvers then they may be found to have contributed to the accident.
