According to the Federal Motor Carrier Safety Administration, the leading causes of large truck crashes are speed, distraction, and impairment due to fatigue, alcohol, or illness. Due to the severity and fatalities often resulting from truck accidents, which are suffered by non-truck occupants nearly 70 percent of the time, the federal government has instituted trucking service hours as a means of keeping fatigued truck drivers off of public roads. Regulating these requirements, however, can be difficult as they are complex and the industry is relatively self-regulated. If you were injured in a truck accident, it is essential to request the trucking logbook as soon as possible to ensure that the truck driver was operating within federal regulations.

As a motorcycle lawyer, it is my goal to educated motorcyclists on safety issues and how to best protect yourself to minimize the risk of sustaining a serious physical injury The single most important aspect of motorcycle safety is the choice and utilization of proper head-gear.  Based on the lack of steel surrounding a biker, a motorcycle clearly lacks the protection that an automobile has.  In order to protect a biker’s single most essential function, the brain (which is a jello like structure) is best served protected by a well-designed safety helmet.

A report on Tuesday, October 27th, revealed that Tampa Bay was the number 1 city with the most legal ads running and saturating our TVs. If it’s not on the radio, most Floridians are well aware of John Morgan and his ever-expanding family of lawyers at Morgan & Morgan—for the people. The U.S. Commerce’s Institute for Legal Reform estimates that Morgan & Morgan has a TV advertising budget that tops $24 million annually, without even taking other advertising mediums into consideration.

This is a tragedy of grand proportions that could have been prevented but for the negligence of a truck driver who chose to illegally park beside a freeway in a manner that created a hazard to oncoming traffic.  California Vehicle Code 22500 prohibits any vehicle from parking or standing stationary adjacent to a highway in a manner the obstructs the flow of traffic.  It sounds like the trucker in question testified inconsistently as to why he parked when and where he did and the jury found the weight of the evidence to support a claim that he acted in an unreasonable manner and caused multiple deaths.  


Some would argue that the jury award of $150 million seems excessive.  California law gives full discretion to a civil jury, however, to determine the value of the loss of human life including, in this case, the lifetime loss of the love, society, comfort and companionship that would have been provided by the girl's family had they not been killed.

What if it was a male child who developed enlarged breasts and had to endure the trauma of having a radical mastectomy? This is an actual scenario that has been repeated countless times due to the adverse affects of a drug called Risperdal.
