How Contingency Fees Work in Personal Injury Cases - Dolman Law Group

How Contingency Fees Work in Personal Injury Cases - Dolman Law Group | Personal Injury Attorney News | Scoop.it
Most personal injury attorneys in Florida use contingency fees rather than hourly rates. These fees are dependent (or contingent) on how much the attorney recovers for the clients. To learn more, check out this article and visit our site more for more information.
Matthew A. Dolman's insight:

Two common questions that personal injury plaintiffs and prospective clients ask, understandably, is “what is the attorney’s fee going to be” and “who is going to pay it”? Dolman Law Group, like most plaintiff personal injury firms, handles cases on a contingency fee basis. Basically, what this means is that you are not charged an attorney’s fee unless you recover money in your case – either by way of a settlement, judgment, or jury verdict.

This article provides a brief summary of how contingency fees work in  personal injury cases and answer some common questions that clients and prospective clients ask.

The statute of Limitations and Your Car Accident Claim

When car accidents happen, some drivers and passengers walk away with minor bumps and bruises or catastrophic, while others suffer life-changing injuries with fatalities. Before the end of 2018, more than 360,000 traffic crashes have occurredon Florida roads, resulting in well over 200,000 injuries and more than 2,600 fatalities. If you have been injured in a car accident or a family member has lost their life in an accident, you might be eligible to recover damages if the accident was caused by another party’s carelessness.

Don’t wait to find out about your rights to compensation. Florida, like all states, limits the amount of time you have to seek compensation from the parties who harmed you or your loved one through its “statute of limitation.”

Matthew A. Dolman's insight:

When someone thinks of care for the elderly, the facility that first comes to mind is the traditional nursing home. Despite their missive to assist their elderly resident’s as they traverse one of the more vulnerable segments of their lives, nursing homes can at times be the site of extremely damaging abuse.

Any Elder Care Facility can be a Setting for Abuse

This nursing home abuse can come in many forms and can be done by a variety of different individuals within a nursing home but the end result is always substantial harm to a nursing home resident. Nursing homes are not the only kind of elder care facility that people turn to. Many other kinds of facilities are utilized to care for the elderly and can also be settings in which residents and patients suffer abuse. The types of elder care facilities that are available can be divided into four categories.

How to Deal With Harassment in the Workplace

Most discussion of workplace harassment focuses on sex-related misconduct, such as a boss grabbing his secretary inappropriately, requesting sexual favors, or making other unwelcome sexual advances. These behaviors certainly fall under the umbrella of harassment in the workplace, but it’s important to remember that not all harassment is sexual in nature, nor does it always involve a male boss harassing a female subordinate.

Statistics from the National Highway Traffic Safety Administration (NHTSA) show that motorcyclists are six times more likely to sustain injuries during a traffic accident than car drivers. This means if you have recently been in a motorcycle accident, you are probably also dealing with medical bills and extended time off from work. The last thing you need is to have your insurance claim derailed by an insurance claims adjuster. So, what should you do when that call from the insurance company comes? Here are a few suggestions.

Matthew A. Dolman's insight:

Freedom from religious discrimination is one of the founding beliefs on which this country was founded. The ability to practice a religion without fear of retaliation and persecution is a right that is afforded to every American. The workplace both private and public is no exception to this basic human right. Regardless of this basic liberty’s age and acceptance as a basic human right by the majority of Americans, it is still infringed upon.

Many employees can suffer discrimination based on the religion or creed they practice. This employment discrimination is very much illegal as one can imagine. Protection from religious discrimination in terms of the workplace and employment is protected by Title VII of the Civil Rights Act of 1964 which also protects a multitude of other groups subjected to discrimination. On top of the federal protections enacted by Title VII, Florida state law protects employees from religious discrimination with the Florida Civil Rights Act which protects employees of businesses of 15 or more employees.

This risk can also be exacerbated by insufficient sanitation practices within the hospital premisesLocal 10 examined hospital grades issued by the independent non-profit group Leapfrog. Hurricane Michael Florida Property Damage and Injury

If you live in Florida, hurricanes are a part of life. While weather specialists can often predict a hurricane’s severity and point of impact, giving enough warning to permit preparation and evacuation if necessary, Hurricane Michael threw Floridians for a loop when it took a last minute turn toward Tampa Bay. In fact, many Floridians had evacuated to the Tampa Bay area with the expectation that Michael was going to hit Florida’s east coast. If you were injured as a result of the hurricane, however, do you have a claim for damages? And if so, against whom?

Matthew A. Dolman's insight:

What Happens if You’re Injured and the Other Driver’s Insurance Company Won’t Pay Your Claim?

When you’re dealing with serious accident-related injuries, the stress levels increase when the liability adjuster refuses to pay your claim. You depend on medical care, physical therapy, medication, and other costs you need to recover from your accident. If you’re losing income due to a temporary disability, you need money for everyday expenses. If you don’t have the financial resources to pay for medical care and basic necessities, it delays your recovery and changes your lifestyle.

If you’re injured in an accident in Aventura, Florida, connect with the lawyers at Sibley Dolman as soon as possible. While our clients concentrate on their recoveries, our personal injury attorneys handle insurance company contacts and look for answers to legal and insurance questions.

Why Did The Adjuster Refuse to Pay Your Claim?

You can’t contest an insurance company’s refusal to pay if you don’t know or understand their reasons why. When an insurance company won’t pay your claim, it’s usually more complicated than a simple refusal. If insurance refuses to pay without explaining the reasons for the denial, those actions violate Florida’s Unfair Claim Practices Statute. When they explain your claim denial, get it in writing.

Unfortunately, some insurance companies use a refusal to pay as a negotiation tactic.

Matthew A. Dolman's insight:

What is a Bedsore or Pressure Ulcer?

A pressure ulcer is a sort of skin injury that is caused by prolonged pressure being placed on a specific site of the skin. This kind of injury is most commonly found on areas of the skin that cover bony areas of the body like the shoulder blades, ankles, heels, hips, and the tailbone. Bedsore injuries are not only skin deep. A bedsore injury can extend to the deeper tissue and lead to some further issues.

Those at risk for bedsores are people with conditions that limit their mobility and see them stuck in the same position in bed or a chair for long periods of time. Naturally, there are quite a few elderly people with medical conditions that place them within this high-risk group. Many sores heal on their own with enough time and steps taken to remove the pressure that caused them but sometimes bedsore can require medical intervention if it has had enough time unaddressed.

The data from the NHTSA show that bicycle accident fatalities increased about one third from 2010 to 2016 and the fatality rate in Florida was more than 50 percent higher than the next highest state. Rise of Uber and Lyft Coincides With Increasing Car Accident Trends

A recent study by researchers at the University of Chicagosuggests that the rise of Uber and Lyft ride-sharing services may have contributed to the increased amounts of car accidents in areas where the services are active. The intent of the research was at first to show the benefits of ridesharing when it comes to decreasing accident rates. This sentiment has been spread with the claim that Ubers and Lyfts help decrease the number of drunk drivers by providing an easy transportation alternative for the intoxicated. Unfortunately, the preliminary findings seem to indicate that the advent of Uber and Lyft ride-hailing accompanies a 2-3% increase in total car accidents.

Rideshare Accidents Caused by Drowsy Lyft Drivers

Lyft drivers often work long hours, frequently driving late into the night. As the hours on the clock increase, so do their rates—and in the middle of the night, they’re more likely to get those high-dollar fares as the bars clear out, parties end, and inebriated people need a safe ride home. Unfortunately, the later it gets, the more tired even the most experienced driver becomes. Drowsy Lyft drivers can cause plenty of problems on the road. If you get in the car with a drowsy driver, make sure you know how to respond and avoid getting involved in a Lyft accident.

Matthew A. Dolman's insight:

If you have suffered an injury as a result of the negligence exhibited by an individual or corporation, hiring a personal injury lawyer is vital. Sadly, I see many individuals attempt to handle their own personal injury claim and fail for several distinct reasons. There are countless studies demonstrating that a claimant represented by legal counsel will ‘net’ (not just gross) in excess of three times more money than had they handled their own claim.

Such overtures are known as “nuisance value” offers. In other words, the carrier is only offering money as the claim is a mere nuisance to them as the unrepresented injury victim has no “bite to their bark.” You can send the respective auto insurance carrier countless letters demanding a settlement that will undoubtedly fall on deaf ears as a non- lawyer lacks the ability to handle their own lawsuit. Thus, the carrier will act as if they have nothing to fear as their policyholder will have no exposure.

Technically you may choose to represent yourself but as the old saying goes “he who represents himself has a fool for a client.” A victim of a car accident or general negligence lacks the training and experience necessary to negotiate properly with an insurance carrier and resolve the medical bills that one will generally incur as a result of medical treatment. Further, a claimant almost always lacks the resources to retain the best experts and the knowledge to recognize the need for such in order to prove liability and truly demonstrate the severity of the injuries sustained.

10 Common Misconceptions About Personal Injury Claims in FL | Personal Injury Attorney News | Scoop.it
There are many common misconceptions regarding personal injury claims. Learn more from experienced Florida PI attorneys at Dolman Law Group. Click here.
Matthew A. Dolman's insight:

Misconception 1: I have insurance, so I don’t need an attorney.

It is important to remember that insurance companies are running a for-profitbusiness. An initial offer from the insurance company to settle your claim will almost always be less than the full amount of your coverage and may not be enough to cover your medical bills and other expenses. The insurance company employs well-trained, expert claim adjusters, investigators, and attorneys. Not only is attempting tonegotiate with the insurance company on your own a bad idea, but statements you make to them could potentially be used against you and harm your claim. It is in your best interest to hire an experienced personal injury attorney—one who is working for you—to evaluate your claim and negotiate with the insurance company on your behalf. Personal injury claims can be complex and tricky, so having someone who has handled thousands of cases can be extremely beneficial.
