How Contingency Fees Work in Personal Injury Cases - Dolman Law Group

How Contingency Fees Work in Personal Injury Cases - Dolman Law Group | Personal Injury Attorney News | Scoop.it
Most personal injury attorneys in Florida use contingency fees rather than hourly rates. These fees are dependent (or contingent) on how much the attorney recovers for the clients. To learn more, check out this article and visit our site more for more information.
Matthew A. Dolman's insight:

Two common questions that personal injury plaintiffs and prospective clients ask, understandably, is “what is the attorney’s fee going to be” and “who is going to pay it”? Dolman Law Group, like most plaintiff personal injury firms, handles cases on a contingency fee basis. Basically, what this means is that you are not charged an attorney’s fee unless you recover money in your case – either by way of a settlement, judgment, or jury verdict.

This article provides a brief summary of how contingency fees work in  personal injury cases and answer some common questions that clients and prospective clients ask.

Matthew A. Dolman's insight:

Motorcyclists love fresh air in their faces, the freedom to pack little and travel far, and the camaraderie of fellow motorcyclists. But riding on a motorcycle in the city or on the open road can sometimes be dangerous.

Even when a rider is fully outfitted in safety gear, he or she is not as protected as a vehicle driver who has a crash-tested frame and airbags for protection. When collisions do occur, they can range from minor to severe, including death, according to the National Highway Traffic Safety Administration (NHTSA). In 2016:

  • 5,286 motorcyclists were killed on U.S. roads
  • Motorcyclist fatalities occurred almost 28 times more frequently than passenger car occupant fatalities.
  • Twenty-seven percent of motorcycle riders in fatal crashes were riding without valid motorcycle licenses.
  • Fatal motorcycle crashes involved drivers with the highest percentage of alcohol-impairment than other vehicle types.
  • Thirty-seven percent of motorcycle drivers who died in single-vehicle accidents were alcohol-impaired.
  • NHTSA estimates that helmets saved 1,859 lives in 2016, and 802 more lives would have been saved if all motorcyclists wore headgear.

Matthew A. Dolman's insight:

Steps to Take Following a Concussion

Many injuries suffered after an accident are visible to the naked eye—lacerations, puncture wounds, and bruises. But invisible injuries, such as concussions, are no less dangerous. If you suffered a blow to the head, seek medical treatment immediatelyand contact a personal injury attorney to see if you qualify for compensation.

What Is a Concussion?

Our skulls provide excellent protection to our brains. And spinal fluid surrounding the brain acts as a cushion, protecting your brain from slamming into the inside of your skull. But if you suffer any kind of blow to the head, that blow may shake your brain. If severe enough, this shaking can cause your brain to hit the hard inner shell of your skull, causing a concussion. In extreme cases, you might black out—but you don’t have to pass out to suffer a concussion.

Matthew A. Dolman's insight:

Making a homeowners insurance claim for stucco damage in Florida.

What is stucco and how does it get damaged?

Stucco is basically cement plaster which is applied to either the exterior or the interior of buildings and is designed to provide a seamless finish to a wall. It can be crafted into many different textures and is available in a wide range of colors.

While it may look nice sitting on the exterior of your home, stucco can be a huge issue for homeowners because water can actually become trapped behind the outer layer and cause significant damage to your walls.

Often times, this damage is caused by the utilization of what is known as the exterior insulation and finish system. This system, if not properly applied to your home, will break down and let water inside your walls. Once the water is inside, it causes the wooden structures inside your walls to severely rot. The result is a rotting foundation and a potential stability issue in your home.

Matthew A. Dolman's insight:

Florida’s New Ridesharing Law

Under Florida’s new rideshare driver laws, each driver must have a minimum of $1 million in liability coverage (which extends to personal injury, death, and property damage). Even when the driver is off-duty, he or she must have at least $50,000 in personal injury or property damage liability coverage on the vehicle. The limits that apply to your case depend on whether a defendant driver was working (i.e. waiting for a new fare, going to pick up a new passenger, or transporting a passenger). It’s important to hire a qualified attorney with direct experience in handling claims against Lyft drivers before talking to any insurance company about your personal injury claim.

When do you need to hire a car accident attorney?

When do you need to hire a car accident attorney? | Personal Injury Attorney News | Scoop.it
Thirteen top attorneys from around the country were asked, "When do you need to hire a car accident attorney?" This is what they said.
Matthew A. Dolman's insight:

It is important to note that not all personal injury law firms are the same. In fact, many of the biggest advertising firms are little more than settlement mills. A settlement mill is a firm that relies on heavy advertising as the lifeblood of their business and litigate a disproportionate amount of their cases. Such firms do not rely on current or former clients to refer cases via word-of-mouth and can thus afford to employ a mill mentality to their handling of cases.

In fact, settlement mills tend to leave money on the table at the time of settlement as they are more concerned with resolving a volume of cases each month to pay their expensive advertising budget. Keep in mind that even an average trial lawyer is superior to a settlement mill as the insurance carrier must spend money defending a trial or a case that has advanced far in litigation. The goal of any insurance carrier is to save money and forcing them to run up costs gets their immediate attention.

Your Florida Motorcycle Accident Attorneys are ready to take on your case with the experience and resources necessary to get you the compensation you deserve.
Matthew A. Dolman's insight:

There are plenty of attorneys out there touting themselves as the best option for your legal needs. Many Florida motorcycle attorneys attempt to pass themselves off as fellow bikers, as though their status will qualify them to protect you when it matters most. More often than not, they are using their status as a marketing tool, rather than being genuine about their true character.

In the real world, you need to be concerned about your attorney’s credentials, their experience and their knowledge, and their ability to win your case. Basing your decision to hire a motorcycle personal injury attorney based on their claims to be bikers themselves will often end up backfiring when it comes to the court room.

Matthew A. Dolman's insight:

Legal Options if You’re Injured While Out of State

You may be visiting the state of Florida for any number of reasons. Tourism, family, business, or perhaps a combination of the three. Anyone is at risk for an injury across the state of Florida from a variety of factors; be it car accidents, slip and fall, or medical malpractice.
If you are injured out-of-state in Florida, then you should take into consideration the differences that there may be with Florida law and how you would normally seek compensation for your injuries in your home state. Small differences in the legal process or laws can make or break a successful case.
One of the primary concerns of being injured in an accident out-of-state, is determining what the jurisdiction of a possible injury claim would be. For the most part, you will have to follow the laws of the state in which the injury was sustained. So if you are on vacation in Florida from New York and you are involved in a car accident, then you would have to file an injury claim in the state of Florida since that is where the accident and occurred and where the jurisdiction is.

Dangerous Trucking Company Practices in Florida

Dangerous Trucking Company Practices in Florida | Personal Injury Attorney News | Scoop.it
Florida-based trucking companies are not immune to dangerous company practices, such as neglect or proper supervision. Florida truck attorney explains inside.
Matthew A. Dolman's insight:

While much attention is focused on truck driver negligence when it comes to liability for accidents involving large commercial trucks, commercial drivers are not the only parties that may be responsible for causing serious accidents and injuries. Manufacturers of trucks may be liable if they sold defective truck parts that malfunctioned and caused a driver to lose control. Additionally, government entities may be negligent if they allow dangerous road hazards to exist that lead to a truck accident. If you suffer an injury in a truck accident, determining who was responsible is imperative to ensuring that you recover for your losses. For this reason, you should always have the assistance of an experienced truck accident attorney who knows how to thoroughly investigate truck accidents to identify negligence.

Determining the Cause of a Florida Car Accident

Determining the Cause of a Florida Car Accident | Personal Injury Attorney News | Scoop.it
Sometimes an investigation into the cause of a car accident is cut and dry—for example, if you were rear-ended because the driver behind you was texting.
Matthew A. Dolman's insight:

Sometimes a car accident has multiple causes—for example, when a collision resulted because a speeding driver’s brake pads failed due to lack of maintenance. In this case, a court may find that the accident was caused by multiple, equally applicable factors.

Furthermore, a car accident may also be caused by the comparative negligence of both parties or due to a chain reaction of events. In these cases, the cause of the accident becomes more difficult to determine. When multiple parties and factors are involved, however, identifying the precise cause or causes of the accident can be the key to monetary recovery for your injuries and damages.

Matthew A. Dolman's insight:

When you’ve been injured in a Florida car accident, dealing with your insurance company can be confusing and frustrating. Unfortunately, how you handle those interactions can change how long it takes to receive insurance benefits and the amount of benefits you receive.

Florida is one of just a few states in the country that has (for now) a no-fault auto insurance law. You must carry a minimum of $10,000 personal injury protection insurance to register a car in Florida. In any accident, your PIP covers the costs of your injury regardless of who is at fault. (This post does not discuss other aspects of Florida car insurance law, which include mandatory property damage liability coverage and other optional forms of coverage, or the right to seek damages from at fault parties when serious injuries occur. Call Sibley Dolman for more information about those cases.)

In this post, we offer some tips for handling your PIP insurance company after a Florida car accident in which you’ve been injured. But please remember: these tips may differ from those that might be useful in other states, because of the somewhat unusual nature of Florida auto insurance law.

Matthew A. Dolman's insight:

Muscular stiffness following a car accident is often a sign of a soft tissue injury. Soft tissue injuries are those types of injuries that do not involve fractures or broken bones and that do not require invasive medical treatment, such as a surgery, to correct. Soft tissue injuries may consist of muscular sprains and strains, whiplash injuries, musculoskeletal disorderschest injuries (often burn injuries from the seatbelt), and knee sprains or contusions.

Soft tissue injuries are especially common in motor vehicle accidents like rear-end collisions. These collisions cause the vehicle driver’s body to abruptly move forward and backward inside the vehicle. Knee contusions are also common if a driver or passenger hits a knee on the car dashboard during a collision.

If you are a victim of an accident with a large truck crash caused by someone else, contact truck accident lawyers at the Dolman Law Group.
Matthew A. Dolman's insight:

We identify all lines of insurance coverage.

Truck accidents are inherently complicated as there are multiple lines of insurance coverage. For example, the truck and the trailer are often owned by two separate corporations and thus are insured by different carriers. Because of this, we can hold responsible, and pursue, both parties for their part in the negligence that caused your injuries. This requires extensive investigation and the testimony of multiple expert witnesses, all of which Dolman Law Group is prepared to handle.

We have the financial resources to handle truck accident cases.

Trucking accident cases are expert laden, since it is often necessary to prove complicated subject matters. For example, proving that a specific part failed, or that a specific hiring practice resulted in an injury, will require the expert knowledge of a hired witness. As a result, truck accident cases are very expensive to handle for a law firm. Since we have handled many different commercial truck cases in the past, we already have a network of witnesses and investigators ready to prove your case.

  1. Interview all available witnesses.

  3. Obtain photographs depicting the property damage involved to all vehicles.
  4. Perform a background check on the defendant including their criminal history.
  5. Obtain all medical records prior to and after the accident.

It is our earnest belief that by focusing only on the area of personal injury law we can avoid being a “jack of all trades and master of none.” We are proud of the reputation we have earned as aggressive advocates for the injured throughout Clearwater and the Tampa Bay area.

The #MeToo movement has reminded all of us that sexual harassment remains an enormous problem in the workplace and the public at large. On December 12, 2017, Governor Rick Scott emphasized the public significance of the issue when he signed Executive Order 17-319 directing all state agencies to train employees on sexual harassment prevention, develop adequate procedures for addressing sexual harassment in the workplace, and notify all employees of the State’s policies for investigating and reporting workplace sexual harassment. The governor’s order sent a clear signal that Florida law does not tolerate sexual harassment in any form.

Pain During Daily Activities after an Accident

So you were just involved in an accident, and you have finally returned home from the hospital; it’s time to get back to your day-to-day routine. Before the accident, you were an avid bowler, you took care of your two children, you worked a full-time job, did the laundry, and still found time to attend college classes on Tuesday nights. But ever since the accident, you have noticed that things don’t quite feel the same. You have pain in areas of your body that you never even thought about before. You now find those daily tasks to be harder to complete: bowling is near impossible, picking up your children is excruciating, your job has become harder, even a laundry basket feels heavy, and sitting upright in class for two hours is painful. In the legal and insurance world, these daily difficulties are known as duties under duress.
