If you have filed your 2012 tax return and are expecting a refund, you could lose that refund in your bankruptcy case.  Ask your lawyer if the refund can be declared exempt or if you should use the refund proceeds for necessities then wait to file.

It appears that the Supreme Court does not intend to revisit the very restrictive Brunner test for determining the dischargeability of student loans.  Given the growing disconnect between higher education costs and starting salaries, I wonder if we are producing a generation of well educated debtors who can never escape their student loan indebtedness.

The author makes an important point - just because a bill collector claims you owe money does not make it true.  Federal law allows you to demand validation of the debt, but you need to assert this right within 30 days of first being contacted about the debt.
