SHREDDING THE 4TH AMENDMENT: A CRIMINAL WORK IN PROGRESS | NEWSslinger - Conservative News, Politics and Commentary | newsslinger | Scoop.it

The Supreme Court gave yet another middle finger to the Constitution this week in a ruling on Tuesday that expanded police powers in a way that myself and other true conservatives agree violates the 4th Amendment.

 

     The essence of the ruling is this: if you and I are living together, and the police show up at the door and want to search our residence, they can do so if only one of us consents to the search, as long as the one who objects is arrested. Previously, both of us would have had to be in agreement over allowing law enforcement officials to enter and for the search to take place. The point about “being arrested” requires further explanation.

 

Samuel Alito, that eternal crusader for constitutional liberties, wrote that because a resident may not refuse a search of their home if they are not on the premises, it follows that the Supreme Court “therefore hold[s] that an occupant who is absent due to a lawful detention or arrest stands in the same shoes as an occupant who is absent for any other reason.”

 

     Except it doesn’t.

 

     As Justice Ruth Bader Ginsburg stated in her dissent , “Fernandez’s objection to the search did not become null upon his arrest and removal from the scene.”

 

     In other words, Fernandez, whom we shall meet in a moment, having been arrested, was as absent from the scene as if he were vacationing in Guantanamo Bay.

 

     The background for the 6-3 decision is as follows: California resident Walter Fernandez told law enforcement authorities they could not enter his Los Angeles home. They arrested him and left with him in tow. Later that day, they went back to Fernandez’s apartment and again requested that they be allowed to enter and conduct a search. This time it was his girlfriend Roxanne Rojas whom they asked, and she let them inside. In the course of the ensuing search, they found contraband including a knife and a shotgun. This evidence was used to help convict Mr. Fernandez of weapons and robbery charges, for which he is currently enjoying a fourteen-year prison sentence.

 

     This decision overturns an earlier 5-3 ruling by the Supreme Court that if either of two inhabitants of a residence wished to deny law enforcement officials entry, then police could not enter.

 

     Significantly, all three of the dissenting Justices are supposedly liberal. The others, including turncoat John Roberts and several supposed constitutional fundamentalists, who would never legislate from the bench, merrily participated in the further shredding of what little remains (if anything) of 4th Amendment protections concerning illegal search and seizure.

 

     I find it consistently alarming that so-called conservative and liberal judges and politicians are mostly united in the championing of greater powers for law enforcement for the alleged purpose of catching criminals and terrorists.  Where are those to champion liberty? Rand Paul is consistent in his denunciation of this arbitrary extensions of executive power by the courts (as are other lesser known conservatives), but the GOP establishment and the vast majority of current Democrats (including all the mindless zombies addicted to the precious Big Brother apologist MSNBC and the sophistry of a Chris Matthews) routinely attempt to throw the consitutional rights of their fellow Americans under the bus of tyranny, as evidenced by the erotic fervor with which they have embraced the Patriot Act, PRISM, and all similarly authoritarian contortions of law.

     There is more to the background of Tuesday’s ruling worth mentioning. When the police first knocked on Fernandez’s door, his girlfriend answered wearing a bloody shirt, with bloody hands, and with a contusion on her nose. She informed police that she had “been in a fight.” This was when Mr. Fernandez emerged and told the officers to leave the residence, informing them that he knew what his rights were under the Constitution. Believing a domestic violence incident had taken place, the police detained him, and then arrested him upon seeing a tattoo he had that was similar to a tattoo possessed by a known robbery suspect.

 

     The majority in Tuesday’s ruling tried to justify the illegal search and seizure of the residence that occurred later that afternoon in light of the suspicions of domestic violence. The three liberal dissenters disagreed, claiming that they did not object to his being arrested for domestic violence, but to the fact that law enforcement officials later searched Fernandez’s residence without bothering to get a warrant, even though the tattoo certainly would have served as sufficient probable cause to do so.

     Rojas’ willingness to let authorities into the home should not have negated her boyfriend’s refusal to do so. In the absence of a warrant, I and other libertarian conservatives object to this as a blatant violation of 4th Amendment rights.

 

     A shining city on a hill isn’t demolished overnight. It requires thousand of vicious little termites to eat away at its buildings’ foundations, letting these buildings gradually fall into ruins around their inhabitants, leaving them stranded in a wilderness of tyranny. Every judge that voted for this ruling is another little termite, gnawing away at our homes, a would-be devourer of liberty’s barely beating heart.

Human trafficking, the intentional forcing of persons into labor or sex trades, the removal of organs and tissues, the kidnapping and selling of infants is profusely practiced for the huge profits it renders.  Few traffickers are prosecuted and the consequences for those convicted are appallingly unequal to the crime.  To stop crime, laws must be enforced and punishments must be greater than the benefits of not getting caught.  The profuseness of human trafficking is an attestation to communities, laws and courts not protecting those who are in great need. 


 Estimates and statistics on human trafficking are staggering.  Polaris Project estimates that 27 million “people [are] in modern-day slavery across the world”, 161 countries are affected, 244,000 American children and youths are at risk, and yearly profits are $32 billion.  The National Center for Victims of Crimes points out that “Collecting statistics on human trafficking . . . is particularly difficult because of the hidden nature of trafficking activities”.  Individuals forced to perform labor, exploited for sex, sliced apart for organs and tissue, and the true number of babies stolen for later adoption is likely much greater.  But, even if it were 27 thousand, or 27, it must be stopped.  That human trafficking happens at all, in any form, is a gross aspect of humanity.


Human trafficking ruins lives, and those convicted should be in prison for no less time than their victims were accumulatively absent from their rightful and chosen place in life, plus time for increments of profits gained.  But, those convicted are often not severely punished.  Recently in the U.K. an investigation that began in 2007 was completed in 2013 with the conviction of four individuals.  These four individuals, the BBC reported, enslaved 12 men in disgusting and harmful conditions, yet the lengthiest prison term of those convicted was only 52 months.  In the U.S., as of September 2012, not all states had even enacted anti-trafficking legislation.


 A “specific concern  . . . [is] human trafficking around major sporting events . . . [that] not only pose a problem around sex trafficking, they also require massive construction projects, creating a demand for cost-effective labor” the U.S. Department of State reported on Jan 27, 2014.  Story after story of sex trafficking of children and non-consenting adults are well publicized.  Not quite so well publicized are stories of domestic enslavement.  A U.S. Department of State June 2007 report told of a 14-year-old who came to the U.S. to work as a paid domestic employee.  No payment was ever made and for five years this child suffered repeated rapings and beatings.  Eventually this child was rescued after a phone call from a concerned neighbor to law enforcement.


 Another big modern day concern is coercing or kidnapping and transporting people to facilities that remove and sell their organs.  The U.N. reported that “Organized crime groups lure people abroad with false promises and convince or force them to sell their organs for a low price. . .  There was recently a case in China where a group of 16 people, including doctors, were selling kidneys illegally.  . . . It is evident that international law enforcers must cooperate across borders in order to address organ-related crimes”.


 The U.N. estimated that in 2006 there were only 3,160 convictions globally for human trafficking.  With those odds versus the known profits, human trafficking is a very safe and desirable crime.

 The greatness of humanity will never be realized while human trafficking is allowed to thrive.  In the words of Robert F. Kennedy, “. . .each of us can work to change a small portion of events”.  Do not be shy, act against human trafficking and make the whisper of democracy into a shout for freedom.  Lobby for enforcement of laws and severe punishments.

What they have said, through Lt. David Thompson, was this, “We hope maybe understanding the gravity of this will change some of the behavior. We hope that we can give the neighborhood the quality of life that they deserve.”

 Apparently, the quality of life they deserve won’t be attained unless Bieber moves. This is not, by far, his first run in with neighbors. He is known for throwing loud, all-night parties and there have been several reports of him driving like a bat out of hell down their streets.

 

 Many have voiced skepticism on the subject of the number of officers called to raid Bieber’s home for said egg-throwing behavior.

 

 One Fox News fan wrote on their Facebook page, “Omg a felony raid for an egg throwing incident? Wow no wonder California laid off hundreds of Officer’s. If they do felony raids on eggs imagine what they do for a homicide…”

 

 Another had this to say, “All this for a stupid egg throwing prank? I agree he’s a little over indulged punk, but wasting these police resources is outrageous!”

 

 So was this a misuse of police forces? Aside from trying to impress gravity on the young, troubled, and inexplicably famous singer, Thompson had his reasons. For one thing, the detectives didn’t know what they would encounter at the home.

 

 “It’s always better to air on the side of safety,” he said. “We did contact seven or eight people in the house so I was thankful we had 12 detectives.”


 

 Sounds reasonable to me. If they were raiding a home in a shady neighborhood, they would have used the same force. I think there are so many situations that police officers encounter where they have to make judgement calls to keep themselves and citizens safe, and they don’t need the public ripping them up and down on a subject they know absolutely nothing about.


 

 If I were Lt. Thompson, and could talk to these jokers who are calling this incident a “waste of police resources” I would say, “You’re welcome for keeping you safe on the street. Every single day.” or “You do your job and I’ll do mine. You know, protecting YOU!”


 

Either way, whether Bieber understands the gravity of the path he is going down or not, perhaps he should be left alone to suffer the consequences of his actions, just like the rest of us. Then he can be free to hit bottom and have to pull himself up by the bootstraps and start over, broke and alone. Then, he may turn out to be a decent person and actually contribute something to society.

Everyone’s favorite obnoxious teen idol, Justin Bieber, is back in the news this week. Apparently, there was a raid at his house early Tuesday morning, which required the manpower of 12 detectives. What were they investigating? An egg-throwing incident from last week that cost his neighbor thousands of dollars in damage.


 While there, detectives arrested Bieber’s long time friend and rapper, Li’l Za for narcotics possession. They noted that cocaine was “in plain sight” as they walked through the home. They haven’t said yet if any evidence connecting Bieber to the egg incident was found. Exactly what would that be, anyway? Eggs in the fridge or suspicious absence of eggs in the fridge?

  Those who doubt that the current administration is an enemy of a free press need look no further than a devastating indictment recently issued by Reporters Without Borders in the 2014 Press Freedom Index.


     The Press Freedom Index ranks 180 countries according to the degree to which its journalists can operate without censorship or fear of persecution. The country that is responsible for the Bill of Rights currently ranks 46th.


This assessment is troubling for conservatives and other defenders of constitutional liberties. This poor ranking, which placed the United States behind such countries as Ghana, Botswana, and Romania, is largely due to the enthusiasm with which the United States has punished so-called whistleblowers under the Espionage Act.


     The Espionage Act, which became law in 1917, has been used by the Obama administration repeatedly to intimidate government employees, including Edward Snowden and Chelsea Manning, who have spoken out against what they perceived to be abuses of federal power. It is notable that none of those so prosecuted are accused of having leaking information to enemy governments; rather, their crime is to have shared classified information with American journalists.


     The poor ranking the United States received in this year’s Press Freedom Index was issued in the wake of significant revelations by Edward Snowden concerning the extent of the National Security Administration’s global surveillance programs.  Edward Snowden, of course, has been charged under the Espionage act with “unauthorized communication of national defense information” and “willful

communication of classified intelligence with an unauthorized person.” He is in fact the eighth such person so be so charged under Barack Obama. This is three more than under George W. Bush. Significantly, it is more than the total number of Americans who  were charged under the Act between 1917 and the year Obama ascended the throne.


     Once freedom of speech becomes merely a phrase on a piece of parchment, journalists begin to censor themselves. The shockingly aggressive prosecutions of whistleblowers under the Espionage Act serve as a stern warning to other would-be whistleblowers and the journalists who would enable them that opposition to the national security state will not be tolerated.


     The word “liberal,” from the Latin word liber, meaning free, has a much different meaning than it used to when it comes to matters of free speech. These days it is the so-called liberals in Congress who champion the imperial overreach of the president while it is left to conservatives such as Rand Paul to challenge it.  Modern liberals are reliable defenders of the status quo and all its constitutional collateral damage including drone assassinations, NSA surveillance, and incarceration of those who invoke their 1st Amendment right to free speech.


     Who are the Americans who have been targeted for expressing their 1st Amendment rights? Thomas Drake, an NSA senior executive who leaked information about his agency’s unconstitutional “Trailblazer” program to reporters for The Baltimore Sun, was initially prosecuted under this law but ended up pleading guilty to much lesser charge, a misdemeanor related to unauthorized use of a computer. John Kiriakou was an official with the CIA who was charged under the Espionage Act for  sharing “the names of two former colleagues who interrogated detainees using harsh practices including waterboarding.” He too pled guilty to a lesser charge and was sentenced to jail for over two years.  Whistleblowers Stephen Jin-Woo Kim of the State Department, CIA officer James Sterling, and Navy linguist James Hitselberger are still facing litigation under the Act. Shami Leibowitz, who worked for the FBI as a Hebrew translator, was sentenced to twenty months in prison for giving documents transcribing conversations in the Israeli embassy to a blogger named Richard Silverstein.  Chelsea Manning, of course, was convicted under the Act in 2013 and sentenced to prison for thirty-five years for giving classified material to Wikileaks. Edward Snowden, the Great White Whale of unauthorized leaks, remains at large.


     It may be tempting for conservatives to dismiss these whistleblowers as traitors who are being justly prosecuted for messing around with military secrets and classified intelligence memos where they should not be. This sort of kneejerk reaction is no longer something we can afford. Regardless of what you can say about Mr. Snowden’s reluctance to come home and face the charges against him, no conservative can deny that he initiated a substantial dialogue in this country about constitutional liberties, one that has been overdue for many years. An administration, whether Republican or Democratic, that restricts freedom of the press to the degree that Obama’s has done is a tyrannical administration and should be viewed as such by any true conservative. It may seem difficult to imagine, but twenty years from now websites like Newsslinger and others that present points of view unwelcome to the ruler in the White House may be flushed down the memory hole and replaced by yet another site detailing the exploits of Miley Cyrus or Justin Bieber or any other person sufficiently shiny to distract the citizenry from the fact of an omnipresent dictatorship.


     It will be interesting to see where our country stands in 2015 on the Press Freedom Index. I, for one, will be paying attention.

Tom Brokaw, NBC special correspondent and former “NBC Nightly News” anchor, has announced that he has been diagnosed with multiple myeloma, a cancer of blood cells in the bone marrow. Multiple myeloma is a cancer that strikes white blood cells in the bone marrow called plasma cells. Plasma cells normally produce antibodies to help fight infection, but in multiple myeloma, an over-abundance of malignant plasma cells causes a release of unhealthy levels of a protein into the bones and blood. This in turn can cause damage to bone tissue and organs. There is no known cure for multiple myeloma, but treatments are available that slow its progression, according to the medical website WebMD.com. He was diagnosed back in August of last year at the Mayo Clinic, and has been quietly undergoing treatments, including while filming the special 2-hour JFK assassination anniversary documentary in November and media coverage of the 2014 winter Olympics in Sochi. He says that he and his doctors are optimistic in his outlook and encouraged by the obviously astounding progress the veteran reporter is making. “With the exceptional support of my family, medical team and friends, I am very optimistic about the future and look forward to continuing my life, my work and adventures still to come,” Brokaw said in a statement. ”I remain the luckiest guy I know. I am very grateful for the interest in my condition but I also hope everyone understands I wish to keep this a private matter.” Brokaw, 74, began his long career at NBC as a reporter in 1966. He then went on to host “The Today Show” from 1976-1981. He replaced John Chancellor at the helm of the “Nightly News” desk, first as co-anchor that year with Roger Mudd and then as sole anchor in September 1983, while the “CBS Evening News with Walter Cronkite” was still the top weeknight network newscast. But, “CBS Evening New with Walter Cronkite” soon relinquished the top spot. Brokaw and “Nightly News” moved to the top of the Nielsen ratings and lorded over Dan Rather and the “CBS Evening News”, as well as Peter Jennings and “ABC World News Tonight” through the end of Brokaw’s long run in 2004, when he handed the show over to Brian Williams. Brokaw has had some pretty impressive encounters and accomplishments throughout his years on the air. He anchored NBC Nightly News for 22 years, authored a bestselling book on “The Greatest Generation”, a work of history which he says is the work he is most proud of. He saw and reported on the fall of the Berlin Wall, and nabbed one of the first American interviews with Mikhail Gorbachev. He also served as White House correspondent during the Watergate scandal of the Richard Nixon administration. The man has seen it all in the last 48 years in American history and has brought so much to the world of televised broadcasting. I would join his colleagues, friends, and family in wishing him a safe, comfortable, and full recovery.

I’m no expert at political radiography, but I think I am seeing something novel in this X-ray I am holding. It’s a radiographic image of the GOP, and if you look closely, just behind the elephant’s skull, you can see the dimmest suggestion of a nascent backbone. What I am referring to is the non-binding resolution passed by the Republican National Committee on Friday, January 24th, 2014 at its winter meeting. This resolution, officially termed the “Resolution to Renounce the National Security Agency’s Surveillance Program,” gives me tremendous hope not only for the future of the Republican Party but also the future of our magnificent country. For the first time, the RNC denounced the President’s unconstitutional NSA surveillance program and called on Republicans to establish a special committee to ascertain the full breadth and depth of domestic spying and hold accountable those individuals who are responsible for it. The resolution begins by describing how the surveillance program Prism works. As we should all know by now, Prism records the metadata associated with Americans’ phone calls and monitors their Internet use. Metadata is, of course, all the information associated with a phone call other than its content: who called, who was called, where and when the call happened, and the length of the call. The resolution correctly states that this collection of metadata is both a violation of the right of free speech as expressed in the 1st Amendment and the right of privacy expressed in the 4th amendment. Having established the essential unconstitutionality of the Prism program, the resolution goes on to explain that the program exists because it relies on an “unbounded interpretation” of a particular section of the Patriot Act, Section 215. Section 215 permits the government to collect “tangible things” – yes, that’s really the noun used – via the use of secret court orders. Section 215 is the legal loophole the federal government uses to justify its collection of metadata and Internet users’ browsing habits. So the resolution exhorts Republican lawmakers to “enact legislation to amend Section 215 of the USA Patriot Act” in order to “make it clear that the blanket surveillance of the Internet activity, phone records, and correspondence – electronic, physical, and otherwise – of any person residing in the US is prohibited by law.” Also targeted for amendment by the resolution are the state secrets privilege and the infamous FISA Amendments Act of 2008. The state secrets privilege is a nasty little law that permits the federal government to withhold from legal proceedings any evidence that might threaten national security. The FISA Amendments Act of 2008 (extended for another five years in 2012), largely minimized the role of the FISA court in overseeing electronic surveillance; that is, it reduced the court to little more than a rubber stamp used to give legitimacy to blatantly unconstitutional acts by the federal government. It remains to be seen what Republican apologists for big government like Chris Christie and Karl Rove think about the RNC’s non-binding resolution. Perhaps they are remaining silent in light of the fact that it was “passed by an ‘overwhelming majority’ by voice vote,” according to Time Magazine, or because “no RNC member rose to speak against the resolution.” Real conservatives know on what side their bread is buttered. For several months now I have been howling in the pages of Newsslinger that the GOP would be well-served by refocusing its brand on the traditional tenets of American conservatism: small government, privacy, and opposition to foreign entanglements including military adventurism. It appears that the RNC is in at least partial agreement with me, and just in time: domestic spying will be a huge issue in the next two elections and probably for some time after that. Republicans are wise to be getting their ducks in a row now when it comes to messaging about the NSA. When the average American voter automatically equates a vote for the GOP with a vote against Big Brother, we will have done our job of messaging very well indeed. The electorate needs to understand that a choice between the Republicans and the Democrats is a clear choice between a party that is united in its defense of the Bill of Rights and a party that is not. As for the Republicans who are yet too timid to denounce Prism and champion the kinds of reforms outlined today’s RNC resolution, their days are numbered anyway. The conservative electorate is tired of candidates like John McCain and Mitt Romney whose actions on the campaign trail remind me of an old Marx Brothers joke: “Those are my principles, and if you don’t like them… well, I have others.” Consider these statistics: in a December 2013 Washington Post poll, 48% of conservatives said that they were “very concerned” about the collection of metadata by the NSA, and another 29% were “somewhat concerned. For you math whizzes out there, that’s 77% of all conservatives, not including another 12% who are “not too concerned.” Privacy is important to conservatives these days. Opposition to the NSA could be the glue that unites the warring factions of the Grand Old Party. I would like to personally congratulate chairman Reince Priebus and the rest of the Republican National Committee on taking a brave stand against King Barack Obama and his cynical supporters. This country survived the Civil War. It survived the Nazis. It survived hair metal. We will survive the reign of Barack Obama and someday the constitutional principles upon which this country was founded will again be the law of the land and not just wise words to be quoted by law professors. I hold in my hands an X-ray depicting the GOP’s emerging spinal fortitude. What could be next? Impeachment, anyone?

The word “racist” is being tossed around again, but don’t worry, I don’t think we’ll have to endure weeks of subsequent outcry from the likes of Jesse Jackson. This time the accusation is aimed at Japanese airline, All Nippon Airways, for impersonating a white man. The 30-second commercial features two popular Japanese comedians discussing the “exciting” new offerings of the airline, when one of them says, “You want a hug?”. The other one looks taken aback, to which the first one responds “such a Japanese reaction.”, and suggests they change the image of Japan. Then it gets hairy. Literally. When the camera pans back to the other, he is wearing a blonde wig and plastic nose, presumably to look caucasian. It’s not that funny, but yet, not offensive, at all, to me. Really. Not even a little bit. However, my sentiments aren’t everyone’s apparently, and after getting some grief from Americans and some Japanese whose feelings were hurt, like Angela Fukutome who posted this on the All Nippon Airways (ANA) Facebook page, “I’ve just seen the new ANA advert…Really? ANA think this is OK?!”, the commercial was pulled. An ANA spokeswoman acknowledged the carrier “has received calls from customers, mostly foreigners, complaining about the ad. “We apologized to each of the customers for having caused uncomfortable feelings and also thanked them for bringing up the issue,” she said. Now, once again, apologies fill the air, with the airline making a statement, “The commercial was intended to be a humorous way of highlighting the increased number of international services ANA is operating from Haneda Airport. It was not our intention to cause offence and we apologize to anyone who was upset by the advertisement,” ANA spokesman Ryosei Nomura said. They also said, “But we have received opinions different from the message that we wished to convey. We will modify part of the advertisement and will release the second version soon.” They wanted to clarify that the company wanted to express the importance of the planned expansion of international services from Haneda and to call on Japanese to go out to see the world. I don’t know about you, but I have many bigger fish on the “offensive” plate right now that to worry about this. I’m talking to you, Governor Cuomo. I mean, really! We are apparently totally welcome in Japan, at least. A world where we can’t laugh at ourselves and each other a little bit every now and then is a world I don’t want to live in! When we were children, this wasn’t so hard. We all made fun of each other, and accepted it in turn. At the end of the day, we were all still friends. I’m not suggesting we be harsh and ridicule, or put each other down about everything, but to be able to take a joke is a virtue right up there with patience, kindness, and meekness in my book. How much time have we wasted throwing fits about stuff like this, when the stuff we should be throwing a fit about slides by unchallenged? What do you think, offensive or silly and forgettable?

The GOP should forget about Chris Christie and his heap of troubles. Ladies and gentlemen of the Republican Party, I give you your 2016 Presidential candidate: Senator Rand Paul.

     Regular readers of Newsslinger know that I am convinced that the path to victory for Republicans in the midterms this year as well as in the general election in 2016 is to champion the core values that defined American conservatism for much of its existence, including favoring smaller government, a less bellicose foreign policy, and the protection of privacy for American citizens.

     The Republican establishment, of course, wants none of these. Any candidate of which both Karl Rove and the Chamber of Commerce approve is guaranteed to prefer the same kind of policies we saw during the W. years, which meant more wars, a larger federal government, and fewer privacy rights. In other words, they are sure to demand policies very similar to those favored by the Democratic party. A GOP presidential candidate who is largely indistinguishable from the Democratic presidential candidate in is doomed to lose the election. Witness McCain 2008, Romney 2012, and so on.  Why would Americans want a watered-down version of a war-mongering, Bill of Rights-shredding, Big Brother-loving Democratic president when they can have the real thing?

    Here is Governor Christie on civil liberties back in July of 2013, following a House vote that only  narrowly prevented a reduction in funding for the NSA’ phone records collection program:

     “As a former prosecutor who was appointed by President George W. Bush on Sept. 10, 2001, I just want us to be really cautious, because this strain of libertarianism that’s going through both parties right now and making big headlines, I think, is a very dangerous thought.”

     Christie followed up by rejecting debates concerning the proper balance between national security and privacy as being “esoteric” and specifically criticizing Rand Paul and others who are concerned about American constitutional liberties.

     On the other hand, today, January 17th, 2014, Kentucky Senator Rand Paul appeared on CNN to discuss Obama’s earlier speech about the NSA. The president proposed tepid reforms to the existing NSA surveillance system such as requiring that metadata be stored by an entity other than the US government (meaning the private sector, of course) and that a panel of “independent advocates” be included on the secret FISA court to share a different perspective when “significant cases” are involved. Rand Paul expressed his disappointment with the President’s proposals and correctly pointed out that they amount to “the same unconstitutional program with a new configuration.”

     The difference between the two wings of the Republican party could not be starker. New York Representative Peter King stated that Paul had “done a real national disservice by treating the NSA as an enemy.”

     I would argue that Peter King and President Obama have done a real national disservice by treating the American citizens like so many subjects. Rand Paul reminded the eternally wide-eyed and benevolently clueless Wolf Blitzer that one of the catalysts for the Revolutionary War was colonial outrage over the general warrants employed by the British in searching the homes and papers of American colonists,  and how the desire to prevent future abuse of this sort led to the Founding Fathers’ establishment of the 4th Amendment in the Bill of Rights.

     We have yet to hear what Governor Christie thinks about the President’s proposals. Here is something else he said back in 2013 following the Snowden disclosures:
