Not surprisingly, HHS rules that health plans that do not provide hospital benefits will not meet "minimum value" under the ACA.  This ruling will be particularly acute in the retail, restaurant and hospitality industries, among others.  There are solutions to meet the ACA requirements (and HHS ruling) that can be optimized for the aforementioned industries.  VisitCook Group Solutions to explore alternatives.  A health plan without hospital benefits is "is not a health plan in any meaningful sense," the Department of Health and Human Services announced in a final rule last week.

While nearly impossible to predict the results of a repeal and replace Obamacare strategy, it will take time, ensuring that the final features of any "replace" legislation will be highly negotiated. As such, replacement legislation will take time before being implemented.

Excellent summary for companies considering the switch from fully-insured to self-insured health benefit plans.  The article highlights some issues to consider, which "include whether prescription drugs are included, guaranteed renewals, renewal rate caps and the evaluation of “aggregating spec” options." With the exception of prescription drugs (which should always be included in the stop-loss insurance premium), these are usually issues for larger employers to consider as they are generally cost prohibitive on a per employee per month (PEPM) basis for smaller employers.
