Amendments

The amendments that I used were the 1st, 8th, 4th,and the 19th. The first amendment is the freedom of religion, speech, and the press, as well as the right to assemble and petition the government. The 8th amendment probhibits excessive fines and excessive bail, as well as cruel and unusual punishement. The 4th amendment prohibits unreasonable searches and seizures and sets out requirnments for search warrents based on probable cause. The 19th amendment establishes women's suffrage.

Analysis: This issue realtes with the fourth amendment. A teenage kid was walking when a police officer came over to him and demanded he emptied his pockets without there being any suspicion. Sure enough, there was a small bag of weed in his pocket so the officer arrested him. This was not fair to the kid though because his rights were violated. That cop had no reason or warrent to search him. In my opinion, the kid did get arrested but a cop should not do that to a teenage kid who most likely does not know his rights.

Questionable police practices on minor possession charges merit deeper scrutiny.

This article relates to the 19th amendment, women's suffrage. One hundred years ago in Oct. 1911 women won the right to vote. On October 10th history was made in California for all women. Before women won this right it was very unconstitutional to not let the women vote. It doesn't make any sense why women were not allowed to vote. In my opinion, there was no reason why women could not vote. I think that men thought they were higher because they were stronger.

In October 1911, California women, in a statewide special election, won the right to vote. Two Bancroft Library exhibits are tied to the centennial.

Analysis: This article is about a 13 year old boy that rapes an older woman and is now sentenced to life in prison. This relates to the 8th amendment because this is cruel and unusual punishment. It is unconstitutional because yes, they guy should receive a long sentence in prison but defiantly not life. The judge should also consider that when he did the crime he was only a ked and all kids make mistakes. I personally believe that he should be released from jail because he is now 33 years old and has spent 20 years in prison and probably regrets what he did. Also, it’s not like he killed anyone.

 

The Supreme Court has been asked to decide if a life sentence for a teenager violates the Constitution.

Analysis: Inmates in jail are having the 8th amendment violated. The 8th amendment is "Prohibits excessive fines and excessive bail, as well as cruel and unusual punishment." These inmates are going through cruel punishment by waiting for years or even decades until they find out whether or not they will be executed in jail. This act is unconstitutional because although they did a horrible crime, they should have to wait and stress for years not knowing if they will be killed.

 

Some ask whether it is cruel and unusual punishment for a death row inmate to wait years, or even decades, before the sentence is carried out.

Analysis: This article relates to the fourth amendment, prohibits unreasonable searches and seizures and sets out requirnments for search warrents based on probable cause. A man in Staten Island waas walking when a police officer tackled him and searched him for drugs. When the officer found nothing he got annoyed that the man was questioning his search son the officer arrested him. This is very unconstitutional because the man did nothing wrong. All he wanted to know was why he was getting searched. In my opinion, the man should be able to sue the officer for searching him without a warrent, let alone proabable cause.

The case of a white New York City police officer charged with violating the civil rights of a black man provides good reason to investigate the police force.

Analysis: This article establishes the 19th amendment which deals with women's suffrage. Saudi Arabian women are treated horribly and their men conrtol their life. The women's rights are being threatened because their husbands and fathers tell them weather they can travel, work, recieve health care, attend school, or start a business. They are also banned from driving. This is not fair for the women because women in America are treated with respect and are equal to men. This is very unconstitutional because no one should have to be controlled by anybody. What have those men in Saudi Arabia done with their life thats so great that they have the right to control their women?

 

King Abdullah’s decision to give women the right to vote is a first step toward moving his country into the modern world, but it is not nearly enough.

Analysis: This article is about gay marriage which relates to the first amendment. The first amendment states that a person has a right to freedom of religion. If people have a problem with gay marriage then the person's rights are being violated. I personally don't believe in gay marriage, but everyone has the right to be happy and if thats what makes them happy, then people just need to get over the fact that they are gay and getting married.

Analysis: Groups of people are using the first amendment by protesting in the streets. They are not causing any damage to the community, they are simply just holding up signs and protesting. Police arrested over 50 people in the streets for protesting. I think that they should be allowed to protest because freedom of speech is part of the first amendment. By police arresting them they are violating there personal rights.
