Mason family who faked life insurance policies, bought Bentley, pleads guilty

Mason family who faked life insurance policies, bought Bentley, pleads guilty | Life Insurance | Scoop.it
Mason family who faked life insurance policies, bought Bentley convertible, pleads guilty Cincinnati Enquirer Published 9:36 p.m. UTC Jul 19, 2018 The Stevensons used $284,000, prosecutors said, as a down payment on a land contract on a home in the Mason, Ohio subdivision of Hampton Bay. The Enquirer/Keith BieryGolick A woman, her husband and daughter have admitted conspiring to launder nearly $3 million in proceeds from fraudulent life insurance policies they bought for a relative who had severe medical conditions, officials said. Patricia Stevenson, 57, and her daughter, Candace Stevenson, 30, pleaded guilty Thursday in federal court in Columbus to money laundering conspiracy. Stevenson's husband, Mitch, 53, pleaded guilty last month. The family lives in Mason, officials said. In 2009, according to court documents, Mitch Stevenson bought two life insurance policies on the relative, who is not named in court documents. The life insurance policy applications falsely stated that the relative was healthy, weighed 170 pounds and had an annual income of $133,000, the documents say. In fact, according to prosecutors, the relative was sick, weighed nearly 400 pounds and was unemployed. More: Feds: Mason family faked life insurance policies, collected $2.9 million and bought Bentley convertible When the relative died Jan. 9, 2012, court documents say West Coast Life Insurance Company issued a $1.5 million check to Patricia Stevenson and a $1.4 million check to Candace Stevenson. An obituary from January 2012 says Mitch Stevenson’s sister died on that day. At Mitch Stevenson's direction, his wife and daughter opened eight different bank accounts to try to hide the source of the money, prosecutors said. "The defendants engaged in a complex sequence of transactions designed to conceal and disguise the ownership of the proceeds of the life-insurance fraud," U.S. Attorney Benjamin Glassman said in a statement. Also according to court documents, the family members bought a 2012 Bentley GT Convertible for approximately $247,000 and used $284,000 as a down payment on a land contract on a home in Mason. Other transactions included about $16,000 to World of Decor and nearly $33,000 to Facet Jewelry. As part of the plea, the Stevensons have agreed to repay the $2.9 million to the insurance company and forfeit the Mason home. Money laundering conspiracy is punishable by up to 20 years in prison. A sentencing date has not been scheduled, officials said. Documents also show that Mitch and Patricia Stevenson and their two sons, were involved in a $428,000 scheme surrounding the purchase and sale of scrap metal. Mitch Stevenson operated Lego Demolition out of the family’s home. Sears Canada Pensioners Dispute Dividends to Lampert's ESL

Sears Canada Pensioners Dispute Dividends to Lampert's ESL | Life Insurance | Scoop.it
Sears Canada creditors are calling $3 billion in dividends into question, prompting Eddie Lampert, a controlling shareholder to defend payments his ESL Investments hedge fund received. The Wall Street Journal has reported that a group of retirees from Sears Canada filed court documents on Friday seeking the appointment of a trustee in the retailer’s bankruptcy dealings. The goal is to claw back dividends paid to shareholders, a large portion of which went to businesses related to Lampert. The plaintiffs are arguing that these special payments, made over a decade, undermined the retailer’s operations. Lampert, who is the CEO of Sears Holdings in the U.S., held a 45 percent stake in Sears Canada through ESL after it was spun off in 2013. The retailer filed for bankruptcy protection in June and opted for liquidation in October. The group estimates they’re owed $270 million from their pension and $400 million in health and life insurance benefits. The concern is that once secured lenders are paid off in the bankruptcy proceedings, there may be nothing left for them. In a blog post published on Sunday, Lampert sought to clear up the “distorted narrative” in the press regarding Sears Canada’s decline and the dividend payments at issue. He said ultimately Sears Canada failed due to an unsuccessful “aggressive” operating strategy, which Lampert said he expressed concerns about at the time. Further, Lampert said the roughly $500 million in dividends that the company paid shareholders following real estate sales in 2012 and 2013 did not drain the coffers. Even after the dividends, he said Sears Canada had an equal sum left to fund operations. He illustrates his point by noting the retailer was able to continue to invest in the business and make required pension plan contributions though 2016. Finally, Lampert said the pension plan should be able to meet its obligations, saying reports to the contrary are due to confusing two different obligations and misestimating interest rates affecting the plan. “I too very much regret the failure of Sears Canada. Like all other stakeholders, ESL has suffered significant losses from the bankruptcy of this storied company – shareholders collectively lost over C$1 billion since 2012, even taking into account the dividends received,” he wrote.

Utah woman found guilty of trying to hire hit man charged with same crime for third time

Utah woman found guilty of trying to hire hit man charged with same crime for third time | Life Insurance | Scoop.it
A Utah woman on trial for trying to hire a hit man to kill her ex-husband was charged for the third time with attempting to get someone to kill more of her enemies, reports said. Linda Tracy Gillman, 70, was charged Friday with trying to hire a hit man about three weeks ago, KSL reported. The charges came the same day a jury found her guilty on one count of criminal solicitation for attempting to hire a man, who also rents a condominium from her, to “arrange to have her ex-husband, Mr. [Duane] Gillman, killed” last year, according to charging documents. Gillman paid the man $5,000 to have her ex-husband and his current wife killed, KSL reported. She allegedly promised to give the man $100,000 once the two people were dead and she was able to collect her ex-husband’s life insurance. MAN CHARGED IN DROWNING DEATH OF TRANSGENDER WOMAN WILL AVOID TRIAL She was ultimately caught when the man she attempted to hire went to police. Gillman had allegedly planned for the man to ask a third individual to murder her ex-husband and stage it as a drug overdose. Gillman was charged with two counts of criminal solicitation in that incident. The 70-year-old, however, didn’t let that deter her from attempting to wipe out all her enemies. While in jail, Gillman allegedly tried to get another inmate to murder the man who she initially hired to kill her ex-husband. "Gillman referred to herself as 'the bank,' and said that she 'could make everything happen,'" according to the charging documents. Gillman allegedly said she would be a “free woman” if the man was killed, adding that "it would make all her dreams come true." COUPLE ARRESTED IN FLORIDA DISMEMBERMENT TIED TO SOUTH CAROLINA TRIPLE HOMICIDE: SHERIFF She was charged with attempted obstruction of justice, but her case was dismissed because of problems with the witnesses. In her latest attempt to hire a hit man, Gillman wanted a witness and an attorney killed. Authorities thwarted her plot when they caught Gillman attempting to send another $155,000 in a check. "She had lined up an individual who would take the witness out. And in addition, asked to have an attorney killed in an opposing civil action against her that she had lost," the district attorney said on Friday, according to KSL. Gillman was charged Friday with two counts of criminal solicitation and two counts of obstructing justice. Katherine Lam is a breaking and trending news digital producer for Fox News.
