Camerons is shutting down part of its facilities services arrangement with Integreon, becoming the latest in a growing number of UK firms to change elements of its relationship with the outsourcing provider.

It is hard to know where to start on this story, as there are multiple angles to come at it from.

 

1. For anyone looking to say that the LPO industry is in rewind, has had its day, has failed, etc. they were always going to be waiting for a story like this. But they need to read beyond the headlines to see exactly what is happening.

 

2. For anyone in the LPO space it is a clear reminder that the value of outsourcing is in specialisation. By definition, that means selecting a handful of areas that you want to be world class in, and sticking to them. When I saw the list of activities that Integreon was trying to do at CMS and Osborne Clarke, I really questioned who on earth advised those firms that one organisation could be so good at so many things. LPOs need to know their core zone and stick to it, plane and simple.

 

3. Multi year strategic outsourcing deals are complicated. What you think will work sometimes doesn't work, but typically 80-90% goes exactly as planned. The remainder causes pain and sometimes it is right to get another supplier or to bring work back in house. This is actually very common and pretty healthy. Anyone with these kind of deals should always be thinking about where to draw and redraw the line. It happens in other sectors so it will happen in LPO.

 

4. Did anyone notice that the law firms are NOT bringing the work back in house? They are fully supportive of the model of outsourcing and specialisation, just that maybe Integreon wasn't the right pick for a few services. Someone else will be, and it won't be the law firm.

While being flattered about being mentioned in this recording, I should not let vanity get in the way of substance. 

 

The facts are that LPOs ARE taking work from law firms. "Stealing" is not the word I would use, but the net flow is work that was being sourced from law firms that is now being sourced from LPOs.

 

That work WILL NOT go back to law firms again.

 

This highlights many issues. The greatest is the "stealth" nature of it. Few firms are being really hurt by this trend...for now. But if a firm is unable to deal with new competitors at this level, how will it deal with any future change or deregulation of legal markets.

 

But wait! That is happening already in the UK. And in the US even new arrival firms like Axiom are proving that there is an opportunity to reinvent the traditional model, without any regulatory changes taking place.

 

Getting your firm nimble and agile should be the number one priority. Change and competition are going to grow. There will be no excuses - few professions have had the advance notification of change that law has had.

Applications are headed for a 30-year low, reflecting increased concern over soaring tuition, crushing student debt and diminishing prospects of lucrative employment upon graduation.

To start with, it is worth noting the "education bubble" that led so many universities to expand at the peak of the market, assuming every growing demand at ever rising fees. Clearly it has popped for law, and I'd be surprised if it does not pop in other all areas, save for subjects like Medicine.

 

Within the legal profession the report really shows the shrinkage in demand for law graduates. Maybe that is a natural resetting from a period of over-supply, but that would not be the case if the profession was even as good as being stagnant in terms of demand and volumes.

 

The real question is whether this is a permanent shift or a temporary shift caused by the economic drift we are dealing with, but exacerbated by non-law firm options for delivering services. In a world of 30% growth for LPO/Legal Outsourcing that leakage needs to be made up by a lot of economic growth before it even balances out.

 

In the mean time, law firms should plan around the only foreseeable certainty - a zero or low growth economy for 2+ years more with clients increasingly sending transactional work to cheaper, more effective delivery models. Note, that those can be internally run by law firms or fully outsourced. The firm just has to decide which will give it the right competitive advantage.

This is only part of the story and, sadly, misses the global aspect. Change is happening in the legal market across the globe but in particular in the major English-speaking nations. This story could have been as much about London and the UK as the US.

 

The tough news is the ongoing legal fee pressure due to the economy and a more informed/aware buyer population. The other element is just the change in how law can be delivered. The legal market has been innovating in the last 5+ years in a way that has never happened before. As ever, the larger law firms - like the larger corporates - have been caught napping. Well, napping with blindfolds and earplugs. It is not too late to change the firms, but the market has changed forever.
