Congressman Darrell Issa and his wife Kathy live in Vista, CA. "They have one son, William, and celebrated their 30th wedding anniversary in 2010. As a senior in high school, Issa enlisted in the United States Army. Through his Army service, he received an ROTC scholarship and graduated with a degree in business from Sienna Heights University in Adrian, Michigan. Upon graduation, Issa was commissioned as an Army officer, and ultimately obtained the rank of captain. He completed his active-duty military service in 1980 and turned his interests to the private sector."

BERNARD B. KERIK is one of the most dynamic, undisputed, controversial and accomplished leaders in law enforcement, correction, and national security in the United States. For more than thirty years, he served his country with distinction, honor, and valor, most notably as the 40th Police Commissioner of the City of New York. A Just Cause believes that Bernard Kerik deserves a second chance and that he still has something to give to our country.  A Just Cause further believes that Bernard Kerik has a unique perspective of being the jailer as well as the jailed -- his experiences give him a unique perspective that would tremendously benefit reform at the Federal Bureau of Prisons.  For this reason, A Just Cause would like President Obama to grant Bernard Kerik a pardon and consider him for the Director of the Federal Bureau of Prisons.

EXCERPTS OF BERNARD KERIK'S BIO BELOW...

For close to six years, Mr. Kerik served as First Deputy and later Commissioner of the New York City Department of Correction. He was responsible for overseeing the New York City jail system, including Rikers Island, one of the largest and most violent jail systems in the country. Under his command, the department achieved historic reductions in inmate-on-inmate violence, and earned international recognition for violence reduction, efficiency, accountability, and correctional excellence.

In August 2000, Mr. Kerik was appointed the 40th Police Commissioner of the City of New York, responsible for 55,000 civilian and uniform personnel, and a $3.2 billion budget. His term was marked by dramatic reductions in crime, enhanced community relations, and his unflinching leadership and oversight, as he led New York City through the devastating attacks on the World Trade Center on 9/11, overseeing the rescue, recovery and investigation. In 2001, he was one of the founding members of the Board of Trustees of the Twin Towers Fund, which raised and distributed $216 million to over 600 families related the emergency service workers killed on 9/11.

After retiring from the NYPD, and following the fall of Saddam Hussein, Mr. Kerik accepted a request by the White House to lead Iraq's provisional government's efforts to reconstitute the Iraqi Interior Ministry, which consisted of its national police service and intelligence, customs and immigration, and border police. He subsequently served as a national security advisor to His Majesty King Abdullah II of Jordan and President Bharrat Jagdeo of the Republic of Guyana. Mr. Kerik has conducted threat and vulnerability assessments for other heads of state, and led crime reduction, national security, and management accountability assessments for the U.S. Justice Department, Trinidad and Tobago as well as Mexico City.

Considered one of the most decorated police commissioners in the New York City Police Department, in the line of duty, he has rescued people from burning buildings, been stabbed, shot at, and saved his partner who had been wounded in a gun battle. He survived the terror attacks on 9/11, and a bombing plot in Iraq. He has been the target of numerous death threats, seized tons of cocaine and millions in drugs proceeds from the Cali Cartel, and brought cop killers, Colombian drug lords and Iraqi terrorists to justice.

His service to his country has been recognized in more than 100 awards for public and heroic service, including the New York City Police Department's Medal for Valor, plus 29 other medals for excellent and meritorious service. He has been commended for heroism by President Ronald Reagan, and has also received the DEA Administrator's Award from the U.S. Justice Department, two Distinguished Service Awards from the U.S. Department of Homeland Security, The Ellis Island Medal of Honor, and an appointment as Honorary Commander of the Most Excellent Order of the British Empire by Her Majesty Queen Elizabeth II. He has served on the Terrorism Committee of the International Association of Chiefs of Police (IACP), the Criminal Justice Advisory Council of St. John's University in New York City, and the Academe and Policy Research, and Emergency Response Senior Advisory Committees for the U.S. Department of Homeland Security.

On December 3, 2004, President George W. Bush nominated Mr. Kerik as Secretary of the U.S. Department of Homeland Security. One week later, Mr. Kerik withdrew his name from consideration, after admitting that he failed to pay payroll tax for his children's nanny.

Five years of state and federal investigations followed. Mr. Kerik pled guilty to false statements and tax charges primarily relating to his children’s nanny and discounted apartment renovations. He was sentenced to 48 months in federal prison. He surrendered to the U.S. Federal Bureau of Prisons at a minimum-security prison camp in Cumberland, Maryland on May 17, 2010, and was released from custody on October 15, 2013.

I learned that the deprivation of freedom is far more profound than one can imagine, and that going to prison is like dying with your eyes open. Press Release issued Jun 2, 2016: Federal prosecutor Matthew T. Kirsch prosecuted and convicted six information technology executives of the IRP Solutions Corporation on allegations that they were involved in a two-and-a-half-year scheme to induce staffing companies into paying employees they outsourced to IRP. IRP Solutions developed CILC (pronounced "silk") criminal investigations software, and according to court documents, the Department of Homeland Security requested and received a quote for over $100 million dollars for CILC. "Although the primary charge was that the defendants misrepresented their success and prospects to certain staffing companies, the case was presented to the jury on the basis that their software was a phony and a scam," says former federal appeals Judge H. Lee Sarokin, and that "defies reality." Sarokin characterizes the case as "strange" and questions why Kirsch disregarded numerous facts that indicate the executives could not possibly have been involved in criminal activity. One of which was why the IRP executives, in the middle of a criminal scheme as alleged by Kirsch, contacted the head of the Denver division of the FBI to recruit federal agents to come work for their company. "Criminals avoid law enforcement at all costs, not recruit them to come work for them," says Lisa Stewart of A Just Cause.

DOJ Prosecutors Are Failing Obama, Scalia & Constitution, Says Advocacy Group, A Just CauseA Just Cause Urges Obama to Take Clemency Process From DOJ Pardon Office

DENVER, CO–(Marketwired – February 23, 2016) – According to the New York Times, pardon attorney Deborah Leff, an Obama appointee, abruptly resigned on January 15, 2016, leaving more than 10,000 clemency applications pending review. The Times reported that the pardon office is caught in an “incurable institutional conflict” because federal prosecutors have little interest in supporting the clemency process. A former pardon attorney told the Times that DOJ prosecutors are “determinedly and irreconcilably hostile” towards clemency.

“Hostile to clemency is hostile to the Constitution,” says Lamont Banks, Executive Director of A Just Cause. “Article II of the U.S. Constitution gives the President sole power to grant reprieves and pardons for offenses against the United States,” adds Banks, “Given the incessant delays in prosecuting clemency applications and hostility towards the Constitution by federal prosecutors, we are asking President Obama to move the clemency process to the White House or to an independent commission,” says Banks.

The United States Supreme Court has called clemency a “historic remedy for preventing miscarriages of justice” and the “fail safe” in the United States criminal justice system. “Reversal of an erroneous conviction… or the pardoning of an innocent condemnee through executive clemency demonstrates not a failure of the system but its success,” Scalia said in the 2006 Kansas v. Marsh case.

According to the National Registry of Exonerations, which was updated this month, a record 149 convicted defendants were exonerated last year in 29 states and other U.S. jurisdictions. “One mistake is too many, a miscarriage of justice for the person wrongly incarcerated,” said former U.S. Attorney General Roberto Gonzales in a USA Today op-ed. Gonzales also said that law enforcement and prosecutorial misconduct are factors in some wrongful convictions.

“Our criminal justice system is far from perfect as witnessed by a record number of exonerations,” says Cliff Stewart, A Just Cause. “Prosecutors should embrace the opportunity to right wrongs through clemency instead of circling the wagons to uphold wrongful-convictions and oppressive sentences,” adds Stewart. “The IRP6’s clemency application has been pending for over a year now,” exclaims Stewart.

In the past couple of months, former federal judge H. Lee Sarokin of the 3rd U.S. Circuit Court of Appeals sent a letter to President Obama on behalf of the IRP6, who have spent over three and a half years in prison on a wrongful-conviction. After reviewing court records, Sarokin wrote extensively about the IRP6 case in his blog on the Huffington Post, concluding that the six information technology executives are not only innocent, but were wrongly-convicted and imprisoned for a “failure to pay corporate debts.” In the letter to Obama, Sarokin addressed constitutional violations and harsh sentences of 7 to 11 years that the government and courts were unwilling to address. Justice Kennedy said in 2004 that “Clemency power can correct injustices that the ordinary criminal process seems unable or unwilling to consider.”

“Like President Obama and Justice Scalia, A Just Cause is committed to the Constitution and clemency for correcting wrongful-convictions,” says Banks. “A dysfunctional clemency process is an anathema to the Constitution and destructive to the cause of justice,” adds Banks. “If prosecutors are conflicted about their constitutional duty and are unwilling to support President Obama in pardoning of the innocent, they should be removed from the process altogether,” concludes Banks.
