Further complicating the process is that OSHA makes a distinction between hazard and risk of a chemical. Hazard is the inherent nature of the chemical and its properties. Risk pertains to conditions of storage, transport and use and consequent damage. UN GHS has reclassified chemicals into various categories with the result that simply transplanting data from MSDS into SDS is not a simple task anymore. The first thing to do is to find out the nature of hazard of the chemical and the category in which it falls. This is not easy, especially when formulations are involved. The aspects to consider are toxicology, fire risks, health hazards, physical hazards and safety hazards. A chemical, by its nature, may be hazardous on its own. Mixed with others in a formulation, the hazard may be elevated or it may be reduced. How does one decide?

The GHS label format has six elements comprising of product identifier, supplier information, signal word, pictogram, hazard statement and precautionary statement. There is a set of pictograms from which one is to be chosen and this is determined by classification and categorization of a chemical. This also influences the signal words used and the hazard statement. Change is a difficult process and transitioning to the new GHS labelling system is even more so because of the confusion the numbering system creates. Under the good old NFPA or HMIS system, the higher the number the greater the hazard level it indicated. In GHS it is the other way around. Lower numbers denote higher hazard factor.

Not always the proper shipping names ending with “n.o.s.” require the addition of technical names on hazardous materials. According to 49 CFR 172.101(b)(4), technical names are only required to be added when a “G” symbol is noted in Column 1 that is associated with a generic shipping name in Column 2 of the DOT Hazardous Materials Table. Therefore, the technical name must entered in pertness on shipping papers and transport marking labels. Since not all “n.o.s.” names in the table have a “G” symbol then those without “G” symbol do not require the addition of technical name and only those shipping name denoted with a “G” symbol must be supplemented with technical name.

The label may appear simple enough. It has 6 elements comprised of a signal word, a GHS symbol, the manufacturer’s information, precautionary statement, hazard statement and the product name. The GHS symbols or pictograms are standardized across international boundaries to give a precise visual clue about the risk. As for risk, the labels must indicate chemical, environmental and health risk. Primary containers must carry GHS compliant labels with all this information. Labels for secondary containers must also comply with GHS norms except in some cases such as when the material is used by a worker who transfers substances from main container to a secondary container and is present during its process or when the container remains in his possession or in the work area. The importance of labels cannot be minimized.

While both are tools to communicate hazards, there is an essential difference. CLP focuses on labeling and REACH specifies rules for the safety data sheets. REACH may apply to quantities above a specified limit whereas CLP applies regardless of quantities involved. REACH SDS registration is mandatory whereas CLP is not mandatory provided chemicals are REACH registered prior to November 2010. The situation can be complex and confusing. This is further compounded by the fact that REACH is more extensive as regards protection of human health and the environment. Chemicals must be categorized and described without any ambiguities in a lengthy process and documentation. HazCom specifies that employers and end users have responsibilities. They are required to maintain a written plan on handling and disposal of the substance and other measures, maintain a chemical inventory, make proper use of labels and warnings, update existing MSDS or create new SDS and train workers. ICSDS assists manufacturers and importers with drafting out a well written plan for the HCS program. The written plan covers daily hazards and defines requirement of SDS management, training and labeling. This written plan must be maintained at workplaces since inspectors will ask for it. The written plan also includes inventory of chemicals. ICSDS assists with creation of printed as well as electronic forms of the written plans and inventories for hazard communication. Support also extends to updating existing MSDS to SDS along with creation of the right safety labels and warnings that comply with HCS as well as with GHS norms.

OSHA updated the Hazard Communication standard in 2012 and it is mandatory for all manufacturers/dealers/distributors/exporters/importers of chemicals in the USA to update their existing MSDS to GHS SDS. In some cases this is a straightforward task of filling in the 16 sections of the SDS with appropriate data. In some cases, the task is not that simple because GHS may have put the chemical in an altogether different hazard category.
