Federal District Court Judge Shelly Dick halted the construction of the controversial Bayou Bridge Pipeline (BBP) across the Atchafalaya Basin. Today’s decision grants a preliminary injunction to prevent ongoing irreparable harm to this ecological treasure while a lawsuit, filed Jan. 11, is being heard.

Judge Dick found that the lawsuit filed by several groups—Atchafalaya Basinkeeper, the Louisiana Crawfish Producers Association (West), Gulf Restoration Network, Waterkeeper Alliance and Sierra Club, represented by lawyers with Earthjustice—raises serious concerns and that the 162-mile pipeline would irreparably harm the Atchafalaya Basin.

The groups recently presented live testimony during a hearing showing that the ancient cypress and tupelo trees slated to be turned into mulch while the pipeline right-of-way is being cleared would never return, including evidence that these old-growth trees are the Noah's Ark of the swamp—providing habitat for migratory birds, bears, bats and numerous other wildlife.

We are choking the planet in plastic. Everything from wasteful water bottles to grocery shopping bags are polluting our waterways, and endangering marine life and the natural environment. It’s fair to say that even the most casual news consumer has probably encountered a Facebook post, TV report, or radio segment about the garbage patches in the Pacific Ocean.

But what’s less well-known is what is fueling this plastics binge: fracking. As the Guardian recently reported, in less than a decade, tens of billions of dollars have been invested in creating new manufacturing sites around the world to turn fossil fuels into resin pellets used to manufacture plastic products. The companies profiting off this surge in plastics are contributing to a growing climate crisis while generating mountains of plastic garbage.

Lissa Lucas traveled the 100 miles from her home in Cairo, West Virginia to the state capitol in Charleston Friday to testify against an oil and gas industry sponsored bill (HB 4268) that would allow companies to drill on minority mineral owners’ land without their consent.

Lucas began to testify to the House Judiciary Committee, but a few minutes in, her microphone was turned off.

And Lucas was dragged out of the room.

Lucas is running for the House of Delegates from Ritchie County, which has been overrun by the fracking industry.

The first year of Donald Trump’s presidency has seen a measurable difference in the way the U.S. Environmental Protection Agency (EPA) has been holding polluters accountable compared to the past 25 years. Under Scott Pruitt, the EPA has collected, on average, 49 percent less in civil penalties against violators of federal environmental laws than in the first year of the previous three administrations, according to a new report from the nonprofit Environmental Integrity Project. “President Trump’s dismantling of the EPA means violators are less likely to be caught, making illegal pollution cheaper,” said Eric Schaeffer, executive director of the Environmental Integrity Project and former director of EPA’s Office of Civil Enforcement. “The president’s ‘law and order’ agenda apparently wasn’t intended for fossil fuel companies and other big polluters.”

Over the past year, oil and gas industry plans to build a petrochemical refining and storage hub along the Ohio River have steadily gained traction. Proponents hope this potential hub, which would straddle Pennsylvania, Ohio, West Virginia, and Kentucky, could someday rival the industrial corridor found along the Gulf Coast in Texas and Louisiana.

Those plans center around creating what is known as the Appalachian Storage Hub, which received a major boost on November 9 during a trade mission to China attended by President Donald Trump and U.S. Secretary of Commerce Wilbur Ross. At that trade mission, also attended by Chinese President Xi Jinping, the China Energy Investment Corp. announced the signing of a memorandum of understanding (MOU) to invest $83.7 billion into the planned storage hub over 20 years. For comparison, West Virginia's gross domestic product (GDP) in 2016 was $72.9 billion.

Though called the Appalachian Storage Hub as a broad-sweeping term, in practice the hub could encompass natural gas liquids storage, a market trading index center, a key pipeline feeding epicenter, and a petrochemical refinery row. Its prospective development has been spurred by the current construction of a $6 billion petrochemical refining facility in Pennsylvania owned by Shell Oil.
