In this paper, Philip Wallach explores the origins and implications of the administrative state's legitimacy crisis and offers a possible path toward overcoming it. He argues that both major camps fighting over the role of the administrative state (generally referred to as bureaucracy) fail to provide a viable means of securing effective and legitimate government.

He argues that both major camps fighting over the role of the administrative state fail to provide a viable means of securing effective and legitimate government. On one side are technocrats who largely deny the importance of current anger at the administrative state and are confident that people will be best served if our dysfunctional legislature allows experts in the executive branch to take the lead in providing for the public’s best interests. On the other side are populists urging a “Jeffersonian cleansing of our institutional stables meant to repudiate elite corruption, return America to its republican roots, and install citizen statesmen who will better serve the people through obedience to common sense and old-fashioned American morals.”


"Wallach explains the shortcomings of both the technocratic and Jeffersonian responses to America’s legitimacy problem. Technocrats believe that existing processes such as notice-and-comment rulemaking ensure adequate representation of all viewpoints, but such limited outreach on the agencies’ own terms fails to achieve broad democratic legitimacy. The administrative state’s critics see its legitimacy problems, but their solutions tend to require the election of a new citizenry. Far from offering a viable path to self-government, their insistence that the people can govern directly leads to further disappointments and cynicism."


"Wallach sketches the outlines of a realistic, workable middle way, in which statesmen lead with the guidance of experts and are made accountable to those parts of the public capable of meaningfully judging their results. This is a vision of republicanism consistent with the actual capabilities and engagement of our citizens, rather than one that depends on idealized notions of citizenship unlikely to be realized in contemporary America. It is characterized by compromise, intermediation, and incrementalism. And while he acknowledges that “our current political environment gives us plenty of reasons to be pessimistic about the chances of incremental reforms,” Wallach ultimately concludes “it should also make us realize why they are indispensable.”

Economists generally think that improving infrastructure would increase productivity and economic activity. However, neither the Democrats nor Trump have come to grips with how they would pay for their infrastructure plans without adding to the government’s budget deficit.

Trump’s advisers — commerce secretary nominee Wilbur Ross and trade adviser Peter Navarro — have argued that the tax-credit scheme would be revenue-neutral, something roundly criticized by economists across the political spectrum. Tax credits would provide windfalls to existing infrastructure plans. They would give incentives to new projects with tolls even if other priorities without revenue streams, such as maintenance, might be more urgent. And they would complicate a tax code that Trump has vowed to simplify

 Criada em 2010 de uma costela da mineradora Vale, hoje sua maior acionista, com 37,6% do capital, a companhia nasceu com dois objetivos. Dar independência e transparência aos ativos de infraestrutura da Vale - unindo ferrovias e terminais portuários que não eram estratégicos à logística da mineradora - e se tornar uma prestadora de serviços ferroportuários integrados, com ativos próprio e de terceiros.

SHAREHOLDER-OWNED FIRMS AND TECHNOLOGICAL ADVANCES

"[...] shareholder-owned firms (in the sense of ones listed on stock markets) are often not a source of technological advances. Bart Hobijn and Boyan Jovanovic have pointed out that most of the innovations associated with the IT revolution came from companies that didn’t exist (pdf) in the 70s. The stock market-listed firm is often not so much a generator of innovations as the exploiter of innovations that come from other institutional forms – not just private companies but the state (pdf) or just men tinkering in garages.[...] There are, of course, many possible reasons for this lack of investment. One might be that outside shareholders are so short-termist that they discourage firms from investing (though personally I doubt this). Alternatively, they might be too ill-informed to distinguish between good and bad projects and so often err on the side of caution. A third possibility is that both investors and bosses have wised up to a fact pointed out by William Nordhaus – that innovation yields only scant profits because these get competed away*.[DILLOW, 2017]

PORTARIA No - 266, DE 31 DE JANEIRO DE 2017 O MINISTRO DE ESTADO DA AGRICULTURA, PECUÁ RIA E ABASTECIMENTO, no uso das atribuições que lhe conferem o art. 87, parágrafo único, inciso II, da Constituição, tendo em vista o disposto do Decreto nº 24.114, de 12 de abril de 1934, no Decreto nº 5.741, de 30 de março de 2006, no Decreto nº 8.133, de 28 de outubro de 2013, na Lei nº 8.171, de 17 de janeiro de 1991, na Lei nº 12.873, de 24 de outubro de 2013, e o que consta do Processo nº 21000.062788/2016-93, resolve: Art. 1º Fica declarado estado de emergência fitossanitária relativo ao risco de surto da praga Helicoverpa armigera no Estado de Mato Grosso do Sul, para implementação do plano de supressão da praga e adoção de medidas emergenciais. Parágrafo único. As diretrizes e medidas a serem adotadas são as previstas na Portaria nº 1.109, de 6 de novembro de 2013, com as alterações introduzidas pela Portaria nº 1.177, de 23 de dezembro de 2014. Art. 2º Esta Portaria entra em vigor na data de sua publicação. BLAIRO MAGGI

A Portaria No 266 de 31/01/2017 que declara ESTADO DE EMERGÊNCIA diante de um surto da praga Helicoverpa armigera (ataca soja, algodão) no Estado de Mato Grosso do Sul (em breve pode ser em Barreiras), o que possibilita o recurso as  medidas aludidas na Portaria nº 1.177, de 23 de dezembro de 2014 que  trata da  autorização de importação e uso emergencial de produtos. 

Esse procedimento   levanta a duvida si os benefícios econômicos no curto prazo decorrente da importação e uso dos produtos,  justifica os custos ambientais no médio e longo prazo,os quais presumo  sejam elevados dado que não são autorizados pelo órgão competente.

Enfim, imagino que a referida Portaria cria uma boa oportunidade para a Mundo Lindo qualificar o debate sobre as intervenções governamentais no agronegócio nos cerados, deixando claro os possíveis  benefícios (e os beneficiados) e custos (e os danificados) decorrentes dos procedimentos autorizados pelo referido  Estado de Emergência.

"Unfortunately the reader’s train of thought gets interrupted with investigations on goods movement (chap. 15), which is not without merit, just in an unusual position within the book. Indeed, in other chapters discussion on freight and logistics is integrated with the wider discussion and this may have been a more appropriate solution in terms of flow. With this as the main shortcoming of this book’s structure, any sceptic impression is overcome with the closing chap. 16 comprising a number of imperative arguments for the proposed strategy described mainly with solutions for New York City and Melbourne [....] [SHÄFER, 2O15, p. 192]

Last but not least it’s a pleasure to see combinations of spatial and transportation planning and policy promoted as the favourable strategy: In the early 1970s, this had already become the mainstream point of view in Germany since Kutter (e.g. Kutter, 1973), while authors of U.S. and other international English-language publications predominantly denied any interdependency of spatial and transportation related factors and developments until only one or two decades ago. The reader may also take delight in the convincing Australian practices based upon these integrated concepts [SHÄFER, 2O15, p. 192]

"Last year the city approved a new Community Design Plan (CDP) that’s intended to be a framework for encouraging healthy development along the street.  [...] What’s the right mix of retail, office and residential?   The new CDP call for mixed use development including commercial business on the ground floor and residential and offices above. That mix is important to keep the street active and lively from morning to night, and should bring more “eyes on the street” – neighbours watching out for each other."
