Many people ask me valuation questions when filing for divorce. One of the main questions is whether or not they should use their current CPA to provide valuation services or expert witness testimony in family law court.

 

Many people going through divorce assume that since their accountant or CPA has worked with them for many years then it would make sense to use them to prove the value of the business, provide maintenance calculations, or testify in court.

 

The reality is that alimony, child support and company valuation issues are complicated matters. Business valuations are usually handled by people who have many years of experience and a business valuation credential such as CVA, ABV or ASA which are just some of the available certifications.

 

So the first question you need to ask your CPA, accountant or bookkeeper is whether they've completed any business valuations in the past. Another good question is whether they have received any formal training regarding business valuation methods.

 

Another good question to ask is if they have some experience in providing valuation services to other companies. The next question could be whether they have ever testified in deposition or trial for a divorce proceeding.

Divorce Valuation "rules" are different for each state. Make sure you understand the court system and cases involved in the state you are getting divorced. Another good reason to work with an experienced divorce attorney and hire a divorce valuation expert.

There are several business valuation credentials which are widely accepted by the business community and the CVA is one of them. The National Association of Certified Valuators and Analysts or NACVA created this designation in 1991.

 

There are several requirements for this designation including:

• a college degree • passing a 5 hour proctored exam • optional 45 hours of training • submission of a redacted client report • 36 hours of CPE or continuing professional education - every 3 years • payment of yearly dues

 

There are under 10,000 expert with this designation and up until April of 2013 there were actually 2 different designations the CVA and the AVA. These were merged into one -- which is the CVA.

Many people have questions about whether they need a business valuation expert when they're getting divorced. Most family law cases involve fees for attorneys and experts, and people are always trying to save money -- I completely understand.

 

The thing is...If there is ownership of a small business, shares of a family held business, marketable securities, or if real estate properties owned by both parties, then you probably need an expert to place a value on those assets. You may need a valuation company or real estate appraisal service.

Here are some things to consider if you own a business and your marriage is ending:

 

1. Was any of the business or marital property owned prior to the marriage?

 

2. Is there a buy-sell agreement that deals with how the business is valued in the event of a divorce?

 

3. Has there been any written offers to purchase the business within the past 3 to 5 years?

 

4. Do you and your spouse disagree on the value or what the business is worth?

 

5. Have you had any prior valuations done for the company?

 

6. Will you be going to family law court to settle the matter?

 

All of these questions are very important to determine whether you need a valuation performed for the business.
