Protection of the 4th Amendment

This case took place in Texas and made people question the constitutional requirements for obtaining a search warrant. During the case, the officers easily obtained a warrant to search the home of someone who was believed to be holding drugs. The accused was later found guilty of the crime, however, the requirements to get a search warrant were then observed and re-evaluated.

In this case, Agent William Elliott of the United States Department of the Interior suspected that petitioner Danny Kyllo was growing marijuana in his home. To prove his suspicions, Elliott scanned the outside of Kyllo's house with a thermal imager to see if the high temperatures required to grow the drug were in use. Danny Kyllo was indicted on one count of the growth of marijuana, but argued that his fourth amendment right had been violated with the scan of his house without a warrant.

A law in the District of Columbia bans handguns by making it illegal to carried unregistered handguns and prohibiting the registration of handguns. Heller, a D.C. policeman fought the law on the grounds of the Second Amendment, the right to bare arms. The court ruled in his favor and ruled that the ban on handguns was a violation of the second amendment because of the need for self protection.

There is much debate about how and when to regulate speech regarding anything school related. In this article, the issue of what students say about their teachers over facebook, or the general internet. Some citizens say that the schoolboard should not be allowed to get involved if the students post something negative about any staff member of their school due to the students' right of freedom of speech. Those opposed believe that the students should be punished for saying anything about their teachers with a negative conotation.

This article just explains the history of the third amendment to the constitution. It was put into place due to the quartering act that Britain placed on the colonies during the Revolutionary War. The third amendment protects citizens from having to house soldiers without their consent, both during a time of peace and/or a time of war.

Violation of the 3rd Amendment

This article discusses a court case in which two correction officers at Midd-Orange Correctional Facility in Warwick, New York, claimed their third amendment right had been violated during a statewide strike in April and May 1979. During the strike, the officers had been forcible evicted without notice from their facility-residences, which were then used to house members of the National Guard with the consent of the officers. Courts ruled that that the third amendment had not been violated due to the fact that the apartments were provided with their employment.

Aaron Tribble, who lives in student housing, says a school rule mandating his guns be stored with campus police violates his constitutional rights. He claims that according to the Second Amendment he has the right to keep a gun in his housing. He claims that not having his gun at home presents danger to his family, should he ever need to use it. And having to store his gun at the campus police station is a time hazard.

Violations of the first amendment

This article lists and describes many court cases concerning violations of the first amendment. In one specific example, dealing with the Sund v. City of Wichita Falls, Texas, members of a local church wanted to remove two children's books from the library due to their depiction of homosexuality. Opposing parties argued that by removing these books the first ammendment of freedom of speech is violated.
