Two more elderly women with medical conditions have come forward claiming they were strip-searched by Transportation Security Administration [TSA] agents at JFK Airport this Novemeber. The women were interegated and strip searched without fair cause.

Engblom v Carey Third Amendment Violation

Engblom was a guard in a New York State prison. She lived in a home owned by the prison, and provided as part of her pay.The guards went on strike, and the State called in National guardsmen to guard the prison. The State evicted the strikers from their prison owned homes, and used them to house the National guardsmen that were replacing them. Engblom sued, claiming that the States action violated the 3rd amendment ban on quartering soldiers in private homes without the owners consent. When Ernesto Miranda was arrested for rape and armed robbery, he was never told his Fifth Amendment rights. Miranda was unware that he had "the right to remain silent and the right to an attorney." Because of this, the Court found him not guily because his Fifth Amendment rights were violated.

Ninth Amendment rights violated because they are unknown

The First Amendment right of free speech and the Fifth Amendment right to avoid self-incrimination are well-known, but the Ninth Amendment is ignored. Pity, because it bears directly on abortion, the right to die and gay rights.  Many people's rights are violated because they are unaware of their Ninth Amendment Rights

When a woman was asked to enter her password into her laptop, her Fifth Amendment rights protected her. "A defendant in this case, Ramona Fricosu, is accused of fraudulent real estate transactions. During the investigation, the government seized an encrypted laptop from the home she shares with her family, and then asked the court to compel Fricosu to type the password into the computer or turn over a decrypted version of her data. But EFF told the court today that the demand is contrary to the Constitution, forcing Fricosu to become a witness against herself." - EFF

Sophomore Chase Harper was told to remove his shirt that read "Day of Silence" while in school. The shirt represented his opinion to bring awareness to homo-sexual rights. The student pleaded that his freedom of speech and religion were violated. The First Amendment states freedom of speech, religion, and press. "The attorney also argues that the U.S. Supreme Court has stated that students do not shed their constitutional rights at the schoolhouse doors."

3rd Amendment Protected when tenant fails to pay rent

Landlord's Third Amendment right was protected when a tenant failed to pay rent. Without paying rent, the person is considered being "quartered" and living in a place without approval or permission. The tenant was evicted from their home when they did not pay fair rent to the rightful owner of the house.

Board of Education v. Earls 536 U.S. 822 (2002) Fourth Amendment protection

An Oklahoma school required that all middle and high school students must take a random drug test to participate in extracurricular activities. Parents and students argued that this "search" violated their fourth amendment rights. Through several court cases, the student did not have to participate in the drug testing. In this situation, the Fourth Amendment protect these citizens.

Romell Broom's death penalty sentence was overturned when executioners failed to find appropiate use for the death penalty. This would be considered "cruel and unusual punishment," violating Broom's 8th Amendment rights.

This article brings up a very good point, one that could, in the future, even be used to get rid of the death penalty entirely. By deeming Broom's execution a violation of his rights under the eighth amendment, he was allowed to live.

This article is about the death penalty. The man claimed that it was a violation of his 8th amendment rights to have an execution twice.  in this case though, they never actually administered the drugs required to kill him. I think that the execution should happen again in this case.  I agree with the courts ruling of it was not a violation.

Man's Sixth Amendment rights were violated when .." failing to timely prosecute what would have been a meritorious motion to suppress the bathtub and all evidence related to said tub discovered following its unlawful seizure. The state unconstitutionally seized the bathtub pursuant to a search warrant which neither listed the bathtub as an item to be seized nor could be construed to validly include the bathtub under the broad latent fingerprint language." - KYpost
