The Constitution does not say the Executive branch can suspend habeas corpus or violate civil liberties. However, presidents have used laws, US Code, and Executive Orders to justify emergency powers that consequently violate our civil liberties.
As President Obama takes his second oath on Monday we should all ponder the nature of the powers we have given him.

The constitutional negotiations, required by a bloc of regional states following Zimbabwe's violent and inconclusive elections in 2008, had broken down over disagreements on more than 30 clauses, including those tempering presidential powers.

The details werent fully proposed for a reduction in presidential powers. But the new constitution introduces a constitutional court and outlines an independent national prosecuting authority. Under the document, the president won't have power to dissolve parliament, a body that will be able to revoke the president's decisions.

President Obama has resorted to bypassing the legislative branch to implement tighter gun control laws. He has called on Congress to ban the sale of assault rifles, limit the size of ammunition clips and require background checks for all gun sales

As Barack Obama prepares to be sworn in for the second time as president of the United States, he faces the stark reality that little of what he hopes to accomplish in a second term will likely come to pass. Mr. Obama occupies an office that many assume to be all powerful, but like so many of his recent predecessors, the president knows better. He faces a political capital problem and a power trap.
