David Slepkow's curator insight, January 7, 2015 2:30 AM

And so Friday, an assistant U.S. attorney filed in U.S. District Court case 14-cfv-01399, a “notice of removal” in what has become the District of Columbia, Office of the Attorney General v. Benjamin Huff, Federal Bureau of Investigation. In essence, the papers “remove” the case from the D.C. Department of Motor Vehicles’ Adjudication Services office — which had scheduled a hearing on the matter for this coming Friday at 7:30 a.m. — and put it into the hands of the federal court.

It was done, the filing says, “to ensure that federal officers or agents shall not be forced to answer for conduct assertedly within their duty in any court except a federal court.”

Bill Miller, the chief spokesman for the U.S. Attorney’s Office in the District, declined to comment, a stock phrase good enough, it turns out, for high-level corruption cases as well as lowly traffic citations. Ted Gest, the spokesman for the D.C. attorney general’s office, representing the DMV, wouldn’t speak on the matter, either.

Just what is all the fuss about?

The driver of the Toyota, Mark Andrew McCoy, of Alexandria, told police that the Caravan, driven by Huff, tried to move from the right lane to the left lane, striking his car. The officer issued Huff a ticket but wrote in the report that she had cited McCoy.

White House Security Breaches Appalling DC Rite of Passage - Price Benowitz, LLP

White House Security Breaches Appalling DC Rite of Passage - Price Benowitz, LLP | Washington DC Criminal News | Scoop.it
How many White House security breaches does the Secret Service need to encounter before there’s a change in policy?
Price Benowitz LLP's insight:

This weekend’s serious security breach at the White House took me right back to 1995, when I was celebrating my law school graduation and became an unwitting witness to similar incident that resulted in a gunman and a Secret Service agent getting shot. Twenty years later and I have to wonder what will it take for the Secret Service to update its security measures?

David Slepkow's curator insight, January 7, 2015 2:14 AM

My first personal foray into this unique phenomenon occurred in May of 1995, on the night before I graduated from The George Washington University School of Law. I was having drinks on the roof deck of the Hotel Washington (now The W Hotel) excited for the next chapter in my legal career, when I heard shots ring out. At first I thought it was a car backfiring, at least that is according to NBC’s archival footage of the interview I gave to a reporter at the scene. The gunman, Leland William Modjeski, 38, of Falls Church, Va., turned out to be carrying an unloaded .38-cabliber handgun. Both he and a Secret Service member were shot by another member of the Secret Service as they tackled Modjeski to the ground. Authorities and the courts later found Modejeski was mentally ill and didn’t intend to hurt then-President Bill Clinton, who was inside the White House at the time. The incident occurred just days after traffic around the White House was diverted because of a potential car- or truck-bomb. Being there for that event has had a lasting impression on me, as have many of the other incidents that have occurred since then. And they all came flooding back to me as I read with interest this weekend about not one, but two security breaches at the White House.

In less than 24 hours, the two most recent incidents have proven to be an embarrassment to the once sterling reputation of the Secret Service and have raised concerns about the safety of the First Family and White House staffers. On Friday, mere minutes after President Barack Obama and his two daughters left the White House, a knife-wielding man scaled a fence and made it all the way to the entrance of the north portico armed with a Sypderco VG-10 folding knife with a three-and-a-half inch serrated blade. The breach prompted an unusual armed evacuation of the White House of staffers and press members, and led to an increase in security measures.

Whoever the faker is — the feds are still trying to confirm his true identity — he hung a shingle for a cubicle-style law office in Brighton Beach and began filing federal lawsuit on behalf of unsuspecting clients in the Eastern District of New York.

Last week two undercover agents posing as prospective clients visited the shady shyster who told them he would represent them for a $5,,000 retainer fee plus $400-per-hour.
