This goes to show you how open your life beomes when joining social media. So if you want to stay private, then go ahead and sign up, but be very limited to what you post, become whats known as a "Troller" 


Social Media has always been this grand idea about connecting.


Although the truth is,  Facebook has rapidly slowed down due to changes they have made in news feeds, yet they still are there for anyone and everyone to look at your past, present and especially photos. Even in the bankcard world of merchanting, you are being looked at, Googled, and searched.

I wanted to take the time in discussing the "NO's" in processing and the Major "NO" NO's for a new online merchant account. 


First lets start out with the type of business your running. 


NO-#1 NOT BEING COMPLIANT


If you are in the online space of selling products, services or digital goods the most important thing you can do is be compliant with all regulatory laws. This goes for your Privacy Policy, Terms and Conditions, Check Boxes or opt in features for additional items added to the cart or up-sells and if your business requires a license or bond then get it!!!   These need to be clearly posted and disclosed. 


NO-#2 INTERNATIONAL SALES ON A DOMESTIC ACCOUNT


If you are a USA based company and selling products internationally you better make damn sure your processor knows this in advance. WHY? Because this will save you a headache of having your account closed or funds held due to US based banks are not in the business of processing International transactions. 1. They are Risky. 2. You have fulfillment problems or import issues and 3rd is that the customer will more than likely chargeback and win and you lose on all costs. 


NO-#3 DUMPING TRANSACTIONS AND DECLINES


Never ever ever ever get a new account set up and start dumping in batches of Bad transactions, retries, or international transactions on a brand new account. WHY? Cause you will lose your account the next day, no questions asked and no reason for explanation other than you as a merchant should 1 Know better and 2. Just being plain Ignorant and most importantly, putting us at risk. 


NO-#4 APPLYING FOR A MERCHANT ACCOUNT


When applying for a merchant account, Do not hide your pages, your links, your way of doing business or anything else. Believe me when i say this. When you process with a company like Vixous Payments, we do not take the GOOD ONLY, We also take the Bad and Turn you into good and doing it the right way. If we know your history, your problems your actual numbers, we can help you get back on track. Trying to fool a processor these days is the number one way to end up on the Mac system, TMF and Watch alerts. And believe me they are all interconnected now, so be honest, and we will treat you fairly, and approve your account the right and honest way.


NO-#5 DONT MISS-COMMUNICATE 


Once your account is approved, talk to us, let us know your batches, what your going to start with, how much volume your going to send over so we can be aware and not have issues. This is the easiest thing to do when dealing with a true Boutique Processor like us. We are not like the rest, We are pro merchant, however we expect communication, honesty and upfront answers so we can expect, help and advise. We are your advocate and custodian of your money in the process.

We understand their are hundreds or even thousands of processors out there. However the truth is, very very few are truly on your side. When in business we all know the importance of making the deal happen. However the deal sometimes needs to be put in writing, especially for high risk Merchants. 


Recently I have had the pleasure of working with many Call Centers and Professional Service and Product centers that sell such services with a higher average ticket and quite honest, deemed to be higher risk. 


Although High Risk is not the issue, the issue is in the deal and contract between you and your customer. With that said its important to have a good contract that clearly defines the following.  And I can assure you that more than 70% of Call centers are not compliant as to the issuers agreements, and also the verbiage needed for regulatory industries. 


So here are some basic tips to make sure you are covered on chargebacks, compliance and enforcing your contract or sale with your customer. 


1. Clearly Define your company name and who the client is.


2. Clearly State the Date that the contract was entered. 


3. Clearly state the service and product offerings in detaill 


4. Have the Customer sign and date underneath the services that they acknoledge they are buying those products and services. 


5. Be sure to have the states mandatory time of right of recission. Which happens to be 3 days in most states and up to 14 in some. 


6. Have your cancelation policy and refund time period on the same page, and in simple easy to understand terms with directions on how they can cancel or receive a refund. 


7. The amount of the Transaction. Now this needs to be clear as to what they are being charged, when and at what dates. 


8.  Company has not made any earning claims. 


9 .  "The Clause" The Clause is the ending of this agreement. Remember all the above need to be on one page, not only for the purpose of easy to understand for you and the client, but its for the bank and processors and fighting chargebacks and winning reversal's.


You need to insure you have the proper language on the single page for the service and product agreement with the listed items above, along with the closing which would include the following. 


I hereby acknoledge and agree to the terms and agreements set forth in the card issuer agreement. I agree to the terms of the above mentioned contract and amount and willfully pay the stated amount for said Goods or Services.  The Company has not guaranteed or made any other statements other than set herein this legal binding contract. 


Sign___________________________ Intials _________ Date ___________



Remember This has to be on page one, not in page 2 or the final page. You can have your additional pages which include your indemity clause, your Arbitration clause and on the final page another place for the signature, inititals and date. 


Another item that Banks DO NOT, and again I will say DO NOT like is Future Services. If you charge on day one, try and deliver items within 30 days. If the services includes ongoing training then say so and also use a seperate agreement for this if need be.

As we all know Visa and MasterCard frequently change their policies and issue alerts out to us processors and banks on changes they put in place immediately. 


Many do not understand the reasoning for this, however its quite simple. When you have a few bad apples it ruins it for the whole bunch. Thus meaning merchants who do not properly run their online business or manage their refunds and chargebacks simply ruin a whole industry of getting merchant accounts approved. 


This is very challenging especially when you know there are good merchants everywhere, with good volume, great product and even better service. 


However banks do not have the same view points as I do, which is "Why punish all when the few have done it wrong" So here we are, and as part of the pushed bulletin a snipit of it says the following, especially for Electronic Cigarettes.


"To enhance the effectiveness of the Global Brand Protection Program (GBPP) and further protect the payment system from illegal merchant practices, effective immediately, online and mail order / telephone order (MO/TO) cigarette merchants in the Visa AP, CEMEA, LAC and U.S. regions that fall under merchant category code (MCC) 5993—Cigar Stores and Stands must be listed as high brand risk merchants."


So here we are, now trying to get this reversed and banks too understand that "Not All are Bad" Therefore lets make some exceptions as long as those merchants have proper fulfillment, service, refund policies and terms clearly defined. No business or commerce should be punished do to some bad eggs, however reality has shown this is a constant trend and it goes up and down.

Well Google hit back hard today after it learned the popular lyrics site Rap Genius had been using so called dubious SEO tricks to attain top spots and rankings in search results.


Now RapGenius.com doesn’t appear on the first page of results for a search of “Rap Genius,” and popular queries like “Jay-Z Holy Grail Lyrics” don’t bring up the startup like they used to. [Update: But the two companies are working on a resolution.]


Founded in 2009, Rap Genius is a lyrics and text annotation site., Interesting enough. It lets users provide their own explanations for song lyrics, religious texts, legal documents, images, and more that other users see when they hover over snippets of text hosted on the site. The startup lept into the limelight when it received a massive $15 million investment led by Andreessen Horowitz in late 2012.

Known for their foul mouths and outrageous behavior, the Rap Genius founders had been riding high over the last year as their site climbed to prominent and lucrative slots in Google search results. 


Bottom line is Google can make or break your business if your too dependent on search and seo. Google has made it clear in the way of actions that big box stores and Name brands come first. 


However they have no problem bilking 10s of thousands of merchants daily out of poor traffic and CPC revenues from small to medium sized business, which also seems to be Facebooks Revenue model. Bottom line, sometimes you have to speak up cause the big dogs like Google need to be put in place once in a while. 


For a company who has sold Americans Data, they scan your emails and sell the data, I personally think its a little Hypocrite of them to say  Rap Genius has done anything wrong. Google take a look in the mirror before you judge.

What are the biggest challenges to business owners today. Some say its funding, some say its getting new customers, and some complain about just not having enough margins or profit. 

 

All of this is tied together, without leads or new customers, you have no income or profits. Many business owners are looking for funding when in reality they should be looking at what they, themselves can do to drive income, and plain and simple the answer is work. 

 

You are your company, you have to get the sales yourself if you have too. Pick up the phone, network, go to lodge meetings, business networks and even unions. Their are so many outlets out there to get customers from and the best way to build long term and good revenues is by knowing your customer. 

 

Reaching out, meeting in person, introducing yourself. Communication and talking to everyone and anyone even at the gas pumps, ask strangers what they do for a living. Do not be afraid because all they can do is say no, take it and move on. Numbers-pipeline=sales at the end.

The End? Or Just the Beginning!


In order to really answer this question you have to look at the whole industry in itself. Free Trials have been around for over 20 years and have not only been a great way for a customer to try a product or service before committing to it, its a great way for companies to get customers in the door to try their product and let the customer decide if they would like to continue to buy or receive the service at the retail price until they cancel or the terms are up. 


Free Trials have been used by some of the biggest names in the industry ranging from Netflix, Body Flex, Block Buster, Mcafee, Virus Protection, and Symantec , and yes even Viagra! Now this is only a short list of the big box stores that have used trials or "Free" Trials as a way to get customers to try their products. 


Over the past years we all have seen the word "free" in one form or another being used in online marketing. Companies selling Vitamins and Supplements, Beauty Brands, and everything else and it still continues to dominate the newer customer acquisition methods for big box stores for online sales. 


However in the past years we also have seen companies take advantage of this term "Free" and the devastation it has caused to merchants, banks, processors and yes eve consumers. 


In light of these that have taken advantage of selling the "Free" Trial methods have left an aftermath that brought the attention and aggression of the FTC, VISA And MasterCard to take action that has literally demolished the hopes and dreams of good companies who comply with the rules and regulations that are to be followed when offering such "Free Trial" Services and Products. 


Put simply those who sell under these methods only need to follow some pretty simple methods to stay compliant. For some odd reason some or rather many had chosen to not do the following. 


1. Disclose the terms properly

2. Using the word "FREE" when if you used the word "Trial" it implies the same but gives the customer the idea that "YES" its a trial only

3. Having a customer service number on how to call and cancel before the end of the trial. 

4. Fulfillment of product and when the trial begins. If its a software thats delivered immediately at the time of the sale then the trial starts that same day, however if its a physical product then you should not start the trial until at least 3-4 days from the time that the product ships, turning a 14 day trial into a 18 day trial giving the customer the time allowable to try the product. 

5. Multiple up sells without consent! Now this is a biggie, many companies would have up-sales on their landing pages or sites that would not disclose the proper terms of what they were buying. 

6. Cancelation process and how to cancel, when to cancel and the terms of canceling. 

7. Refund Policy

8. Making claims to lose 30 pounds in a month without a back up of claims or making false claims. 

9 Fulfillment Process, are you using a good company to handle and ship you products and services in a timely manner. 


10. And  YES the most important, people just were not answering phones and giving refunds. Why I do not know other than the market to acquire a customer the costs to acquire a customer is so high it makes it impossible for a merchant to be able to issue refunds like they should due to the ROI and the loss and attrition rates.


Therefore here we are in the era of shut down for many in the industry of selling, except the big box stores and so called "House Hold Name Brands" 


Now the question has always been asked, "Why can Netflix offer free trials and we can not"


Well simply put its because you are not BIG BOX and yes is it unfair ?YES but so many bad has put the good on the list of shit box stores instead. 


Getting a merchant account now for continuity is now becoming extinct for independent owners of products, unless you have some serious money in the bank to back up what your selling. And Yes you can thank those who have not complied. 


Now their is another issue that over the years that have now made it even harder. Many merchants feel that they can manage the chargebacks and ratios if they have 20 -50 merchant accounts and all running less than 50K of volume per month. Well I can assure you it wont last long, and as of the past week many have found out that, "Yes even that comes to a screeching halt" And Poof your accounts are dead. I can say that in the last 2 weeks Our company has had over 60 accounts submitted through our online portal at Vixous Payments and we have only approved one of them, and that is only because he is selling hard sales and one time buys and lets the customer opt in if they want to continue with any other future shipments. 


So to summarize this up I would like to say that instead of trying to beat the system, learn how to work with the system, think outside the box, test, figure out how to convert the right way, manage your customers and refunds and the industry can come back, But for now the free trial industry is about dead!


However when their is an end, their is also a beginning. Lets just hope the beginning starts out right and follow the guidelines and if needed call your consumer protection for advice they are more than happy to help. The economy needs jobs, money needs to circulate and it can be done the right way


So in the future here are some simple tips besides the ones above to have to run and be a real business. 


1. Have a real url and website for customers to reach you and buy from. 

2. Have a contact and support page

3. Do not allow anyone to host you pages, landing pages or sites. 

4 Be sure to ship on time every time

5. Answer the phones and issue refunds when the customer wants one

Life is a Garden Dig It...


This is a saying that i still use today in  life and in business. We have so many opportunities available that life is really like a garden., its incredible and endless of opportunities out there. 


As with Gardening:


We have to plant a seed, water it, fertilize it, and maintain it. This goes the same for business. 


When you start a new business your planting a new seed, and you want this seed to grow to a plentiful provider of fruits for you and your family. So this takes some nurturing and care and follow up. 


Recently I have found myself being far more organized than ever before by adding some changes internally, learning new systems, self educating which is what i call fertilizing, or giving us a boost in how we respond to our inquires, new sales, merchant questions and simplifying our process. And out of this we are growing at a much faster rate than I expected, but well worth it and appreciated!!!

A guy comes near my seat, shoves a badge that had some sort of a shield on it, yanks the Google Glass off my face and says “follow me outside immediately."

Really should we have to be concerned about what we wear to theaters or when out? For an American to be detained and questioned and drilled for wearing prescription high tech glasses goes a little too far.


To Further the insult to this unknown American that the FBI whos' job is to know about technology should know that they can easily obtain the footage by viewing it if the glasses where being used to Illiegally record the movie (Ripping the Movie)


The question asked without putting him through this scary ordeal should have been a simple yes or no, Were your glasses turned on at the time of the movie? Answer=No. Question, can we confirm by viewing the footage, Answer = Yes. And this would have solved an unlawful detainment based on suspicion


As Technology moves faster than we can blink an eye its time for law enforcement to get with the times of technology, and more importantly remember we have a Constitution and Bill of Rights. 


Sure Illegal movie downloads or screenings take place, if you have ever been to NYC, you will find them laying on the corners or with men standing with Blue bags, Not some middle age man from Columbus Ohio.

Eventually, after a long time somebody came with a laptop and an USB cable at which point he told me it was my last chance to come clean. Then they went through my phone, and 5 minutes later they concluded I had done nothing wrong.

The officer asking the questions identified himself as "Bob Hope" of the "movie association" — presumably the MPAA — and gave him four free passes to another movie at AMC. He didn't apologize: "All he said was AMC called him, and he called the FBI  ... I would have been fine with 'I’m sorry this happened, please accept our apologies.' Four free passes just infuriated me."

We all know when running an online business you have a lot to deal with on a daily basis. However if you do some simple changes in the beginning or even now it can save your business and even your merchant account.


Some businesses who come to us for processing do not understand that even though we underwrite and handle the day to day and "We Might Understand Their Business Model" This does not mean the bank or risk assestment teams at the bank do.


Therefore I think its important that Online Businesses take notice to some pretty simple guidelines that I feel is needed and a must have.


1. A professional home site www.Home.com now this is where your customers can always find you. If your selling a product that has external landing pages, Come on, have a home site, its simple, and a must have.


2. Privacy Policy and Terms and Conditions. If you dont know this is a must, then you need to take a step back and ask some people who do know what you need.


3. Toll Free Numbers active and working. This is just common sense


4. Working emails that a customer can reach you at, and reply to them.


5. If you have complaints from a customer or a BBB or anything else, DO NOT IGNORE IT, Refund, handle it and move on, just do not ignore.


6. Professional Site Designs, this goes back to number 1. Why would you sell something and not have a good looking and converting home site? If you need help with this ask us, we can help provide this service


7. Basic hours of operation posted on site. If a customer know when they can get a hold of someone then they wont think the word "Chargeback"


8. If your in an industry that requires a license or registrations for high risk, telemarketing bonds etc, get them done. Yes some of it cost money, but it will not cost you as much if you do not have the license and you are regulated and hit with a fine.


9. Sub Pages, Landing Pages, Pre-Sale Pages, now this is where people try and get sneaky. Why ? I dont know, Keep it clean, and simple. Have your links available to click from your home site, Have you terms clear, and privacy policy in tact.


10. When Applying for a merchant account, BE CLEAR, HONEST and OPEN. This is a biggie with me, If i do not know whats going on, or the problems you are having, how am I properly supposed to help you manage your account, approve or even offer solutions to your current problems. Remember, We process for very successful online and high risk businesses for a reason, and we have seen the ugly as well. So do not take a chance, do it right and keep it tight.

Did we just hear this correct? Did Google really make the right decision for once or was the heat too hot to handle. Now that Rap Genius is back at the top even though their alledged spamming techniques were in violation of googles terms or "Green Earth and Peace and Harmony" They have been put back to the ranks with Pride. A win for all of us!!

Google apparently cares more about giving the best search results than punishing spammers, as it’s returning lyrics site Rap Genius to its high rankings for searches after it was exiled for SEO spam 10 days ago. What looked like a death sentence for Rap Genius’ traffic has turned into a slap on the wrist. Today Rap Genius detailed what it did wrong, and how it ditched the spammy links to get back in Google’s good graces.

Previously on “Rap Genius’ SEO blunders”, the startup had raised $15 million from Andreessen Horowitz to annotate the web. It’s site hosts lyrics, religious texts, legal documents, poems, and news and allows users to add explanations of what they mean. The Rap Genius founders are known as braggadocious rabble-rousers, and they showed off their ridiculousness on stage in an interview with me at TechCrunch Disrupt New York Link below. There they discussed doing study drugs like Adderall while naked to make sure the stayed home and focused on building the site. Now if this isnt a in their own way a strange way of staying focused, it sure panned out for them in the long run for business. 


I been following them for some time as i have seen them add poetry, quotes, stories and more that others will curate and discuss and mostly talk about what it means. It brings to light the minds of many and the insight of some interesting people. 


Keep it up Rap Genius and Thumbs up for Google for putting their links back up.

Well to be honest, yes we are all Ketchup, however their are differences like ketchup. Some are thicker in texture, some are sweeter, and some are cheeper. Well the same goes for choosing which processor works best for your taste. 

When looking for a merchant account their are 10 key things you should be asking or looking out for before choosing the right custodian of your money and processing. 

1. Are their any long term contracts?

2. What are my monthly fees?

3. What is my true discount rate? 

4 What is my Transaction Fee? 

5. Are you PCI Compliant?

6. Does your company have the taste to do business with a company like mine, i.e. call center, E-Commerce, Online products, digital downloads, Brick and Mortar etc? 

7. Do you have any reserves or hold reserves and if so, How much?

8. Will you hold my money if i go over my approved amount more than 10%?

9. How long have you been in business?

10. What is your approval Process

These are pretty easy to answer question for any experienced company in the industry and if they can not give you an answer then move on to the next. When it comes to your credit card acceptance this is one of the most important parts of your business as its 50% or more of your revenues, and if you an online or Mail Order or Telephone Order company then 100% of your revenues will come from credit cards for the most part.

Well Google hit back hard today after it learned the popular lyrics site Rap Genius had been using so called dubious SEO tricks to attain top spots and rankings in search results.


Now RapGenius.com doesn’t appear on the first page of results for a search of “Rap Genius,” and popular queries like “Jay-Z Holy Grail Lyrics” don’t bring up the startup like they used to. [Update: But the two companies are working on a resolution.]


Founded in 2009, Rap Genius is a lyrics and text annotation site., Interesting enough. It lets users provide their own explanations for song lyrics, religious texts, legal documents, images, and more that other users see when they hover over snippets of text hosted on the site. The startup lept into the limelight when it received a massive $15 million investment led by Andreessen Horowitz in late 2012.

Known for their foul mouths and outrageous behavior, the Rap Genius founders had been riding high over the last year as their site climbed to prominent and lucrative slots in Google search results. 


Bottom line is Google can make or break your business if your too dependent on search and seo. Google has made it clear in the way of actions that big box stores and Name brands come first. 


However they have no problem bilking 10s of thousands of merchants daily out of poor traffic and CPC revenues from small to medium sized business, which also seems to be Facebooks Revenue model. Bottom line, sometimes you have to speak up cause the big dogs like Google need to be put in place once in a while. 


For a company who has sold Americans Data, they scan your emails and sell the data, I personally think its a little Hypocrite of them to say  Rap Genius has done anything wrong. Google take a look in the mirror before you judge.
