The Uncertain Science Of Fetal Pain

The Uncertain Science Of Fetal Pain | Upsetment | Scoop.it
As the Republican-led House of Representatives passes a far-reaching bill that would ban most abortions after 20 weeks based on the science of ‘fetal pain,’ Michelle Goldberg reports on whether the unborn can feel hurt.
Kenneth Weene's insight:

If the "Right to Life" crew insist on trying to attribute cognition and awareness to a fetus, then they must demonstrate at least a minimal level of learning to substantiate that attribution. I await those replicable and valid experiments. Bet they won't (can't) be done.

Later Tuesday the House will vote on the Pain-Capable Unborn Child Protection Act, a GOP-sponsored bill that aims to ban abortion after 22 weeks.

What is wrong with the far right? Could it be that they have no control over their own sexual preoccupations?

G.O.P. Pushes New Abortion Limits to Appease Vocal Base

G.O.P. Pushes New Abortion Limits to Appease Vocal Base | Upsetment | Scoop.it
Instead of focusing on the economy, as an internal party document suggested, House Republicans are pushing the most restrictive abortion bill to come to a vote in a decade.
Kenneth Weene's insight:

There is something terribly wrong with a political system in which appeasing the extreme wing of a party is more important than representing the vast majority of your country.

Ruckus in Wisconsin Senate: Republicans push through ultrasound bill after silencing Democrats | The Raw Story | Upsetment | Scoop.it

Once again the women of America get to see the indiference of the far right to the concerns and freedoms of women.

Kenneth Weene's insight:

If I were a woman, I would probably do two things after reading this story: 1) Send a contribution to Emily's List and 2) Decide to never vote for a Republican candidate at any level of government.

Cops Plead Guilty to Helping Plant Drugs on Woman Sexually Harassed by Judge

Cops Plead Guilty to Helping Plant Drugs on Woman Sexually Harassed by Judge | Upsetment | Scoop.it
A judge responded to an assault victim by demanding sex in exchange for 'legal favors' in her divorce. She filed a complaint, and he sent cops to plant meth in her car.
Kenneth Weene's insight:

I am not generally a proponent of the death penalty; but if this is an accurate story, this ex-judge and these ex-cops should probably be stoned. They are beneath contempt.

Yet another example of how the "War on Drugs" helps to corrupt not uplift law enforcement.

Obama-Xi summit 'constructive'

Obama-Xi summit 'constructive' | Upsetment | Scoop.it
US President Barack Obama and Chinese leader Xi Jinping end a two-day summit described by a US official as "unique, positive and constructive".
Kenneth Weene's insight:

The Daily Beast mentioned the following:

"China’s borders: a court sentenced Liu Xia, the brother-in-law of imprisoned Nobel winner Liu Xiabao, to 11 years in prison for alleged real estate fraud, a fairly harsh sentence for a minor business dispute."

The Beast saw this as troubling; I see it as positive. Think of how little we punish businessmen who break laws. Yeah, it had to do with Liu Xiabao, but is also about trying to find a line between the rights of businessmen and the rights of the country. The real quesiton is what about the rights of individual Chinese. But that is not our question to be asking except when it comes to buying products made in their sweat shops.

Mississippi’s governor comes out with some bad ideas for women. Michelle Goldberg reports.
Kenneth Weene's insight:

Yup, those conservatives sure know how to help women. Consider Mississippi, a state so backward that it is more like a third world country than the rest of the United States. Consider its governor, Phil Bryant, another exemplar of misogyny Republic style.

The Guilty Man

The Guilty Man | Upsetment | Scoop.it
Twenty-six years after Michael Morton was sent to prison for a murder he didn’t commit, his wife’s killer was finally brought to justice.
Kenneth Weene's insight:

Once again we are left with that question, when the prosecution and police don't do their job properly, when they persecute rather than investigate, what should the consequences be? This man--deprived of 25 years of his life and even a connection with his son--how does the state of Texas right his wrong? Will the state even try?
And why is it that these stories seem to so often come from Texas?

The Volokh Conspiracy » Do You Have A Right to Remain Silent? Thoughts on the “Sleeper” Criminal Procedure Case of the Term, Salinas v. Texas

The Volokh Conspiracy » Do You Have A Right to Remain Silent? Thoughts on the “Sleeper” Criminal Procedure Case of the Term, Salinas v. Texas | Upsetment | Scoop.it

"This morning the Supreme Court decided a very important criminal procedure case, Salinas v. Texas, by a 5-4 vote. I’m guessing that you haven’t heard of Salinas. And it probably won’t get much attention in the press. But it should: Salinas is likely to have a significant impact on police practices. And it’s a fascinating case for legal nerds, too. So I thought I would explain the issue in Salinas and offer some thoughts on why it matters and what it might mean. "

Kenneth Weene's insight:

This decision means that if you don't answer questions when you aren't under arrest the prosecutor can use that silence against you in court. So if you are not arrested, you should immediately refuse to talk to the police and assert your Fifth Amendment Right to silence, whether you are guilty or not. That offsets this potentially damaging decision.

By the way, unless he was a balistics expert, the individual would have been a fool to answer the question to which he remained mute. I for one don't know how shotgun shells are matched to a gun and how accurate such a match might be.

GOP Governor Rick Scott signs ALEC-backed bill banning paid sick leave | FreakOutNation

GOP Governor Rick Scott signs ALEC-backed bill banning paid sick leave | FreakOutNation | Upsetment | Scoop.it

So the government can't tell restaurants that sick workers should be paid, which means you'll have somebody sneezing on your food. That schools, especially the private ones and pre-K care facvilities, can't be told to pay sick teachers, so they'll be at work helping to spread illness even when the sick kids are home. ALEC and the GOP strike again, and we will all be the worse for it.

Kenneth Weene's insight:

The GOP just doesn't get that it is about people not corporations.

Major military contractors are competing for billions of dollars expected to be spent to secure the border with Mexico if an immigration bill passes Congress.

Of course a rational change in immigration policy would cut down the need for this as would a change in the drug laws. Could it be that the military-industrial-espionage complex don't want us to have rational laws? Could that be?

Supreme Court allows police to take DNA from criminal suspects

Supreme Court allows police to take DNA from criminal suspects | Upsetment | Scoop.it
WASHINGTON -- The police may take a DNA sample from people arrested for serious crimes, the Supreme Court ruled Monday in a major victory for law enforcement and crime victims.
Kenneth Weene's insight:

The simple fact is that fingerprinting is allowed in the course of an arrest so why not a DNA sample? On the other hand, if the original arrest is not based on probable cause or if it fails to be supported in court, should both the fingerprints and the DNA sample be considered fruit of a poisonous tree? That will have to be the next question.
