The Fourteenth Amendment contained the historical terms of surrender for the Confederacy. Each Confederate state when rejoining the union and accepting the constitution was accepting that federal government now had the right to determine what was due process in each state.

Speaker Boehner raises doubts amid deepending impasse on immigration policy.

For once I will take Mr. Boehner's side. Yes, we need to take care of these kids in an humanitarian fashion. Yes, we need to change the 2008 law to make the return of those who do not meet the U.S. criteria for amnesty easier and quicker. And, yes, there has to be clarification of the status of possible Dream Act recipients. All that should be done at one time. The Democratic members of the House need to recognize the realities; we cannot provide for all these youngsters, many of who are here looking for a dream that should not come true for them. The best way out of the impasse is to provide funding, modify the 2008 law so kids can be screened and returned more quickly, and passing the Dream Act with clear boundaries so that the future policy is also set. Lastly, I strongly recommend the amendment of Amendment XIV Article 1 of the Constitution as part of that sweeping overhaul. I do not believe that the child of undocumented immigrants or amnesty recipients who are not citizens, or even of visa carrying workers should be given citizenship because of location of birth.
