ATLANTA (CN) - The 11th Circuit refused to review a rule that exempts transfers of U.S. waters from Clean Water Act permit requirements.


In 2002, Friends of the Everglades and one other environmental group filed a federal complaint against the South Florida Water Management District over its water transfers from polluted canals in the Everglades agricultural area into Lake Okeechobee. The groups argued that the water transfers introduced pollutants into the lake, and thus were subject to the requirements for a permit.


Friends of the Everglades, several other environmental organizations, nine states, a Canadian province and the Miccosukee Tribe challenged the new rule in the Southern District of New York and the Southern District of Florida.


... "The water-transfer rule imposes no restrictions on entities engaged in water transfers," Judge William Pryor wrote for a three-member panel. "The effect is the opposite: the rule exempts governments and private parties engaged in water transfers from the procedural and substantive requirements of the [EPA] administrator's permit program."

What's more, the water-transfer rule neither issues nor denies a permit, but instead permanently exempts a category of activities from permits, the ruling states.

The Department of Environmental Protection has asked for $50 million for Everglades restoration as well as $50 million for the state's conservation land buying program known as Florida Forever. But instead of seeking of new money for Florida Forever the agency is asking for permission to sell existing state-owned conservation lands to generate the money.


Patrick Gillespie, a spokesman for the agency, defended the decision to not recommend any new funding for the program. Gillespie noted that there is currently $65 million in available money for Florida Forever despite a decision in recent years by legislators to curtail money for the program.


"We've got land available we can sell in order to purchase conservation land," he said. "We can do that in a fiscally responsible way."


Earlier this month former U.S. Sen. Bob Graham and others launched an effort to place a constitutional amendment on the 2014 ballot that would set up a dedicated source of money to pay for land conservation efforts

I don't understand why they want "eradicate" the from the Everglades...They have as much of a right to be there as any other species that lives there.

Nancy Marshall, president of the Arthur R. Marshall Foundation for the Everglades, founded in 1998, who works for the restoration and preservation of the greater Everglades ecosystem, will present awards to recipients of the nonprofit organization's fifth annual Champion of the Everglades Awards.


Honorees include the U.S. Secretary of the Interior Ken Salazar; Ron Bergeron, member of the Florida Wildlife Commission; and the Florida Wildlife Federation, which is celebrating its 75th anniversary.


As Secretary of the Interior and a former senator from Colorado, Salazar works to protect the nation's lands, wildlife, history and culture and has been an effective and tireless supporter of Everglades preservation and restoration, as part of the Obama administration's support of the ecosystem.
