"Three or four years ago people would laugh if we discussed social media training being manadtory for law firms.

 

Here’s six points applicable to social media education for law firms.

 

Begin with the why. Why is social media important for the law firm and its lawyers. Having firm leadership involved is critical. For more information on the why read this post of mine on how to get buy in on social media.


Educate on what social media is all about. Relationships, word of mouth reputation, listening, and engagement.


Educate on how social media is not unlike traditional business development in the law. Lawyers and law firms have always gotten their work via relationships and a strong word of mouth reputation. Social media has not changed that.


Cover how a social media strategy is developed as to a particular industry, consumer group, or area of the law, and create one.


Review the tools and platforms that may be used and when they are appropriate and when they are not.


Train the trainers (business development/marketing professionals) in large law firms and the lawyers themselves in smaller firms on how to use the tools and platforms and the tactics involved in using them. The trainers will train the lawyers in the larger firms."

According to Pew, "According to the PEW Research Center, as of May 2013, 72% of online U.S. adults use social networking sites, up from 67% in late 2012, and 8% in 2005." 

And one of the big winners, with really rapid recent growth, is a site that you probably think is totally useless: Twitter.

A point of law yet to be completely settled is who owns company social media accounts. You'd think this issue would be simple, but what if you hire an industry expert to tweet for you? When you part ways, who owns the followers (contacts) and relationships.

 Do you dedicate time on a daily basis participating in the various social media platforms?
 Do you engage with others in social media? Are you commenting on others post, retweeting good content you’ve found, +1 and sharing other’s content.
 Are you continually  expanding your social media reach by adding followers, friends, connections, people to your Google+ circles and joining LinkedIn groups?

What is the growing role of social media in/around the court?

What remains is in the courtroom of public and professional opinion. On one hand, some say that to ignore social media for law and order is short sighted. I agree. There are rules in place that govern the message—The ABA Professional Rules and Model Code, as well as several state bars, address the attendant ethical duties.

 

For the prosecutors, as Joyce illustrates, they are very aware of the ethical boundaries attached to their office. If an attorney abides by them, then go for it. Who doesn’t want to intimidate criminals and have transparent access to information?

 

For the defense, how far is too far before your message interferes with professional duty? The lessons learned by the Zimmerman defense team suggest that almost everything about social media other than simply posting court documents has a potential backlash.

 

For the accused, the sheer reach of social media can taint a very large pool of prospective jurors and compromise a fair trial. Even in the case of a prosecutor publicizing their sins, any subsequent charges against them would almost surely be impacted by that dialogue.
