Oklahoma has spoken and constitution speaks yet again for same-sex marriages.  Yet opponents still argue that the founders of our country and drafters of the U.S. Constitution certainly never envisioned the legalization of something that wasn't even remotely contemplated at the time of it's signing, namely the legalization of marriage between people of the same gender.  But then does that mean the constitution should be changed in order for the proponents argument to have any solid footing?

It's interesting that this appeared only a day after I read about a heterosexual couple faced with divorcing after a long-term marriage in order to maintain a minimal level of income due to the governments policies for determining Supplemental Security Income benefits after one of the spouses got a job which just barely covered the SSI benefits the husband was receiving for being completely disabled.

 

It is tremendously amazing how the legalities of divorce and marriage are coming into play both in same-sex couple marriages and opposite sex couple's marriages as a matter of survival even when love still exists between the two.

Same sex parents receive kudos from their daughter.  The world is changing and more recognition is being given to same-sex marriages and relationships across the country.  This is only one example in which Brenna Harding expressed her heartfelt thanks to both of her mothers in an acceptance speech of an award she won.

 

While laws through many states strive to catch up to how states will deal with the fact that only about 16 states have accepted and codified laws accepting same-sex marriages, the Federal Law likewise finds itself changing drastically with regard to benefits under federal programs that have been around for years and have been in drastic need for modification to address the same-sex acceptance throughout the country in various ways.

 

Will the law keep up with this continuing change?  We shall see.

There was an abolition of church and state long ago.  Yet with the advancement in numerous states across the country that have recognized the right of same-sex marriages, now come the religious battles that join with those legal rights.  What role does freedom of religion play here?  What recognitions should be given to religious exemptions?  What about the conflict between those states who do not recognize same-sex marriages versus those who do?  With advancement and change comes conflict especially when it relates to an issue that is both legal and faith based for many.  This is a very interesting article to say the least.

The Herald of the Joys afforded Same-Sex Couples this week in the ocean state also brought with it the opening of another door that may or may not be just as great as Attorney Neville Bedford filed what is believed to be the first same-sex divorce in The Ocean State of Rhode Island.

Christopher Pearsall's insight:

Since Massachusetts has had married same-sex couples for some time, some of whom have migrated to Rhode Island to carried on their married life .... and not officially so by law in the state, while others waited in line to get married it is not surprising that the first day of wedded bliss for many Rhode Island couples also carried with it the first same sex-divorce.

 

Whether it happened on the first day you could be married as same sex couples or next week is not of significance.  What is of significance is the consideration that it was going to happen, and with that underlying thought comes the herald of new law, new court perspectives, and new considerations that Rhode Island family law practitioners had better be prepared for in order to serve new same-sex clients properly.

 

Thankfully Rhode Island's bar has it's own committee and even an upcoming Continuing Legal Education Class to direct family law practitioners regarding issues that may need to be addressed differently as compared to heterosexual couples as well as issues with laws that have not yet been changed to this new change in Rhode Island's divorce and family laws.

 

I, for one, will be ready to help people with their same-sex divorces hopefully in an amicable capacity but also in instances where things aren't quite as friendly as the parties would like them to be.

 

Rhode Island is in for a change.  Yet that's the Ocean State for you!  Always a new wave is hitting the beach.

Is this the entire story or only half of the story.  Does it make sense that Rhode Island Family Law Practitioner would intervene in the manner described in the Providence Journal Article for no reason.  As an attorney was his intention to defend Macera and act as his counsel.  Little was said as to any reason given by Attorney Christopher Friel about the reason for his intervention but even in a state of intoxication there is usually a reason.  

 

The natural inclination of a lawyer is to intervene for a friend as if you were a hired attorney on his behalf.  

 

Do we believe everything we believe or is something missing?

 

Question People!  Always question!  Something is missing here.  What items are missing in your mind.  I know several come to mind to me.

This is certainly a very different take on same-sex marriage. Yet does it stand up to a logical common sense test as compared to a legal one? After 30 years in the music ministry of the church and dedicating his life to the catholic ministry this gay man got married and was instantly fired.  

 

Is this right?  The church says that they can't have a person of importance in their clerical staff who openly violates the canons of the church by getting married.

 

But when one door closes another door opens...as a pro-gay protestant church picks up a great music director this man begins to look a little more closely at his real identity.

Gay marriage is a matter of religious freedom for two reasons: First, a substantial component of the opposition to legalizing gay marriage is religious in origin. This is particularly true in Utah, where the Mormon Church has taken a lead role in opposing gay marriage. Interesting article of freedom of religion for Religion . in this article we see how over many century's Europes has had troubles with the right for freedom of religion . Finally the fighting has slowed down and freedom of religion is more accepted but now there is another problem, many people believe freedom of religion is freedom to marry whoever you want. The largest and most comprehensive study to date found that homosexual homes sets kids up for a host of problems later on.

The pros and cons of same-sex marriages continue to be debated. In New Mexico it seems that there are those who tout homosexual homes and marriages as being a more stable environment for children. Or perhaps the position is better stated that they believe it would create greater stability in various households by allowing same-sex marriages.

 

In this particular article it is debated that in fact what is being ignored are the facts as set forth in what is touted to be the most prominent study on the subject. Particularly it is argued that same sex marriages set children of for a host of problems later on in their lives.

 

This commentor not having read the particular study that is the subject of this article I'm not in a position to comment regarding whether it would or would not cause problems for children based upon whether or not the studies were competently conducted or whether or not there was some indicated bias in the performance of the studies.

 

What is most certain though is that states continue to join the ever-growing populace of other states that seem to be willing to accept same-sex marriages as something that should be allowable under the law.

 

No doubt for many this is a legal issue well for others this tends to be a moral issue. The question of "normality" aside and whether or not the definition of  "normality" is an ever-changing tide having to do with law, religion, morality and various other topics which need not be named is one of great debate in many circles, including those of a personal nature.

 

Ultimately, it cannot be denied that there is a trend toward more states accepting same-sex marriages. This may be true as a result of ever-growing lobbying, or it may be true simply because by failing to accept same-sex marriages from one state to another  it creates an incongruity  of legal decision-making from one state to another and at the federal level.

 

 Only the future will tell.

An interesting article to say the least. Yet is it biased or accurate. It would seem the author merely seeks governmental muster not only to recognize equality on a legal level but to impose it on an educational and moral level even for those who may feel differently about it than the law would provide. Must the law then provide strictures on language by teachers outside the bounds of formal education because the gay author (and perhaps the community) is not happy with those who may disagree with a particular lifestyle. I myself have numerous gay friends and I have had them since my 20's but does that necessarily mean that those who do not agree with such a lifestyle must be forced into conformity by edict of law? I agree with some points of the article but the author from my point of view takes it to such a level as to induce reverse discrimination upon those who do not agree with what may be viewed as an attempt at legal imposition of the gay agenda by power of law to control what may be purely a matter of personal choice, religious principal, or even personal morality. The article has many good points but for some it may go too far and intrude into the parameters of a person's own personal or moral beliefs. Whether gay or straight, I would never agree that the law should impose on a person a standard of belief that he or she does not adopt by virtue of his or her own conscience.

Once again another article brings forth the reality of Rhode Island divorce now that Rhode Island same-sex marriages are likewise a reality.

 

What is unfortunate are the statements made by Attorney Ken Schreiber about considerations to be thought of when it comes to same-sex marriage  is the direction toward consideration of pre-nuptual agreements.  While his statements are for the most part accurate they are far from the optimistic approach that same-sex couples might wish to pursue their relationships with.

 

There is no doubt a law for everything and yet the snippet seems more a "consideration for a sales pitch" rather than an optimistic look at marriage from the the outset.

 

Regrettably there were much more informed and knowledgeable attorneys in Rhode Island such as Attorney Lise Iwon that the press could turn to regarding considerations in this regard to get an accurate and overall picture from a proper perspective.

 

Nonetheless, things are changing in Rhode Island Family law and with it Rhode Island Divorce and Family Law Attorneys must change with it and so should the considerations of those same-sex couples who may be thinking about getting married.

 

As with any marriage.  My best goes out to happy and healthy couples as productive families in the Rhode Island communities.

It is amazing to thing that this is such a monumental breakthrough that it is a news topic.  One wonders if the first driver's license was in the newspaper.

This is in no way to belittle what has happened here.  Clearly this is a major change that affects people throughout not only the United States but the world as a whole.

The GLBT community has been looking for just such recognition for many years.  Many people wonder why.  Equality in the eyes of others? Recognition as within the bounds of what is "normal?"  Equal Rights under the law? Perhaps all of the above.

Whatever the case may be this couple seems to be very happy with the result whatever their reasons may be.

They celebrated on the back porch in Warwick with Chinese food and champagne. It was June 26. The Supreme Court had removed a long and terrible uncertainty from their lives. Friends e-mailed and called with congratulations.

Now with the end of DOMA, doorways are open that were never before available to same sex couples.  It is nothing short of ground breaking in the same way as when women gained the right to vote or when slavery was prohibited.  And with this change in those states that allow same-sex marriages there comes the domino effect relating to inheritance and intestacy, real estate ownership and tax treatment and the various laws that need to be addressed with such a monumental change in the law.

 

Some are puzzled by it.  Other people find it morally wrong.  Still others find it religiously reprehensible and sinful.  Judgments or not the law is the law as it stands and every person has a right to their opinions, morals and religious values.  As long as we respect those of others who advocate for new legal standards for things that are fully understandable and the law accepts, the world keeps on turning.
