TIMELINE: Human rights in 2012 - Amnesty - AlertNet @AMNESTY IGNORES LIBYA VIOLANTION OF #HumanRights | Saif al Islam | Scoop.it

"LONDON (AlertNet) - From the crisis in the Middle East to the arrest of Russian performers Pussy Riot, executions in the United States, Japan and other countries, and forced evictions across the globe, human rights have taken another battering in 2012.

Amnesty International said events in the past year should make leaders, companies and individuals the world over resolve to join the battle for human rights, as it published a timeline on Monday surveying some of the key human rights moments in 2012 to mark Human Rights Day.

"Across the world we see millions of individuals who have achieved extraordinary change against the odds," Salil Shetty, secretary general at Amnesty International, said in a statement. "These people stand in stark contrast to the governments which all too frequently stand by in the face of terrible violations from Syria to the Democratic Republic of Congo.

“Crimes such as torture, disappearances and violence against women remain commonplace in parts of the world even though progress elsewhere is there to be seen. What we want in 2013 is more action and commitment to ensure everyone can enjoy their dignity and freedom.”

Below are some of the key human rights events in the past 12 months, according to Amnesty. The list is not meant to be exhaustive but gives an overview of human rights trends and events around the world. "

OUTRAGEOUS »»» Russian athletes to remain banned from Rio - Court of Arbitration for Sport | Saif al Islam | Scoop.it
Secretary-General of the Court of Arbitration for Sport (CAS) Matthieu Reeb has announced that the CAS has declined the appeal by Russian athletes against an IAAF ban from the Rio Olympics competition.

The Russian Olympic Committee (ROC) lost its appeal against a blanket Olympic ban on its track and field athletes.

"CAS rejects the claims/appeal of the Russian Olympic Committee and 68 Russian athletes," CAS said in a statement.

The decision means that long-jumper Darya Klishina, who trains outside Russia, will be the only Russian track and field athlete cleared to compete in Rio

Matthieu Reeb has noted that ROC will not be able to appeal the ruling in the Swiss Federal Court.

The Kremlin "deeply regrets" CAS upholding the ban on Russian athletes, said presidential spokesman Dmitry Peskov.

"We can only express our deep regrets. The news is not too good, and we certainly will have to analyze the situation, taking in account the [CAS] decision, that's why I would avoid any further comments on that matter," the Kremlin spokesman said.

Russian Sports Minister Vitaly Mutko also offered his thoughts following the announcement.

"I will be brief, an official announcement will follow later. I regret CAS's decision. Unfortunately, by introduction of collective responsibility, it is the creation of a precedent. But we didn't expect a different result. When the IOC vice-president says that Russian athletes have nothing to do at the Olympics - it's certainly a signal,” said Mutko.

The International Olympic Committee (IOC), however, can make its own decision regarding the participation of Russian track and field athletes at the Rio Games as the CAS does not have the power to implement the ban itself.

God apparently uses Face Time. It was via that iconic iPhone footage from an undisclosed location shown live on CNN Turk by a bewildered female anchor that Erdogan managed to call his legion of followers to hit the streets, unleash People Power and defeat the military faction that had taken over state TV and proclaimed to be in charge.

So God does work in mysterious mobile ways. Erdogan’s call was heeded even by young Turks who had fiercely protested against him in Gezi Park; were tear-gassed or water-cannoned by his police; think the AKP governing party is disgusting; but would support them against a “fascist military coup.” Not to mention that virtually every mosque across Turkey relayed Erdogan’s call.

Presidency Council say charges too serious for Saif to be pardoned #Saif #Gaddafi #Libya #ICC #Zintan

The Presidency Council has weighed into the alleged release of Saif Al-Islam warning that he remains subject to Libyan and international claims that he committed crimes against humanity. In a statement issued today, the PC said that there could be no amnesty for such accusations.

“These charges do not lapse with the passage of time”, it said, “and are not subject to general or specific pardons, as per international conventions and international law dealing with human rights”.

It is being claimed that the Ministry of Justice in Beida issued a pardon, though the provenance of the document has been questioned. There has been no formal comment from the government of Abdullah Al-Thinni.

Al-Ajmal Al-Atiri, commander of Zintan’s Abubakr Al-Siddiq battalion has insisted that Saif has been freed but refuses to say where he is “for security reasons”. A British lawyer Karim Khan, who has represented Qaddafi’s second son and heir apparent, has also said that Saif is indeed free.

Gaddafi's son Saif, Libya's former heir apparent, released – lawyer | Saif al Islam | Scoop.it
The son of former Libyan leader Muammar Gaddafi, Saif al-Islam, has reportedly been released from prison, more than four years after he was caught trying to flee the country by a rebel militia, despite being sentenced to death last year.

“He is well and safe and in Libya,” his lawyer Karim Khan told France 24, revealing that his client had been set free back on April 12, though the news had not been made public until now.
Khan suggested that Gaddafi did not face any future charges, and was let go “in accordance with Libyan law.”

In 2015 a court in Tripoli, under control of Libya Dawn, a rival faction to the one holding him, sentenced him to death for ordering troops to fire at civilian targets, recruiting militia units, and inciting rape and murder during the Libyan civil war.

The trial was widely condemned by international organizations for slapdash judicial standards, and using confessions obtained under torture. Gaddafi was never handed over by the Zintan militia.

The 44-year-old Gaddafi is still wanted by the International Criminal Court in The Hague for a host of crimes against humanity, and war crimes associated with his father’s regime.
But Khan said that a repeat trial would constitute double jeopardy.

"It is prohibited to try an individual twice for the same offense," he insisted.

The urbane, London School of Economics-educated Gaddafi was often considered the second-in-command in Tripoli in the latter part of his father’s rule, and was touted to become his successor, before the war broke out.

The Sultan of (Emergency) Swing

The Sultan of (Emergency) Swing | Saif al Islam | Scoop.it
Amidst an astonishing, relentless, wide-ranging purge that shows no signs of abating, with 60,000 – and counting – civil servants, academics, judges, prosecutors, policemen, soldiers jailed, fired, suspended or stripped of professional accreditation, it’s relatively established by now the Turkish government was very much informed a military coup was imminent on July 15. The information may have come from Russian intelligence, although neither Moscow nor Ankara will reveal any details. So, once and for all, this was no false flag.

A top, secular Middle Eastern intel analyst with an Istanbul front seat view to the coup clarified the internal political context even before the – widely expected – proclamation of a state of emergency (if France can do it, why not Turkey?):

«They knew five to six hours beforehand that a coup was in the works and let it go ahead, knowing, as they must have, that it would fail… This affair has propelled Erdogan to semi-divine status among his supporters. The way is clear for him to get what he wants, which will be a powerful presidency and removal of the secularism principle in the constitution. This would set the stage for the introduction of aspects of Sharia law. He tried this in the early years of the AKP government with the introduction of Zina, a strictly Islamic provision, which would have criminalized adultery and could have opened the door to the criminalization of other islamically illicit sexual relations as Zina is about this in general and not just adultery. But when the EU objected he backed off».

Before Prosecuting Iraq War Criminals, US Must Deal With Afghan War Crime

Before Prosecuting Iraq War Criminals, US Must Deal With Afghan War Crime | Saif al Islam | Scoop.it
Iraq war criminals deserve to be prosecuted. Britain’s Chilcot report is only the most recent example of a worthy cause needing to be addressed. But in 1979, long before false intelligence was used to justify the Iraq war, a heinous war crime was committed against Afghanistan by President’s Carter’s National Security Advisor Zbigniew Brzezinski.

By Paul Fitzgerald and Elizabeth Gould

It’s not just Brzezinski who is culpable. It was the Washington bureaucracy that enabled Brzezinski to activate his Machiavellian plot of intentionally drawing the Soviets into his “Afghan Trap.”

How the Washington bureaucracy enabled Brzezinski's scheme and why it's still important today

Hands Untied? US Troops Relax Rules of Engagement in Afghanistan
Once the Soviets took Brzezinski's bait and crossed the border into Afghanistan on December 27, 1979 the fates of both countries were doomed. As if in a trance, a complacent bureaucracy turned a blind eye to the lack of proof of the American claims that the Soviet invasion was a step towards world domination. Within days the beltway became a cheering squad, enabling Brzezinski to fulfill his imperial dream of giving the Soviets their own "Vietnam." The bureaucracy's motivation was simple. Brzezinski was winning the only game in town, the Cold War against the "Evil Empire." The fact that Brzezinski's deceitful plot could lead to the death of Afghanistan as a sovereign state did not concern Washington's elites, either from the right or the left. Predictably, Afghans' lives have been turned into an endless nightmare that festers to this day. Not only is Brzezinski's scheme continuing to undermine Afghanistan's sovereignty, his Russophobia also drives NATO's unjustified aggression towards Russia today!

France says 3 soldiers killed during anti-terror mission in Libya | Saif al Islam | Scoop.it
PARIS — Three French soldiers were killed in Libya "while on a mission," the French Defense Ministry announced Wednesday in the first official confirmation that French special forces have been active in Libya in apparent operations against the Islamic State.

French officials gave few details on the deaths.

But the Associated Press, quoting Libyan officials, reported that the French soldiers were killed Sunday in an attack on their helicopter. An Islamist militia known as the "Defending Benghazi Brigade" claimed responsibility for the downing.

Islamic State fighters are now estimated to number between 2,000 and 5,000 across Libya, which has been gripped by unrest and political upheavals since a Western-aided uprising in 2011 brought down longtime ruler Moammar Gaddafi, who was captured and killed by rebels.

M of A - Libya - Part III - The Return Of The King Saif Gaddafi

The news of the release from a Libyan prison in Zintan of Saif Al Islam Gaddafi, heir apparent to his late father, is surprising to many outsiders but it nothing to what may come next - a return in some form to power.

In Libya’s 2011 Arab Spring uprising, Saif joined his father and sons on the barricades, castigating NATO-backed rebels in a bitter revolutionary war. While those rebels later cornered and killed his father Muammar and brother Moatasim in Sirte, Saif was captured alive trying to flee through the Sahara desert to Niger.

It may be his good fortune that the units capturing him were from Zintan, a mountain town south of Tripoli, who later went to war with Islamist led Libya Dawn which captured the capital in 2014. When a mass trial was held of former regime figures there, Zintan refused to hand Saif over, sparing him the brutalities inflicted on other prisoners including former intelligence chief Abdullah al Senussi and his younger brother Saif, who was filmed being beaten in a Tripoli prison cell.

Zintanis were no friends of the former regime, fighting against Gaddafi’s forces as one of the most effective rebel outfits during the uprising that was won by NATO bombing.

But from the few accounts of those allowed to visit him in a closely guarded compound somewhere in the town, he has been treated well, living under what amounts to house arrest, until now.

A year ago a Tripoli court operating under Libya Dawn auspices sentenced him, and either others including Al Senussi, to death. Up in Zintan, not much changed for Saif, with Zintan still digging in its heels and refusing to hand him over to Tripoli’s grim Al Hadba prison.

The shambolic UN-backed Government of National Accord (GNA) under a puppet PM who operates out of Tripoli naval base, the only part of the city they control, however appears to be responsible for the amnesty order given in April to Saif and other prisoners removing their death sentences and ordering them to be freed.

Since then, Saif’s location is a mystery, but Zintan’s attitude to him is tempered by their alliance with former Gaddafi-supporting tribes, including those from Beni Walid and Warshefani, in their brutal battle with Libya Dawn’s Islamists. The Gaddafi tribe itself has a base south of Zintan around Sebha, making common cause with the Zintanis against Libya Dawn militias who control the capital and lord it over the GNA.
