Uma das aberrações jurídicas mais épicas de nossa era está sendo desmascarada.

O Grupo de Trabalho sobre Detenções Arbitrárias da ONU – o tribunal internacional que analisa e decide se os governos cumprem ou não suas obrigações em matéria de direitos humanos – julgou que Julian Assange está sendo detido ilegalmente pelo Reino Unido e a Suécia.

Após cinco anos lutando contra difamação impiedosa, Assange está mais próximo de obter justiça – e, quem sabe, liberdade – do que jamais esteve, desde que foi aprisionado em Londres sob um Mandato Europeu para Extradição, agora já desacreditado pelo próprio Parlamento britânico.

O Grupo de Trabalho da ONU baseia suas decisões na Convenção Europeia sobre Direitos Humanos e em três outros tratados de cumprimento obrigatório por seus signatários.

Tanto o Reino Unido quanto a Suécia participaram da investigação oficial da ONU, que durou 16 meses. Será um tapa na cara do direito internacional se estes países não acatarem a decisão e permitirem que Assange deixe o refúgio oferecido pelo governo equatoriano em sua embaixada de Londres.

Em casos anteriores que o Grupo de Trabalho julgou, e foi festejado internacionalmente, ambos os países apoiaram as decisões do tribunal sobre prisioneiros detidos ilegalmente.

Foi o caso de Aung Sang Suu Kyi, em Myanmar; do líder oposicionista Anwar Ibrahim, na Malásia; e do jornalista do Washington Post Jason Rezaian, no Irã.

A diferença agora é que a perseguição e confinamento de Assange acontece no coração de Londres.

O caso Assange nunca foi, primordialmente, sobre as alegações de má conduta sexual na Suécia – onde a chefe da promotoria de Estocolmo, Eva Finne, julgou a acusação improcedente, dizendo: “Eu não acredito que exista qualquer razão para suspeitar que ele tenha cometido estupro”.

Além disso, uma das mulheres envolvidas acusou a polícia de fabricar evidências e forçá-la a prestar queixa, sendo que ela “não queria acusar Julian Assange de coisa alguma”.

Foi quando um segundo promotor, misteriosamente, reabriu o caso após intervenção política.

A perseguição a Assange tem suas raízes do outro lado Atlântico, numa Washington dominada pelo Pentágono.

Sua obsessão é perseguir e acusar whistleblowers – especialmente Assange e o WikiLeaks — por terem exposto os crimes cometidos pelos EUA no Afeganistão e no Iraque: a matança desenfreada de civis e a violação da soberania dos países e da lei internacional.

De acordo com a Constituição dos EUA, nenhuma dessas revelações é ilegal. Como candidato à presidência, em 2008, Barack Obama, professor de direito constitucional, afirmou que os whistleblowers são “parte de uma democracia saudável [e] devem ser protegidos contra qualquer vingança”.

€5 million: How much the Parliament spent to broadcast the European Parliament election results live from the Brussels plenary chamber

75: The number of staffers the European finance department claims it would need to oversee how MEPs are spending their general expenditure allowance, so for now there’s no oversight. Too costly!

I’M AN OFFICIAL, GET ME OUT OF HERE! The European Parliament’s employee unions are up in arms about the latest injustice from management: the thought of making EU officials work in cubicles. SHOCK! HORROR! Eurocrats are not poultry, they cry! An e-mail from the trade union SAFE with the subject line “Help! They want us to work in cubicles” seemed pretty desperate for a reality most workers accept. It compared the conditions to chicken pens. “There may be an EU directive protecting chickens and other poultry and improve their welfare, but EU officials and agents will be confined in small spaces when moving to a new building by 2018-2019,” the email says. “We will have to work in ‘cubicles’ — a kind of mini-compartmentalised work spaces, chicken pens actually — as offices.” The union even compared the work environments to “a choice between plague and cholera.” Welcome to the Third World, Eurocrats. Playbook will get you through it. We work in an open environment and quite like it that way.

THE TRAIN THAT NEVER CAME: MEPs were promised a direct train link from the European quarter to Brussels airport by December 2015, but the project has been delayed and they’re still waiting. Not even the legislative might of the European Parliament can move the project along any quicker. In the meantime, we’re all still dealing with the Schuman metro station obstacle course. The mezzanine level of the station now appears to be complete — no more temporary lighting, cables to trip over or dodgy surfaces. Instead, there is now a brightly-lit, cavernous, empty space the size of a school gym. It’s still a daily mystery as to which of the escalators will be working/not working. Now … which small member state can get finishing the station into the U.K. renegotiation deal? It might be our only hope.

Russia’s intervention in Syria has produced many astounding results since it began late last year, and they seem to be continuing into the new year too.

Major General Igor Konashenkov is reporting that the Russian airstrikes have hit almost 900 targets from 1-4 February in Aleppo, Latakia, Homs, Hama and Deir ez-Zor, which have caused the terrorists to sustain heavy losses:

“In order to retain at least some semblance of a fighting capacity, the militants’ forces in the Syria’s northern regions continue abandoning their positions and falling back to the Turkish border.”

Furthermore, despite widespread Western, alarmist claims of besieged settlements as they seek to further demonise Assad and the Syrian government, Konashenkov reports the following:

“The soldiers of the Syrian Arab Army, aided by popular forces, have driven back the militants in the province of Aleppo and lifted the blockade from the settlements of Nubul and az-Zahra that were besieged for over four years.”

One of the epic miscarriages of justice of our time is unravelling. The United Nations Working Group on Arbitrary Detention - the international tribunal that adjudicates and decides whether governments comply with their human rights obligations - has ruled that Julian Assange has been detained unlawfully by Britain and Sweden.

After five years of fighting to clear his name - having been smeared relentlessly yet charged with no crime - Assange is closer to justice and vindication, and perhaps freedom, than at any time since he was arrested and held in London under a European Extradition Warrant, itself now discredited by Parliament.

The UN Working Group bases its judgements on the European Convention on Human Rights and three other treaties that are binding on all its signatories. Both Britain and Sweden participated in the 16-month long UN investigation and submitted evidence and defended their position before the tribunal. It would fly contemptuously in the face of international law if they did not comply with the judgement and allow Assange to leave the refuge granted him by the Ecuadorean government in its London embassy.

In previous, celebrated cases ruled upon by the Working Group - Aung San Suu Kyi in Burma, imprisoned opposition leader Anwar Ibrahim in Malaysia, detained Washington Post journalist Jason Rezaian in Iran - both Britain and Sweden have given support to the tribunal. The difference now is that Assange's persecution and confinement endures in the heart of London.

The Assange case has never been primarily about allegations of sexual misconduct in Sweden. The Stockholm Chief Prosecutor, Eva Finne, dismissed the case, saying, "I don't believe there is any reason to suspect that he has committed rape" and one of the women involved accused the police of fabricating evidence and "railroading" her, protesting she "did not want to accuse JA of anything". A second prosecutor mysteriously re-opened the case after political intervention, then stalled it.

The Assange case is rooted across the Atlantic in Pentagon-dominated Washington, obsessed with pursuing and prosecuting whistleblowers, especially Assange for having exposed, in WikiLeaks, US capital crimes in Afghanistan and Iraq: the wholesale killing of civilians and a contempt for sovereignty and international law. None of this truth-telling is illegal under the US Constitution. As a presidential candidate in 2008, Barack Obama, a professor of constitutional law, lauded whistleblowers as "part of a healthy democracy [and they] must be protected from reprisal".

Obama, the betrayer, has since prosecuted more whistleblowers than all the US presidents combined. The courageous Chelsea Manning is serving 35 years in prison, having been tortured during her long pre-trial detention.

The prospect of a similar fate has hung over Assange like a Damocles sword. According to documents released by Edward Snowden, Assange is on a "Manhunt target list". Vice-President Joe Biden has called him a "cyber terrorist". In Alexandra, Virginia, a secret grand jury has attempted to concoct a crime for which Assange can be prosecuted in a court. Even though he is not an American, he is currently being fitted up with an espionage law dredged up from a century ago when it was used to silence conscientious objectors during the First World War; the Espionage Act has provisions of both life imprisonment and the death penalty.

It looks like the U.S.-led fight against ISIS is probably moving to Libya. AFP reports there are plenty of people in the Defense Department worried about ISIS’ movement into the North African country.

About 5,000 IS jihadists are now in Libya, the defense official said, approximately double earlier estimates, while the number of IS extremists in Iraq and Syria has dropped.

The updated tallies come as the administration of President Barack Obama faces growing calls for the US military to step up action against the IS group in Libya, where the jihadists have already seized the city of Sirte and an adjoining length of Mediterranean coastline.

NATO defense ministers are meeting in Brussels next week to evaluate the ongoing US-led coalition campaign against the IS group and to discuss ways of redoubling efforts.

It doesn’t appear President Barack Obama is interested in getting militarily involved in Libya, but that doesn’t mean the Pentagon isn’t pushing him. One thing The New York Times points out is not on the table is “ground troops” (emphasis mine).

Mais les tribunaux qui l’ont poursuivi depuis plus de deux ans l’accusent d’avoir écrit un ouvrage blasphématoire : Instructions internes. Dans ce recueil de poèmes, l’artiste palestinien affirme avoir simplement voulu évoquer des « questions culturelles et philosophiques ».

The UK and Sweden should respect and abide by UN panel ruling if it establishes that Wikileaks’ founder Julian Assange’s detention in London is illegal, Kristinn Hrafnsson, the group’s spokesman, told RT. He said its ‘unthinkable’ to undermine the panel’s decision.

If the leaks of UN panel’s ruling in favor of Assange are confirmed on Friday, the whistleblowing organization expects British authorities to lift the arrest warrant against the Wikileaks founder, “hand him his passport back and secure his freedom,” he said.

UK Prime Minister David Cameron said through his spokesman that the UN panel decision wouldn’t be legally binding and if Assange leaves the Ecuadorian embassy, an arrest warrant will be put into effect.

A last ditch effort to stop a Russian-led military offensive in northern Syria ended in failure on Wednesday when the Syrian Arab Army (SAA) backed by the National Defense Forces (NDF) and heavy Russian air cover broke a 40-month siege on the villages of Nubl and al-Zahra in northwestern Aleppo province. The Obama administration had hoped that it could forestall the onslaught by cobbling together an eleventh-hour ceasefire agreement at the Geneva peace talks. But when the news that Syrian armored units had crashed through al Nusra’s defenses and forced the jihadists to retreat, UN envoy Staffan de Mistura suspended the negotiations tacitly acknowledging that the mission had failed.

“I have indicated from the first day that I won’t talk for the sake of talking,” the envoy told reporters, saying he needed immediate help from international backers led by the United States and Russia, which are supporting opposite sides of a war that has also drawn in regional powers.” (Reuters) De Mistura then announced a “temporary pause” in the stillborn negotiations which had only formally begun just hours earlier. Developments on the battlefield had convinced the Italian-Swedish diplomat that it was pointless to continue while government forces were effecting a solution through military means.

Media report that "the Geneva Conference on Syria announced that it has been postponed til February 25th".

The pro-government Russian media often explain the failure of the talks in Geneva by the success of the military intervention of Russia enabling the advance of the Syrian army.


Personally, I’ve paid attention to the fact that the delegation of ‘opposition’ forces, before coming to Geneva, spent a week in Saudi Arabia being coached on how to behave.

Saudi Arabia is the birthplace of Wahhabism, which constitutes two-thirds of the ideology of ISIS.

In 1744 Muhammad ibn Abd al-Wahhab was exiled from his native town of Uyyauna where he preached a return to the pure beliefs of old times. He arrived in Diriyah, another small town whose people were poor, not wihstanding good soil. The city was known for its orchards and fig plantations, its emir and a bandit named Muhammad ibn Saud. The two Muhammads discovered they were meant for each other.

Wahhabism rejects the deifying of Mohammed and condemned Muslims who prayed at the graves of the saints, criticizing the custom of marking the grave with names, denounced everyone who was not a Sunni Muslim and even some Sunni groups (including the Sultan and Caliph in Istanbul) as heretics. This provided a political and religious justification for a jihad against other Muslims, especially Shiites, including the Ottoman Empire.

By 1792, when Ibn Wahhab died, the Saudi-Wahhabi forces had conquered the city of Riyadh (the current capital of Saudi Arabia), Harzh and Kazim. In 1803 they captured the holy city of Mecca and destroyed the tomb of the Prophet and the Caliphs! That’s when the Islamic State came into being.

So make no mistake: as long as the rogue state of Saud Arabia exists, talks involving Islam will fail.

But at least it is being rolled back in some places. Ramadi in Iraq was retaken in December. Oil installations controlled by IS have been bombed, sapping the economic and the fighting power of the jihadists. In Libya, though, the picture is more alarming: the caliphate is building a sprawling new “province” on the southern shore of the Mediterranean, just a few hundred miles from Europe. This is the new front in the war against jihadism.

Picture sleepless nights at ‘Sultan’ Erdogan’s palace in Ankara. Imagine him livid when he learns the Syrian Arab Army (SAA), backed by Russian air power, started a preemptive Battle of Aleppo – through the Bayirbucak region - cutting off Ankara’s top weaponizing corridor and Jihadi highway.

Who controls this corridor will control the final outcome of the war in Syria.

Meanwhile, in Geneva, the remote-controlled Syrian opposition, a.k.a. High Negotiations Committee, graphically demonstrated they never wanted to meet with the Damascus delegation in the first place – “proximity” talks or otherwise, even after Washington and Moscow roughly agreed on a two-year transition plan leading to a theoretically secular, nonsectarian Syria.

The Saudi front wanted no less than Ahrar al-Sham, Jaysh al-Islam and all Jabhat al-Nusra, a.k.a. al-Qaeda in Syria, collaborators at the table in Geneva. So the Geneva charade, quicker than one can say “Road to Aleppo!” was exposed for what it is.
And forget about NATO

Notorious Saudi intel mastermind Prince Turki, a former mentor of one Osama bin Laden, has been to Paris on a PR offensive; all he could muster was an avalanche of non-denial denials - and blaming the whole Syria tragedy on Bashar al-Assad.

The bulk of the Syrian ‘opposition’ used to be armchair warriors co-opted by the CIA for years, as well as CIA Muslim Brotherhood patsies/vassals. Many of these characters preferred the joys of Paris to a hard slog on Syrian ground. Now the ‘opposition’ is basically warlords answering to the House of Saud even for bottles of water – regardless of the suit-and-tie former Ba’ath Party ministers handpicked to be the face of the opposition for the gullible Western corporate media.

Meanwhile, the ‘4+1’ – Russia, Syria, Iran, Iraq, plus Hezbollah – is now winning decisive facts on the ground. The break down; there won’t be regime change in Damascus. Yet no one broke the news to the Turks and Saudis.

‘Sultan’ Erdogan is wallowing in a sea of desperation. He continues to divert the gravely serious issues at stake to his own war against the PYD - the umbrella organization of the Syrian Kurds - and the YPG (People's Protection Units, their military wing). Erdogan and Prime Minister Davutoglu wanted the PYD not only banned from Geneva but they want it smashed on the ground, as they see the PYD/YPG as “terrorists” allied to the PKK.

Saudi Arabia expressed its readiness to send ground troops to Syria if the US-led coalition decided that such operation is necessary, an adviser to the Saudi defense minister said.

"The kingdom is ready to participate in any ground operations that the coalition [against Islamic State] may agree to carry out in Syria," Brigadier General Ahmed Asseri, who is also the spokesman for the Saudi-led Arab coalition in Yemen, told al-Arabiya.

According to Asseri, Saudi Arabia has been an active member of the US-led coalition since the country’s warplanes carried out more than 190 aerial missions against Islamic State targets.
