an article by RI Car Accident lawyer David Slepkow 401-437-1100
excerpt:

On January 7th 2013, a nurse was involved in a serious multi-vehicle head-on accident while travelling southbound on South Main Street in Houston Texas. She was driving a Toyota Camry. The negligent nurse, who fell asleep at the wheel, and was at fault for the collision was on her way home after working an overnight 13 hour shift at a hospital.

The crash was apparently caused by drowsy, sleepy driving because the at fault motorist fell asleep at the wheel.  This was apparent by a cursory review of police reports and emergency medical technician (EMT) records.  The drowsy driving conclusion was also evident by the tired driver’s numerous admissions at the scene of the wreck. These admissions were made to police, emergency workers and medical personnel dispatched to the scene of the head-on accident.

Despite overwhelming evidence of the motorist falling asleep at the wheel, for some reason the NTSB decided to investigate it. Predictably the NTSB concluded that this was in fact a tired overworked motorist dozing off at the wheel of her automobile.

an article by RI Personal Injury lawyer David Slepkow 401-437-1100
excerpt:

There are several causes of motorcycle accidents on the roads. The rising concern at the increasing cases of motorcycle accidents lead to a comprehensive survey made in 2009. This survey compiled a list of possible causes for motorcycle accidents on the road. By identifying the causes behind serious motorcycle crashes, it is easier to minimize their occurrence and make the road a safer place.

Understanding the causes helps in taking preventative measures to stop motorbike accidents.

  1. Careless maneuvering by other drivers on the road: Four-wheeled vehicles tend to cause more motorcycle accidents than others. Most drivers are unable to detect motorcyclists or do not pay enough attention to them. They tend to make abrupt swerves that invariably results in a fall or collision. Motorcyclists are either forced off their bikes or make hard hitting physical contact resulting in severe injuries to the arm, neck and face areas.
  2. Loss of control of bike: Many motorcyclists have been victims of accidents because they were unable to control their motorcycles and took a skid or fall. In a motorcycle crash of this nature, the rider’s arms or legs often tend to get caught beneath his machine resulting in serious lacerations or even fractures. Control is defined as the ability to stop the bike at will in a safe manner.
  3. Sudden stops trigger accidents: Speeding was not a contributing factor for bike accidents. More clearly indicated was the occurrence of sudden stops as a cause for accidents. In fact, statistics indicated that as much as 70% of motorcycle accidents occurred when the motorcyclist was cruising at speeds less than 30 miles per hour. The solution is that motorcyclists are advised to slow down instead of clamping down the brake. The sudden switch in momentum makes the rider fly over the bike and sustain serious injuries.

The nation’s auto regulatory authorities have also backed the technology. Last month, the US Department of Transportation said that it is considering making it mandatory for all automakers to adopt such V2V communication systems by 2016, as a part of its efforts to solidify industry-wide standards for customer safety.

Moreover, auto safety watchdog, the National Highway Traffic Safety Administration (NHTSA), is also pushing for a regulation that will in six months require automakers to install automatic braking systems.

A Busy Year For Auto Industry Regulators

Regulatory authorities around the country have been actively probing automakers and safety parts’ suppliers to ascertain any potential negligence as to customer safety.

The world’s second-largest provider of auto safety parts, Takata Corp UNSP (ADR) (TKTDY), is being probed by the NHTSA for manufacturing potentially damaged airbags, which are then installed in vehicles of various American and Japanese automakers. This led them to collectively recall over 6 million vehicles this year for the airbag defect, identified by faulty airbags rupturing upon deployment.

In March, Toyota Motor Corp (ADR) (TM) agreed to pay a penalty of $1.2 billion for settling a four-year criminal probe regarding delayed auto recalls in 2010, stemming from an unintended yet serious acceleration defect owing to sticky gas pedals.

Nationally, according to the National Highway Transportation Safety Administration, “approximately 29.7% of all crashes in the year 2000 were rear-end crashes. These crashes were responsible for 30% of all injuries and 29.7% of the property damage.” http://www-nrd.nhtsa.dot.gov/Pubs/809-540.PDF

A large majority of auto wrecks in the Ocean State constitute what is commonly known as “rear enders”. Rear- end accidents in Rhode Island are easier to settle with Insurance Liability Adjusters than other types of vehicular collisions.

an article by RI Car Accident lawyer David Slepkow 401-437-1100
excerpt:

Anytime a moving vehicle hits a pedestrian in Rhode Island, the results can be catastrophic or fatal. The National Highway Traffic Safety Administration (NHTSA) indicates that nearly 4800 pedestrians were killed in 2012 in crashes involving a motor vehicle. In addition, there were 76,000 pedestrian injuries recorded in the same year.

Not every  RI car accident that involves a pedestrian occurs at a dangerous intersections or crosswalks. In fact, many walkers believe they have the right of way in nearly every situation along the Providence roadways, and often fail to obey RI traffic related laws enacted for their protection. However, one of the leading causes of pedestrian injuries and fatalities involves alcohol impairment, which plays a key factor in nearly half of all pedestrian deaths.

Determining Responsibility for a Rhode Island Pedestrian accident

Often times, it is challenging to determine which party is at fault or responsible for causing the accident in Rhode Island. In almost every incident, the case will be determined by negligence, which refers to the careless or reckless action of one or both parties. In most motorist/pedestrian accidents, determining the right-of-way can be confusing.
